I think I get a VJ Email on the 22nd October congratulating me on another year, with the implication how has he survived so long. Anyhoo, he is 19 1/2 and his mother does not have her GC, so if all goes well he will be nearly 23 when she naturaises. Not even close to 21. The will he leose CSPA if his mother naturalise makes no sense to me when he can elect to keep F2a PD, something I have not really looked at. Totally illogical so could be an issue. Marries and we are in a different ball game. Wait for F2a is c3 1/2 years, some think it will reduce, I do not, time will tell. I think that such cases are not prioritised over non PD cases, is it done to help? I doubt. What will happen toI 130 processing times, no idea.

In my mind the whole thing is stupid, I have not seen it come up where someone has a Certificate of Citizenship and not sure I understand why that would make a difference. I am sure I have seen many cases where the child comes over on holiday to get their citizenship, lives with another parent outside the US and never has a problem and a few where they do. I was just trying to suggest why the issue arose in this case, all I can think of, essentially it seems a matter of opinion, maybe there has been a memo that went around? I suppose at least if you are in the US you can eventually take it to an IJ, however my focus would be talking to one of the 2 lawyers mentioned, I certainly have nothing against Margaret, just mentioned my recommended one in this area. -

My reply on your other post There is no requirement for a USC to maintain residency in the US. On here I always recommend getting a Certificate of Citizenship as you have nothing otherwise. These conditions must be met before you turn 18 years of age: 1. Your parent must be a U.S. citizen; 2. You must be the biological child of that U.S. citizen parent; 3. You must be lawfully admitted to the United States for lawful permanent residence; and 4. You must be living in the United States in the legal and physical custody of your U.S. citizen parent. I assume this is the issue if he ever lived in USA, son replied he has always lived in Dubai -

Instead of drawing management attention to this, and presumably being banned the Lady called the Cops who presumably had not read Planet Fitness Diversity Inclusion and Equity policy and took exception to her activities.

Well that is an interesting if somewhat desperate ploy. And a new one to me. So the argument is that a couple who divorce but still living together revert being common law married and not single. Now a quick google says you have to divorce to terminate a common law marriage in Texas, which os what happened. So the only way I see this operating is there has to be a gap, marry, divorce marriage, become common law married. So I do not see how this could operate as the process would not be seamless. Yes, Texas law recognizes common law marriages. In Texas statutes, such marriages are called “marriages without formalities" or "informal marriages." Laws related to common law marriage are in Chapter 2, Subchapter E of the Texas Family Code. Who can have a common-law marriage? Both partners must be eligible for marriage. This means that they must be: at least 18 years old; not related to each other; not married to anyone else. Section 2.401 of the Family Code states what qualifies as a common law marriage: each partner must agree to be married; after the marriage agreement, they must live together in Texas as a married couple; the couple must represent to others that they are married. Texas law still refers only to “husband and wife," but common law marriage is also available to same-sex couples due to the U.S. Supreme Court’s decision in Obergefell v. Hodges. How do I prove a common law marriage? Couples can register their common-law marriage by filing a Declaration of Informal Marriage with their county clerk’s office. TexasLawHelp.org has sample forms and instructions for this procedure. Your county clerk’s office may also have their own forms. Documents like tax returns, lease agreements, insurance policies, etc. may also be helpful in proving a common-law marriage. In some situations, it may be necessary to go to court to prove a common-law marriage. The law can be complex, so you may wish to talk to an attorney if this is something you’re considering. For more information on finding an attorney, please see the library's Legal Help page. How do I end a common law marriage? Like those in a formal marriage, couples who want to end a common-law marriage must file for divorce. However, if two years pass after a common-law marriage couple separates and neither party has filed anything to prove the marriage, the state presumes that the marriage never existed. This is referenced in Texas Family Code Section 2.401.

Correct Obviously we have seen this many times, the last one I remember was that Canadian Lady who seemed to be working on the basis what they do not know etc, she was ,married to the F2b and thought they would not notice when she asked for a GC. -

The first case died as soon as he married, she can file for him again as soon as the divorce was completed. -
I have seen cases that stuck me as very dubious but without this level of investigation, so open to fraud what did you expect. see also VAWA, SIJV, Asylum, well the list goes on. I have always wondered what the thought process is when designing such systems, surely they must realise what they are doing?

I can think of all sorts of variants, just a few points Nigeria and fake divorces are well known DoS do check Seems that in this case the OP also told them, so extra reason to check. Who knows the validity of the Lawyer in Nigeria Maybe he subsequently had a valid divorce. Not sure what the US Consulate in Lagos have to do with this, he is a USC, maybe in Nigeria, I doubt he needs Csulate Services. If he wishes to petition his GF than all this will be gone through again. Sounds like the OP has not divorced if not then that should be a priority, I suppose if he never was free to marry then the marriage was never legal but doubt she has evidence of that to convince a US court.
