  1. It's nothing to do with the consulate any longer, they don't process AP. AP can't be expedited but you can file a WoM if you want to try and force them to make a decision.

  5. If you're spending a year at school then presumably you have school vacations, so why not just come back to the US then? That would then mean your continuous residence requirement wouldn't be reset. My daughter is at college overseas but has 7 months of studies and 5 months of vacation that she will be spending in the US each year. Otherwise, as Boiler said, you'd have to wait to be eligible again before you can file. AP will mean you don't lose your LPR status, but doesn't help with maintaining continuous residence.

A consular processing application would have made far more sense given your situation and I think @SalishSea was just wondering if there was another reason you chose AOS, or if perhaps you were misadvised.   8. Please take the caps lock off. It's considered 'shouting' in forum netiquette. 6 months would be pretty quick, even the quickest consulates are 3-4 months for spouses and Lagos had a big backlog. There's also a much higher chance of being put in to Admin Process in Lagos, so do factor that in. Is your wife a US citizen?

  13. Things really must have changed in the past decade if your wife only filled in a one page form for AOS. Just the I-485 is a far longer form than the I-129f now, and then of course add in the I-864, and possibly I-131 and I-765 as well. Overall probably 40+ pages of forms for most.
  14. So you’re basing this on experience from a decade ago? 😂 Just pop over to the K1 forums and that’ll give you up to date info. I-129f’s for Filipinos are processed at exactly the same rate as those from every other country. They’re only processed at one service center now.

  16. SB-1 would be a last resort option normally. High refusal rate and you'd have to prove you couldn't return to the US due to reasons out of your control which isn't true. Accepted reasons would be things like being hospitalised etc, not just losing your green card and not wanting to pay for a boarding foil. Why not just get yourself over to the US asap as everybody has suggested above?

  18. It's not lack of funds, it's not having a job to return to - ideally she'd have as many ties to her home country as possible to prove she'll return.

  20. Of course USCIS decide where to allocate their staff. But applications have increased hugely which has an impact, I don't understand why anybody would think that's not relevant. It may be taking a little bit longer (about 2 months longer) than it used to, but if you go back a few years it was MUCH longer. It's actually sped up a lot in the past few years.

  23. I don't think a boarding foil is an option now as the OP appears to have been outside the US for more than a year. No. 2 definitely the best option. But I would also get the OP to file the I-90 in case he's asked about it - biometrics can be rescheduled if they are required, but if he at least has a receipt number for the I-90 that might be useful.
  24. If your agent is your sponsor then any employer isn't relevant, most people who apply with an agent don't have any work lined up. Good that you've added more evidence. Hopefully your lawyer has a lot of experience doing O visas this time?
