OldUser reacted to K1visaHopeful in 20 year old K2 Visa Holder change her name
    Your post is very confusing.

"Provided a name change" means what? Provided by who? What kind of document are you referring to that would allow you to change your name as the child of a parent who marries a step parent?

You are not eligible to change your name because your mother got married. To change your name you must go the legal route in civil court or be adopted or wait until citizenship.

Why would you not be eligible to AOS? I'm not understanding the relation between "being provided a name change" and not being eligble to file I485.
Once your K1 parent marries, you are eligible to AOS as well as soon as the official MC is available.

I'll respond to further questions provided you fill out your VJ timeline as you do not have one posted.

100% they won't be allowed at the interview. 99% they won't be allowed in the building. 99% they will be allowed outside the building / parking lot.

There's possibility, but we cannot jump to conclusions based on one side of the story and limited detail.
It would be not to immigrant's benefit to be divorcing with pending I-751. If she married OP for GC she would have likely naturalized (or at least obtained 10 year GC) and then seeked divorce. But it's the OP who's seeking divorce. Sometimes US citizens want to flex their power and if immigrant doesn't tip toe around them, start divorcing. Not saying it's the situation here, but it's also a possibility.

I agree, ID is a must. I think a lot of people try to save money but that works against them. Only recently read a thread where the person didn't have any valid US ID and their foreign passport expired. Not a good spot to be in.

Short of an admission of fraud by the Green Card holder, herself, it would be extremely difficult to prove she didn't enter the marriage in good faith, imo.  The couple have already provided a plethora of evidence to the contrary.  The fact is that the Green Card holder can continue her path to citizenship by a couple different routes....both without the cooperation of the US spouse.   The sooner she becomes a citizen, the sooner the US spouse's I-864 obligation ends.
The divorce settlement is a separate issue, but I think proving fraud would be just as difficult in that context.  Good meaning marriages fail every day.

I am sorry you are going through this. Get a good divorce lawyer and don't waste your time on immigration. You provided a LOT of proof to the government. She will be able to stay. It is in your best interest that she naturalizes as soon as possible so that your I-864 obligation ends.

    Good luck.

I don't see an immigration problem. I only see a marriage problem. Divorce and move on; get a good divorce lawyer. Marriages breakdown a lot of times, and USCIS even allows divorce people to extend their greencards without the help of the ex-US spouse. And you are also on hook for the affidavit of support you signed even in divorce so it will actually be to your benefit if she naturalizes at some point. Good luck.

You need an affidavit from the family member(s) who are paying your utilities.  They should explain exactly what they cover, and what monthly sum you pay them to help pay them back.  It would also be good if they explain WHY they are doing this.  Also make sure your evidence is from the beginning of your marriage.

They're probably looking for more evidence. I'd send everything you have.

What about joint bank account statements and utility bills? Do you have any of those spanning period from date of marriage until now?

Essentially they didn't think what you sent was enough or up to date to approve your case.

Make them an authorized user on your credit card accounts.  That will get their credit file started and get their name and social security number into the system so it is the number one best thing you can do to start them out.  Call the bank that just denied the secured card, explain the circumstances that they are recent immigrants and ask if there is any further identification or proof of income that might get them to reconsider the denied application.  If they have a local branch that you have been banking at, you can try going in and talking to someone in person. They might or might not reconsider but there is no harm in asking and sometimes it's just as simple as showing them a physical social security card, state ID or signing a release for them to directly verify a social security number.  There are now these hybrid fintech banking products out there like Chime, cred.ai etc, that more or less function like a deposit account with a debit card but report to the credit agencies as a credit card.  Those also have the added advantage that they will create the account without a hard credit pull.

There was a whole thread somewhere on VJ where one of the former VJ members @Mike E gave a lot more examples of CBP detaining US citizens while figuring out whether they're US citizens and can be admitted.

CBP even published report on how many citizens were held in CBP custody over 24 hours.
