We’re sooooo happy to be finally done with this grueling process and look forward to being together without the long distance travel hassle.     No, during this time I was also unable to reach NVC by phone. The supervisor review had also rejected the document but wrote a couple more words in addition to their generic response (something like “US authority needed”), so that’s how we inferred that it was because the divorce wasn’t filed in US court. We called several lawyers (didn’t hire any, just the initial free consultation) and one of them said I should just submit a letter to explain the situation, so that’s what we did.

    I thought I would post an update after so long, maybe this would help others who run into similar issues. So after I had posted the above, we requested a supervisor review, and two months later, they finally gave a very terse explanation. Basically my husband and his ex were living in the US and had divorced via the Korean consulate (because they got married in Korea). The NVC people must’ve expected the divorce be filed with a US court or something because they were living in the US at the time.
     
    So we submitted a letter explaining the circumstances fully to show why the divorce was filed via the consulate. Another 2-3 months go by and we finally got DQ’d a few weeks ago! We were told that he should be expected to present his divorce documents for his consulate interview. Since it’ll be in Korea, we hope that the consulate people there have more experience navigating korean marriage/divorce procedures and not give us any more trouble about it.
     
    It’s a longer process than we had expected but we feel like we’re finally seeing the light at the end of the tunnel. Thanks to all who have read my posts and gave me advice, I wish everyone the best!

    Update: this was in Calgary airport’s pre clearance. We stood in different lines, but when officer asked me if I was traveling with anyone, I answered that I was with my husband. He told me to wave him over, we passed quickly without any problems. Thanks again everyone!

    Call them back and ask for a supervisor review, if you are sure you submitted the correct document.
    Supervisor review takes about 6 weeks at most

    My opinion is that the petitioner does not need to indicate they prepared their spouse's I-130a.  Unless the petitioner used a third party interpreter or preparer, they don't need to indicate they prepared or interpreted for themselves regarding the I-130.

    My family was in the same situation earlier this year. They did not have any issues/questioning when they were here to visit me for 3 months (while still awaiting NVC processing). Just for my own comfort and peace of mind, I did give them a letter to carry. It was a letter I wrote addressed to the CBP officer. In the letter I explained the situation and attempted to help the officer understand the intent was only a short visit. In addition, I ensured that my family knew everything about the process so that they can convince the officer that there is absolutely no motive to violate any B1/B2 restrictions. And in fact there were every reason to return to host country.
     
    In theory, the CBP officer can deny entry, but for most part they are reasonable and will accommodate genuine cases. I think they have many years of experience and over the years see many travelers with all sort of intent. So, they have pretty good instincts to identify a genuine case. 
     
    I am sure it will all be fine. I wish you quality time with your husband and a very happy thanksgiving.

    We met online February 2018. 
    Became boyfriend-girlfriend in March 2018.
    He traveled to see me first time in June 2018. We got engaged on 2nd day of his 8-day stay.
    He filed for fiancé visa in December 2018.
    I immigrated to the US in July 2019.
    Got married in August 2019.
    Two years later, we are still madly inlove with each other 🥰

    My wife (a Spanish national) has visited 2 times, one of those times since we started the CR-1 petition. She was pulled into secondary processing on the second visit. It wasn't a bad thing really, as they simply wanted to verify information. All of these agents were really nice to her. But one of the border agents, a woman (speaking in Spanish to my wife), told her that she must absolutely NOT overstay by one minute, so there would be no problems with this CR-1 petition. This was no problem for us, as my wife and I agreed to limit the visit to 11 weeks (entry on ETSA grants you 90 days, strictly, and not a minute more), to allow for cancelled flights and whatever else might delay her trip back to Spain. Make sure your husband DOES NOT OVERSTAY.
     
    Also, have your husband bring a copy of at least your passport, your drivers license, and your marriage certificate (get this translated if it's in Korean or any other language than English, and getting it apostillized if it's not an American document is probably a good idea as well). I also have a sheet with my address clearly written on it as well as my phone number that she carries with those other documents. The more transparent he is, the more that will put the border agents at ease. They have a hard job, so do what you can to make it easy.
