But if the mum is meant to die, whether he travels or not, she will still die. He can go, enter, have his passport stamped then take the next flight back

She signed documents asserting OP would live with her. There are legal consequences to denying a spouses access to their homes.

OP and wife convinced either other, USCIS, and State the relationship was bonafide. OP has a right to figure out what is going on with the relationship

That observation seems to be employing a stereotype.

Lawfully moving  to the most  advanced country in the planet is the opposite of a world of hurt.
I’ve been detained several times by CBP, INS, UK border force, Australian border force.  If one cannot cope with that possibility, one should not travel internationally.

Based on the post, OP has done nothing wrong and will not be doing anything wrong by coming to America.

OP’s wife had a choice. And still has choices. OP is supposed to wait in limbo until it is “convenient”? Is OP an object or thing?

There's so much more to consider here.  It's Nigeria.  You've met ONCE (how long a visit makes a difference) then you'll marry before seeing each other again and she'll visit after (how long a visit makes a difference).  Your respective ages makes a difference.  How much scrutiny any case gets depends on many factors including the country and how much immigration fraud the Consulate there sees.  We have long rated consulates based on the amount of fraud they see regularly.  Here's the system.

    1.  Low fraud.  UK, Canada, EU, etc.
    2.  Medium Fraud
    3. High Fraud
    4. LAGOS

Learn first what it takes to convince a Consular officer (using only truth) that your relationship is bona fide (genuine) instead of just for immigration purposes, BEFORE you make your plan.  They care much more about how much time you spend together than they care about any reasons why you don't or haven't.

Interesting how he thought that mentioning the child would mess up the process, but then he wants to naturalize said child as well. How USCIS would naturalize a child they didn’t even know existed is beyond our pay grade.
In addition, he hasn’t had his CR-1 approved yet and is thinking of naturalization already? One thing at a time!
It is absolutely a mess. However, is it material misrepresentation? My understanding is that misrepresentation is material if the truth would have prevented the beneficiary to obtain a benefit. Having a child does not prevent anyone from getting a CR-1, right?

Same question I asked him and he said, they thought it would affect their application. If he had mentioned the kid, would the kid be a US Citizen upon him naturalising?

Joe Joe reacted to Pinkrlion in Can a child born out of wedlock before naturalisation by non USC become a us citizen when his/her father naturalise?
He will have a challenge to prove that it is his child, since never listed on paperwork.  Including proof of providing care, birth certificate, DNA test, among other proof.

Joe Joe reacted to Mike E in Can a child born out of wedlock before naturalisation by non USC become a us citizen when his/her father naturalise?
OP says the friend hasn’t interviewed yet.

If OP’s friend does disclose  his kid at the interview then this will call into question how genuine his marriage is since the petitioner didn’t disclose.

So logically then the petitioner would need to provide a statement stating that she knew there was a kid (if she did know) and gives a reason why she didn’t disclose.

However,  I will never advise anyone to self incriminate.  Such advice should only come from a licensed criminal attorney.

The petitioner and beneficiary each need to hire criminal and immigration attorneys licensed to practice federal law.  We are beyond DIY.

This one usually falls under “intends to cut off a line of inquiry

Either way, under section 6 “Timely Retraction” there is opportunity at interview to fix this.  Once the interview is complete and if this has not been disclosed the deed is done.  It may already be too late as the petition section about beneficiary’s spouse and children was left blank, signed, and submitted.

What a mess.  A completely unnecessary one, unless beneficiary is hiding something else (abandoned or not supporting the child?)  That will catch up sooner or later as well.

Hello fellow VJ. Please I need an advice. I and my Girlfriend(USC) haven’t met in person due to the nature of her work (US army). We are planning to meet anytime this year but we don’t know exact date. Is it advisable we both get married through Utah online marriage and wait until we finally meet and then apply for CR-1 or should we leave the online marriage until we meet?

Well that isn't true. I have known personally of a few who at Citizenship things started to unravel in their stories. N400 they truly do a deeper dive. You are never past suspicion. Sometimes at N-400 is when fraud is found out sadly.

This almost same scenario happen to a friend of mine. He thought like you and thought Immigration would not connect the dots and at interview he was grilled why the difference in addresses and why did he divorce shortly after I-751 and changed to divorce waiver.
After all was said and done he was separated when he filed for ROC wife thought she was helping by signing but then it went south and they divorced waiting for ROC approval and he was called into interview and it was changed to divorce waiver all fine. But at N-400 it was found they were separated when I-751 was filed.

Seems OP has about the same story. No way anyone is forgetting in 2 years where they lived. I know my address from when I was 10 that was 53 years ago, So OP sorry your story so does not add up at all.

Just wondering, is there any reason why you are considering an online marriage without meeting?  Who suggested it?   Would your girlfriend consider moving to Nigeria?

My husband was a lieutenant colonel in the US army when we met and he had no problem taking time off to meet.  In fact we met several times before we met, we even took a vacation together, before we decided to get married.

Military Leave: What It Is and How It Works. As part of the military pay and benefits package, military service members earn 30 days of paid leave per year. You start at zero and for every month of military service, 2.5 days of leave get added to your leave account.Jan 5, 2022
