Expired Green Card/ Expired I-90 and left US for parents funeral

My wifes green card expired 1/03/2022.  The 2 year Extension I-90 expired 1/03/2024. During the 4 years of the 2 year Green Card and 2 year Extensions she has traveled back to Japan about 8 or 9 times to see her mother.

Her mother died last week and without a thought we booked her flight for the following morning and off she went.  She was supposed to return yesterday but due to the fact the Green Card and i-90 expired on 01/03/2024 obviously she is not here with me or I would not be typing this right now.

1st thing she did was go to the US Embassy in Tokyo Japan, they told her to go on the USCIS website and file a form I-131.  

I called USCIS and they told me that is not the form needed and to go on the US Embassy website and find the correct form there.

They would not tell me what form to file.

Then I called back and they said to schedule an appointment, but you can not make the appointment from here in the US and there is no link on the website to make an appointment either... kind of like the old man joke in Coming to America--- "Where's the spoon... Aaaahaaaaa"

 

I filed a form DS-160, Hope that's the correct form.

 

I have never had a problem with this process but now I am super pissed off.

 

Has anyone had an issue with leaving the US with an expired Green Card and how did you get back or get an exception?

The I-131a is the correct form from USCIS  to apply for a boarding foil.

She should have gotten a 4 year extension letter after filing an I-751 for removal of conditions.

This was recommended as well by 1 USCIS rep but another rep said not because her Green Card was not Lost or stolen.

If I understand the situation, she has an expired 2 year Green Card and an expired extension letter.  If so, she cannot, to my knowledge, board without a boarding foil.

How do we get the boarding foil?

Will she be able to travel back in 6-8 weeks?- see below

 

And here's another issue. 

 

She has to go back to Japan end of April to finalize her mothers funeral ceremony... this custom requires a final ceremony 49 days after the cremation and obviously she wants to comply with her mothers wishes, and it's not an option for me to say no to her.

She will need either a valid extension to accompany the expired Green Card...or she needs to get an ADIT stamp from USCIS in order to return after that trip.

Filing Fee

$575.

There is no biometric services fee. Anyone may pay this fee from anywhere in the world, as long as they enter the correct first and last names, date of birth, and A-Number because this information will appear on your boarding foil. Can't she just file the I-90 and bring the receipt with the expired GC with her to the PoE? That's what some LPRs do when returning to the US with expired GCs.

What's LPR?

Wait a minute.....Why was an I-90 filed?  Wasn't this a 2 year Green Card?  Your timeline seems to indicate she received a 2 year card.

@Zumbadaddy, did you file an I-90 to renew a 2 year Green Card?  Your timeline shows marriage was in 2019.  If she was supposed to file an I-751, but she filed an I-90 instead, you have a big issue ahead.  She should have filed to Remove Conditions on her 2 year Green Card. This could complicate her current situation.   This needs to be addressed like yesterday!!!
