I have lost my beloved wife from Belarus do to cancer. We were married 21 months so were still on the 2 year green card. My question is what now with the 20 year old son? I want him to remain in the USA and am not sure what to do. Adopt him? Just apply within the 90 days of green card status and show up with her death certificate? Any help will be appreciated.

He can file the I-751 himself. He should check box "b" in part 2 of the form, and attach an explanation why he cannot be included in the joint petition with his mother (e.g., because his mother has passed away). He should include a copy of her death certificate.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I am sorry for your loss.

I am in a similar situation to yourself, except my wife was the USC and I am the foreigner. My wife had a son from a previous relationship whom I now consider to be my own, since his birth father wants nothing to do with him and is essentially human scum for other, unrelated, reasons.

Once I have my GC I plan on adopting him here in Texas, and eventually applying for British citizenship by registration on his behalf, too.

You should consult with a family lawyer in PA to investigate adoption, if that is what you choose to do.

Adoption will not work since he is now an adult.

He can file alone to remove the condition on his green card. Include his mom's death certificate.

Many states recognise adult adoption, including PA. I'm talking more from keeping the family together rather than conferring immigration benefits.
