No, you will not be able to apply for AOS. Since you are abroad, you opted for consular processing on the I-130, so USCIS will automatically forward it to the NVC. You will have to wait for their reply. Best of luck to you and your wife!

Is K3 still an option or is it obsolete?

 

My wife who's a us citizen is applying for my immigration by tomorrow and i'd really want to be there for my kid's birth and am looking for faster ways which can get me there, we're expecting by the end of October, 2017.

Sorry, but there is no way you will get a visa by October.  You will miss your child's birth.  The US will not expedite your case because your wife is pregnant.  Sorry.

You qualify for a tourist visa based on your intent to return home.  For a tourist visa, your reasons to return home is essential.

 

The birth of your child is not a valid basis to grant you a tourist visa.  Your reason for coming to the US is not important.

 

Planning to enter the US on a non-immigrant tourist visa with the intent to adjust status is visa fraud.

I agree with Jojo.  The K3 is obsolete, and even if it wasn't, most likely it would not meet your timing.  You could probably apply for a visitor visa, but that may be a waste unless you have perfect ties to show you would return.

I agree with the other responders.  If you have perfect ties to show the IO you do not plan to stay on a tourist visa you can certainly attempt an application.  As the others have said, a tourist visa focus is on the intent to return before the visa expires, not the reasons for wanting the visa in the first place, except for how the IO feels those reasons may cause you to react and keep you from returning.

K-3's are obsolete and almost never issued. Your only option at this point is the CR-1/IR-1 spouse visa.

Hi,

So the K-3 is no longer an option.  You can expedite at the National Visa Center stage for your wife's pregnancy.

However if you haven't already started the visa process - I think its pretty likely that you won't make it for the birth.

IF you ARE at at the NVC stage.. I can give you the steps to expedite your case.

Expedite requests are usually not granted for this as it does not meet the established criteria for granting one.

Hi Ryan,

It is possible.  I know because I am someone who DID get their expedite for pregnancy approved.

I had a normal complication free pregnancy - alhumdualillah. 

 

One can ask for an expedite for numerous reasons including pregnancy, money hardship etc.  

 

NVC's and well as the consulates - are staffed by people who I think deep down want to be compassionate and help reunite couples, families etc instead of extending processes and wait times.

 

I sincerely hope that this couple is able to be reunited quickly and that the poster is able to see his wife and child to be as soon as possible.

A normal pregnancy is not a reason to expedite.

 

I presume everybody wants their case to go quickly.
