Processing times for VSC are 26 months so you're well within that. I don't think your representative can do much at this point. If citizenship is the end goal there's no reason to wait until is done. The processes can run in parallel and lots of people get scheduled for their N-400 way before the I-751 gets adjudicated, give or take a couple of weeks for the approval if it's not a combo interview.

    If your wife:

    - Has been married to you, US citizen, for 3+ years
    - Has been a permanent resident for 3 years
    - Never had trips for over 180 days at a time since becoming LPR
    - Spend at least half of her time in the US

Then she is eligible for N-400. Even with I-751 pending. Yes, conditions have to be removed, but the petitions can be pending in parallel. And can be adjudicated together if I-751 is not approved when N-400 interview is scheduled.

Ok, this is a great thing to learn when dealing with immigration: answer what was asked. Don't say anything extra. It will make things straightforward.

This is advice you pick up by hanging around forums and people sharing their experiences, so find the AOS monthly thread for your process and read the posts. I'm mentioning this because I stated some examples of standard questions you might be asked and you replied with both families backgrounds and issues. The answer to "have you met family?" is yes/no if yes, when. Nothing else is needed and might save you extra questioning for volunteering information.

The more financial mingling the better, photos and affidavits are secondary evidence. Treat it as a job interview where you need to put your best foot forward. The immigration officer doesn't care about your love language and anxiety, they care if you got married to get a green card or not - this is very matter of fact what is being probbed in the AOS process. Good luck!

Not really, interviews are part of the immigration process. Understand the forms your filling, have a conversation with your spouse about the answers you both have for basic questions like where did you meet, habe you met family, names and dates for important things etc.

You don't have to worry if your relationship is genuine. After AOS you will have ROC and possibly naturalization if desired. Get comfortable with immigration forms, norms and procedures. You can't let anxiety ruin a straight forward process, even if it's stress inducing and infuriating as times.

"Then why can't she move to your country?" See what I did here? This could be a follow up question from the officer. We all understand what you mean, the officer will understand what you mean, but don't open yourself up to this kind of conversation and questions 🙂

All that aside, I was shaking in the first minutes of my interview. The officer noticed it when I pulled my work permit out of my wallet. She was super sweet and pointed out a couple of times that the interview is just a formality and that there's nothing to worry to calm me down.

The officer will ask questions for both of you to answer, it’s not complicated.

Well guys, the day has finally arrived. After multiple years in this journey and after an RFE following my N400 interview on March 25th, yesterday (3/28) I received mine "Oath ceremony notice was mailed" and it is scheduled for April 24th.

Thank you so much to everyone who has shared their experience here. Reading about your experiences and tips has been profoundly helpful throughout all these years and it really made a difference in my case. Please don't lose hope as the end of the road is closer than you think.

Again, thank you so much, and hoping for the best for all of you!!!

Yeah that's bs. You had all past three returns as expected, it's not April 15, there is no reason for it to be the one piece of evidence that will approve or not your application.

Someone just needed to feel important, it will delay but it won't stop you, it's the home stretch! Good luck

I've seen a lot of discussion on this and there are two main sticking points: the person accepting your passport application might not accept the copy, regardless of what the DHS says and that getting the certified copy from USCIS might as well be impossible.

I think it's worth the try but I wouldn't hold my breath on it. Yes there's a chance of the certificate to get lost but most people get them back.

Child entered Feb 2024 and I551 expires in Feb 2025- @jackiegringa is thinking this is the endorsed visa in passport when she entered not the actual physical green card.
    @CJlove was the I551 CR2 or IR2?
If student registered at school did the student give them a copy of her I551 when she enrolled?
Does school have any of her documentation on file? Asking as this is how she might have received her student card…

Why will she need her passport for AR-11? She’ll need her A number but says above they have a copy of her passport which hopefully includes a copy of her visa.

OP, which country is her passport from?

