    As far as I know, you'll be abandoning your I-485 petitions the moment you leave the US without Advance Parole.
     
    You can leave and re-enter on H1B, but you'll have to refile your I-485s.

    OP, what's the plan, when are you coming back to live in the US?
    I hope you know the reentry permit only covers 2 years max since the time you left the US (AFAIK)? Then you'd have to get a new one.

    Ability to work and travel freely are the most significant considerations for me.  But of course, the deciding factors in your case would depend on your preferences and circumstances.
     
    As for filing the I-485 -- because you are a US citizen and your husband is currently in the US, it would be a legal option for you two to submit the I-130 and I-485 concurrently while he is in the US.  Not much point comparing the processing times for CR1 vs AOS, as I-485 processing depends on the USCIS local field office backlog, and USCIS processing estimates for I-485 are notoriously inaccurate.

    Its either consular processing or adjustment of status.
     
    If you file the I130 and I485 ….. and the recommended I765 work authorization and I 131 travel authorization.. and he then needs to leave the US before the I131 is granted, then the approved I130 Is still valid. You  can then request to proceed with the immigrant visa through the home country consulate.

    Is your husband currently in the US?  If so, are you both ok with him not being able to work or travel freely outside the US for around 8 months or more?

    It might depend on the time your interview is scheduled, mine was at 7.15 am and I was called in at 7.40.
    The lovely IO told me that there was gonna be a ceremony at 11 and hopefully she was gonna sign me in for it 'cause I live 6 hours North of SF and she didn't want to bother me coming back to the City! 
    I'll love her forever!

    If you did not change your intended US address from the intended address in your DS-260 form at the time of your interview, then there is no need for you to file an address change with USCIS.
     
    If you ever actually change addresses in the future, then you (the immigrant) will need to file AR-11 address change by mail, or create your own USCIS account (not using your petitioner's account) to change address online.

    Have you looked at the financial requirements for AOS?   They are higher than for the K-1 interview.

    Have your titers done now by your family doctor or local clinic.  It will show what immunities you have in a format you can present so you aren't stuck doing ALL required vaccines.  Otherwise, no proof of immunization = redoing all immunizations.

    Hi.  The timeline doesn't seem to match.   You were married for 5 years.  And you filed for ROC in Dec 2022.  That means you were married for 4 years when you filed the I-751?  4 - 2 = 2: you had a conditional GC when you were married for 2 years?
     
    How did you enter the US?  With a CR1 visa, or did you enter as a tourist and then adjust status?  It would be helpful if you can share your immigration dates, vs the marriage date.  I have a suspicion that you should have received a 10 yr GC but was given a 2 yr GC by mistake.
     
    Regardless, either your husband is lying to you about getting you deported or the lawyer is taking him for a ride.  The only thing he can do is send a complaint to USCIS.  If he accuses you of fraud he will have to provide evidence, vs the evidence you both submitted of a bona fide relationship when applying for the CR1 or AOS and the ROC.  In fact, the threat he made of "deporting you" can probably used against him in divorce court.  He is on the hook of providing you support via I-864, which is also something a divorce lawyer can use.  It is his best interest to get an amicable divorce.  If it was him asking for advice, I would suggest that he works out the divorce terms as quickly as possible and make a clean break.

    If you mean items 24.a to 24.c of part 6 on the I-864, you must list the total income figures exactly as reported in your 1040 forms for the 3 most recent tax years.  Exact figures, whether they are negative or not.  Any other number that doesn't match your reported income figures would be misrepresentation.

    He can get the biggest and best immigration lawyers known to man, and you will still not lose your green card. You had to prove a bonafide relationship/marriage in order to come here and just because you've strayed, does not mean your relationship with him was not real. He'll just be wasting time, and lots of money, trying to have you deported..

    Is this all the evidence you sent? Seems thin to me. Photos and affidavits are the weakest evidence. How about jointly filed taxes, leases, health insurance, beneficiaries on 401K plans, flight reservations with both names etc?

    He can complain to USCIS but it doesn't mean you can't stay in the US. Your ex doesn't own you or your immigration status. I totally understand he's hurt and you wasn't nice of you to cheating, but he is not in charge of your immigration status.

    She needs a proof of being a LPR. That's ADIT stamp. Filing for N-400 doesn't result in getting the stamp.

    I was told that it depends on the officer who your case is being attached to. Sometimes a new officer comes into game and gets several cases from the other one. So sometimes new officer receives the newest cases and processes them faster. I think that explains why some people get interview way faster than the other

    After divorce you're no longer eligible for N-400 under 3 year rule.
     
    Technically, you can file for N-400 under 5 year rule, whether your I-751 is approved or pending at that time.
     
    Look at your 2 year GC. Find "Resident since" date. Add 5 years to it and subtract 90 days. That's the earliest you can apply for N-400 in your case. Sometimes you want to get I-751 approved first, if it's messy.
