    After you marry, you can file Adjustment of Status. However, during that time the foreigner cannot travel internationally. You will need to wait for a special travel permission called Advance Parole. You can file for that for free with your AOS and it takes about 3 months to be approved. You cannot come back on the F-1 with the intention to adjust status - that is visa fraud. CBP can and will deny you entry for this. I'd move up your marriage time table a bit so you can get the AP in time to travel. Otherwise, you will have to pursue a spousal visa and the foreigner will have to wait outside the US for 8-10 months while it is processing.

    Don't worry about it. This won't be an issue. Mention it later on at the interview if you'd like, but this alone won't stop you from getting your initial petition approved.
    Calling USCIS will not do anything. The OP has no need to reapply or pay any fee again. This isn't a big deal at all. No need to try and scare people.

    For heavens sake, your fiancee's aunt must be the worst lawyer in America. Did she even bother to use Google to do her legal research? Did she even bother to read the instructions for Form I-129f?

    AOS is a time of limbo. The I-94 is not only the time to get married. After the I-94 expires, your husband would be out of status if he hadn't submitted his I-485. He did submit it, so he is here legally because his pending AOS grants him a period of authorized stay. Most DMVs, however, don't accept the NOA1 from I-485 as proof of legal status - since it can be revoked at any time. You'll have to wait for the EAD or GC to get him a DL, depending on your state laws.
    This is very common.

    he walked out on you at the very beginning of the process, you had no idea where he was, what he was doing or if he was coming back. He obviously treats you like dirt and is guilting you into staying married until he gets his green card. And you feel guilty......seriously?????????? If you post something like this here and expect people to be sympathetic, I can't imagine many will. He obviously only married you to for a green card, he used you. WHY WHY WHY are you EVEN considering helping this man when he said he would just find another woman to marry to get a green card? Not to mention that you will be committing fraud because you know the second he gets his green card he is history. Have some self esteem, divorce him and let him figure it out by himself.

    I will tell you I am stressed, depressed ,I am the care giver to my brother who is dying of a rare cancer called GIST and liver cancer because of GIST. I haven't seen my husband in 10 months. I have to have 2 surgeries because of my own conditions. Now tell me about stress? let's all be reasonable we all have many things in life happening to us and definitely need our love one beside us :(Look at our timeline you'll see how long we been waiting and I am not being mean but I seen someone wanting to expedite before because of a exam in USA made this can be rescheduled can someone's life be ??? venting sorry

    No it's not. It's perfectly legal to enter with intent to marry, it's NOT legal to enter with intent to AOS.

    Being called for an interview is more common then you would think. When your petition is received a fraud level is assigned of A B or C.
    C is the lowest- everything looks good- they recommend no interview
    B is the middle- minimum required number of documents, but something feels off to the adjuster so they dont go with C
    A- is possible fraud- there is insufficient evidence,large age difference exists between the spouses; the married couple is not living together
    All fraud level A cases are interviewed no matter what. Depending on the percentage of cases the district office wants to interview, around 30-100% of level B cases are interviewed and 10-50% of level C.
    So even if you were a C you could get an interview. It doesnt mean somethings wrong. If they got to you 'quickly', its another indication that your local office had a lot of empty interview slots and stuck you in one of them.
    The burden of proof in ROC lies with you. You need to show you entered in good faith and the marriage just didnt work out. You say you have all your proof. So have some faith. I think youre going to be fine.

    Stop repeating the same things, it doesn't change the facts.
    It is our opinion that you were sent the GC by mistake. If you try and enter you will most likely be turned around. If you AREN'T turned around and permitted to enter and later try to file for USC you will have your USC denied and your GC revoked for failure to maintain status.
    You received the GC as a mistake. If USCIS didn't make mistakes there wouldn't be a form to correct USCIS mistakes on the GC.
    If you want to try and use it, go ahead and try. But bear in mind you would essentially using a document you shouldn't be using to try and enter the US and that could be used against you. But it's your life and your choice. I personally wouldn't.
    Your other option is to see an immigration attorney. As you're not in the US your wife should see an attorney and see what they say. Bearing in mind they care about money so be careful who you trust.

    I have eyes and have seen this happening and I am not the type to lie about it. I said many because it happens more than it should, which is why all of us have such an uphill battle to prove legitimate relationship. Every time I mention fraud in west african relationships I get those that are offended, some of which amuse me because the fraudsters fuss the loudest.
