HERE IS MY SITUATION 4 WEEKS AGO MY FIANCE ARRIVED IN AMERICA SO SHE CLAIMS.SHE ARRIVED HERE ON THE K1 VISA .SHE DECIDED TO GO TO WASHINGTON DC TO VISIT HER FAMILY SUPPOSEDLLY.HERE IS THE WEIRD THING I HAVE NOT SEEN HER ONCE OR I HAVENT EVEN REALLY SPOKEN TO HER.EVERYTIME I TRY TO TALK TO HER THERE IS ALWAYS A EXCUSE WHY SHE WASNT ABLE TO CONTACT ME.SHE MADE THE PLAN TO GO TO GO DC WITHOUT MY KNOWING SHE WAS SUPPOSED TO COME TO CHICAGO.SO I GAVE HER THE BENEFIT OF DOUBT.ITS BEEN 4 WEEKS AND THE GAME SHE IS PLAYING IS STILL GOING ON.WE BOTH CAME TO THE CONCLUSION SHE WOULD COME THIS SATURDAY MAY 5.I TALKED TO HER ON SUNDAY AND SHE SAID SHE NEVER SAID SHE AGGREED ON COMING HER ON SATURDAY.WE ONLY HAVE 90 DAYS TO MARRY AND SHE HAS ALREADY WAISTED OVER 20 DAYS.I TOLD HER AGAIN TO COME HER ON SATURDAY AND SHE SAD SHE WILL COME.I HAVENT HEARD FROM HER SINCE LAST SUNDAY SO I AM NOT SURE IF SHE IS REALLY COMING. Darnell will be along with the proper procedures to follow but just to let you know, I think she is scamming you and just used you as a ticket to the US. Don't marry her and she will be out of status when her I-94 expires (usually 90 days after arrival). There only way she can adjust status from a K-1 visa is marriage to you. Do not marry her if she has treated you in this manner already, she has made it plain she has no interest in being with you.

Once she realizes she cannot legally stay in the US any other way she may come crawling to you with excuses for her behavior and promises that she has no intention of keeping just to marry you. Then either she will leave when she has her green card (she doesn't need you after that) or if you marry and don't file her adjustment of status she may try to file a VAWA (violence against women act) petition by claiming you abused her.

From what you've told us here it does seem that being with you is not high on her priority list.

If she wants to stay, she has to marry you. There is a small, small chance for her to adjust status without marrying you. But that's not something you should hold out as a threat or inducement to come to you.

My personal opinion: be very wary and don't allow your emotions to cloud your judgement. Have you talked about you going to DC to meet her and the family? If she says no, then it is sounding more like you're being taken advantage of.

Most K1 couples spend the first 4 weeks in bed and shopping... Your case is far from normal... If she truly 'loved' you she would not have been gone for the extended time without some serious issue having come up.. hospitalization etc... at thispoint, it is obvious that you are just a ticket here.. sorry to say it but thats it..

Sorry dude, I really do feel sorry for you. Although you are in love with her, she does not feel the same way. Think about it, all other couples here, including myself, are so desperate and anxious to get hold of this Visa so they can marry their loved ones. Your fiancee does not seem so desperate to plan the wedding nor be with you. if she would rather give you the run around and make excuses then be with you, then you are better off! So sorry to hear of your apparent woe. As indicated at the bottom of this page..... you can either call ICE or email ICE. It may be wise to consider emailing ICE. You are headed into an area where good documentation of who, what, and where did you communicate with, may be necessary. Protect yourself, and properly document your activities in this matter.

Where is she from? How did you meet?

If you believe that you've been used it's best to have no in person contact with her. That way there can be no allegations of any sort of mistreatment. Call and write ICE. Document EVERYTHING.

I've read the responses and advise given. All I can add is, do NOT contact her anymore. Contact ICE and report her. Document everything: from the tickets you purchased to all your attempts to contact her. If you called her from a mobile phone, get a detailed bill where it proves how many times you tried to call her and whether there was any response or not. If you have emails, add them too. Then stop the moment you report her. She IS using you. She is scamming you.

I'm sorry this is happening to you. It does sound very fishy... If you bought the ticket to ORD how did she make it to IAD? Either way............... I can't even imagine how you must feel. If I were you, I would call/email her very nonchalantly and try to get as much info as possible... HELL I would even ask her for an address with the excuse of sending a gift for her! ... She will probably give it to you... evidently she trusts you, but is not very bright. You can later provide said address to ICE...
