    Sometimes the family is in on it for the greater good of the family.
     
    What makes you think you were duped? Could it be that it just did not work out? I’m just asking because on the flip side people don’t realize the strain of someone uprooting and relocating their life to a foreign land. And sometimes foreigners have an unrealistic view because the American dream is often something they see on tv. So when those 2 things clash with real life, all the lovey dovey feelings you had when visiting goes out the window. 
     
    What stage are you in? You don’t have a timeline completed. What would the class action be for? There’s really nothing you can do unless you have solid proof. Hearsay and speculation won’t cut it with USCIS. It may be best to let the process run its course so you can be off the hook for the 864. Best of luck to you.

    It's impossible to prevent this type of fraud.

    The petitioners are in the best position to protect themselves since they are asserting that the relationship is real.  If they rush after meeting once or whatever, it's on them
     
    A mandamus for what?  What would you like the US government to do?  

    Class action?  Not going to happen.  

    Sorry that you got scammed.  Realize that you are angry.  If the US government had denied your case or caused delay, you would've have been up in arms.  

    You are in the best position to protect yourself.  Be aware of this type of fraud.  Don't rush into marriage and bringing them over.

    Can you ask her if she'd be interested in filing a mandamus action or class action lawsuit or give her my information please?

    My friend that is a lawyer says that it is more common when you marry within 1 year of meeting in person, met online and  immediately start sending money and buying gifts, does not introduce you to family and friends, among others.

    1. No. You have to have the EAD in order to work.
    2. Nope. Still considered work.
    3. Yes. Usually with a job offer or evidence of extreme financial hardship
    4. No. You have to have the AP to be able to travel and return
    5. If AOS is complete before AP then there will be no need for AP. That is one of the reasons why the fee for AP is waived when applying for AOS.
     
    And this is why the K1 visa sucks. Yes, it has benefits in certain situations but the spousal visa is far more superior. With the spousal visa you would be able to do everything you just asked about from day 1of entering the US. People mostly get caught up in the "it's faster" part of the K1 yet overlook all of the limitations it come with it.
     
    If working and traveling is important to you then the K1 visa is not the way to go.

    Passport with issued visa arrived in mail today. I guess experiences are different coming from NZ and not a 3rd world country.

    If you deem that this is enough to delay, then I presume there is no rush for you guys. In that case you must go with your conscience. There really is no way to know. He has been reversing a few things but I have personally not heard he would be doing that, yet. If your spouse is also ready to wait 25 years, then you should wait and not go against your deep beliefs. But personally I would have just gotten this done now ASAP, and then either voted to make sure the right politicians are elected in the future, advocated for that change as a US citizen, brought it up to her senators or representative. Remember things that are bad can always get worse. Maybe for 4 years they will go in a (good) direction, and then maybe in 4 years they will get worse. 
    You know how human nature is. People were satisfied with one guy who served 2 terms, then decided maybe it's time for a change and time to experiment something new. Well, we all saw how that experiment ended...
    Final thought: If that is the only question bothering you I think there are 128 questions in total. So that's a 0.78% (it's actually not, but I am simplifying the statistics here) chance she gets that question.

    the new civics test is not a president thing, Biden won't do a thing, Immigration and citizenship change their citizenship test every 10 years, regardless of whoever is President at the moment
     
    I applied for citizenship in 2010, the test had just changed to the 100 civics questions, before it was 150 questions to study, I waited and tested with the 100 civics questions one, so 10 years later, they revised and made a few changes to the test.

    Do you object to only 1 question? If you can afford to make 1 wrong answer, then answer it the way you want if you get that question. I am actually glad that USCIS does not make us sing the national anthem and write the Pledge of Allegiance as our only oral and written tests.
     
    Just apply and get this over with. This way you don't need to worry about the requirements for being an lpr. Also, we need more voters and a louder voice!

    Or you could take the view that the sooner she gets her citizenship, the sooner she can vote to help implement what she sees as right. Is it worth potentially missing the midterm elections waiting for them to change the questions, for example?

    Marriage, in itself, confers no immigration or visiting rights.  In fact, it can harm chances of a tourist visa........seems that your friend is misinformed.

    I dunno - a German dude who started a UK wedding website in late Q4 2020, ordained by an American marriage ministry - it all sounds rather dodgy at best.  That, in and of itself, in addition to the immigration instructions, would flag up in the system.  
     
    I get it - you want to be together.  I had to leave the US and move out of country for 18 months with my kids to prevent visa overstay and ensure we'd get our visas.  All we wanted was to come home and be together, but this sounds FAR too risky.

    It SPECIFICALLY says ".....where one party is not present during the marriage ceremony......"  "...unless the marriage has been consummated;..." Seems extremely clear to me.  The marriage MUST be consummated prior to starting the immigration process.

    I had a look at the web site as I could see from the bit posted it was not put together by a native english speaker.
     
    Any company that does not list its address, who you can only contact by email or WhatsApp rings alarm bells with me.
     
    Who they are, where they are is unclear, well probably could find out more with more digging.

    @krose The law is clear...You must have evidence of being physically together AFTER the online ceremony to even start the CR-1 process.  That website you show is not a source for immigration law......whereas, the following is:

    I am not sure anyone can predict what the CO will do here.  Since it appears the Dr. for you physical did not list you as an addict, the CO could determine you are admissible.  If the CO does deny it and a waiver is available, they will tell you then.  I guess I would be prepared for the worst and hope for the best which it appears you already are.

    Yes! He is going to become a citizen when his window opens, though reluctantly, and thankfully  Argentina definitely allows dual-citizenship because he refuses to ever give that up (not that he can lol). He is going to do his citizenship just to have it, even though we may end up going back to Argentina to live. 

    As a side note, there is no real difference between living in the US as an LPR or citizen though. My husband has no interest in staying in the US if we were ever to divorce (not that we will )

    In 2009 Argentina decided that the Argentine Citizenship is a human right and cannot be renounced.

    Consequently an Argentine citizen may not be able to acquire the citizenship of a country that requires renunciation of other citizenships; however, many countries waive this requirement if renouncing the other citizenship is impossible."
     
    I'm an Argie with dual-citizenship. All of my ARG family members are dual citizens.

    Your friend can stay as long as her authorized stay.  If they overstay their current visa, then it can cause issues.