    Hello everyone!
It's been years since I started this thread and the time finally came when I can post an update.
I've finally got my green card in the mail today!
In February 2020 I chose to file I-485 along with my US citizen husband's I-130 petition for me as his spouse. I added a copy of my existing green card at the time, denial notice for N-400 and a cover letter describing my situation and asking them to help me fix an issue and apply whatever procedure was applicable in such case.
Our field office is Fort Myers, FL. this office is obviously a busy one as we were waiting for 4 years for an interview to be scheduled and those are normal processing times for this location according to USCIS website. But the time came and we had our marriage based interview on February 28, 2024.
Once we walked in the room with an officer and sat down I knew she was clearly aware of what was going on and that she was going to take an action on it.
I'm going to mention that an interview was previously scheduled and cancelled on the same day about 8 weeks before the new interview date was scheduled. Not sure if they needed extra time to review the case of if there was another reason.
The officer told me that my old green card wasn't good as it was not properly issued and offered me two options. First, was for USCIS to rescind my LPR status, second, for me to give it up voluntarily. Didn't make any difference for me so I told her whichever is faster and easier process, I was willing to go with that option. Voluntarily giving up my green card that was. An officer then told us that it might not happen that day as she had to request a form from their headquarters that I will need to sign, she said she requested it but wasn't sure if she gets it by the end of an interview. We said we were willing to stay and wait if possible to cut on time, because otherwise we would have to wait for them to mail the form to us and the me mailing it back with green card. She then proceeded with marriage based interview and I-485 questions, took some paperwork from us, I-693, few pictures for the case etc. By the time we finished with an interview, the form was available.  It was acknowledgement of abandonment of green card, it sounded like it was tailored for my case.
It stated that I am willing to give up my green card, because it was issued erroneously, but that I was not willing to give up my LPR status; that I understand that if my new I-485 is approved my legal permanent residency is going to start from the new date when it's approved. An officer explained that even though I might be put out of status for some time when my green card is cancelled and the case isn't approved yet, that shouldn't be a big deal because they know why it happened. We didn't expect them to process it so fast. in two weeks after the interview I got an update that cases were approved. It took another two weeks for card to arrive in the mail.
I wanted to share my experience. I've seen a few lawyers over these four years trying to find a solution for my problem, none of them were able to advise on how to proceed. What they were saying is - you're in a limbo, there is no way out of this situation, last one called it an immigration hell.. I had an advise from legal worker who was friend of a friend to give a try to marriage based application and a couple lawyers on avvo supported that idea. My ex-husband was asked about my issue during his naturalization interview and officer interviewing him said this issue might only be fixed in immigration court.
    Hope it helps someone!

    Filing Fees | USCIS
USCIS says they run credit cards only once.  If declined, they will reject the package.  They do not specifically say that for debit cards.  I would wait a couple days to see if the debit goes through before sending another package.  I would pay via personal check.
It could take a couple weeks before receiving a rejected package.  I know of no way to contact them about the I-751 since you have no reference number.

A-number and USCIS account umber are two very different things. All immigrants have an A-number. Only those who have previously filed a petition ONLINE have a USCIS account number. Many of us never filed a petition online because the petitions were paper filings only back then, so we don't have any such numbers. You will get one after you have submitted your online filing, so you just skip that question when you fill out your petition.

Worst they can do is actually mistakenly approve and realize later/at interview stage that you were not eligible to file; you will then lose more time, and money; the later they notice, the more detrimental it will be.  Just withdraw the current I-130, and submit the new form as soon as possible, ideally before the fees increase.

The document you submitted should be acceptable as it is in both languages.  You have two choices.  1.  Submit it again with a letter pointing out it is already in both languages.  or  2.  Get an English Translation made and submit that.  You're not going to be able to talk your way out of respondin in one of those ways.

You cannot withdraw a withdrawal. You will need to file a new I130.
Even if the first I130 is approved do not act on it. A few years back, a member entered on a withdrawn petition and this error was only caught at N400 stage. They had to return to their home country as they had no actual status in the US.
Perhaps someone can find it- I’m having no luck right now.
