Any I-130 denials for missing too much paperwork?

Hey guys!

My husband has a friend back home that married an American lady back in spring of 2011. She sent an I-129F in to start their process and was denied in Nov. 2011 of course because she sent in the fiance packet and not the I-130. She sent nothing again until this last fall. This time she sent in the I-130 form and the fee and that's it! No marriage certificate, no birth certificate, no divorce records from her, no G-325A forms, no passport photos, no proof of anything... literally just the I-130 form and the fee.

Now my question is this - I would assume they will just deny her instead of requesting an RFE for absoultely everything, but we never know I guess. Is there anyone out there that has missed a lot of paperwork and was either flat out denied or received an RFE?

Why would she not follow the instructions and complete everything? That seems so odd to not follow any of the directions and include anything at all. My guess is that they would request all of the supporting docs to be sent. Did they cash the check?

Yes - they cashed the check. As for why would she not follow the directions? That is another story. I gave them to her directly from the USCIS website and told her everything we had sent in our packet. The fact it took her a year to try a second time (after filing the wrong form) makes me tend to wonder if she is serious about the process of getting him here.

My first post included me asking whether or not she was serious but I held my thought to myself because I didn't want to be rude.

As for 'whats next'? Lets find out in another month, aye? If it's denied, usually it's denied within 60 days of submittal, with no prejudicial stuff. If there's an RFE, expect it to be issued on the date that it WOULD have been approved.

Almost 40 years' difference? Wow! That must make it extra difficult to prove as a legit marriage. I can't even imagine being married to a 26 year old male and that'd only be about 10 years younger than me! Not judging, just sharing ;)

Agreed - it will be pretty difficult. They definately have enough against them to make it a huge uphill battle... I would have thought making sure the I-130 was done correctly would have been a MUST!? :wacko:

OMG I will not pick on her age heck I am 21 years older than my husband but dang have a drop of sense. Goodness.

I am sure she waited because she didn't have the funds. Does she realize what happens at NVC?

I am sure she is aware of what happens at the NVC stage as I told her. But I also told her how to do the I-130 correctly, so go figure. It's funny because she does keep saying "I don't know why they denied us the last time. What's wrong with us?"... when in fact she DOES know - it is because she filed the wrong form over a YEAR earlier. Yikes.

DZ is the country code for Algeria.. I have no idea why.

My husband tried to explain but frankly he makes no sense to me regarding this! :bonk:
