    Hi folks,
I was a k-1. my green card (I-485 Application to Register Permanent Residence or Adjust Status) was approved January 13, 2023 and expires January 13, 2025. I have not received any notification that extends for 48 months instead of 24. Should I contact USCIS or Im not applicable for the extension?
    TIA

Yes that is correct where the foreign income is shown reported (1h) then a negative number showing the excluded amount (Line 8). The US earnings  reported on W2s will be shown on 1a as a total for both of you.

i looked over the 1040 for 2022. It has changed from previous years. Line 1 used to be a single line. This year there are 10 parts covering Line 1.

The waiting period is not the real problem. You make patience and will pass. The problem is that you cant work till you get the work permit or GC.. With marriage visa you can work asap.
I regreted the K1 because i could not work for 10 months..

I will need to look at my 2022 TurboTax to review specifics for this year.  Each year things can be worded differently or the tax form slightly reorganized.  But if you wonder how to answer a specific question, just ask and I will try to help.

cristinea2 reacted to Wuozopo in Form 2555 and exclusion of taxes
Okay so you file with your husband. You have to report all his and all of your income (US and abroad) earned in 2022. Your US income is entered in TurboTax where it asks for W2 info. Foreign Income will be entered toward the end of the income questions under the section called “Less Common Income”. That’s where your January income gets entered.

TurboTax will take you through questions and do form 2555 ito exclude your Greek income. You qualify to exclude because you were a bonafide resident of Greece, allowed to work and earn money there.. It is written more for Americans working abroad so sometimes the wording is confusing. I think it asks what visa you had. That is not K1. It is asking what visa you had for Greece. Well none. You didn’t need a visa because you were citizen of Greece allowed to work there. You do absolutely qualify for the foreign earned income exclusion and if TurboTax says you don’t, then you have answered on of their questions incorrectly so back up and review what you entered.

If you get stuck, come back to this thread and ask specific questions.

Simplest is to take the foreign income tax credit.

    besides which:

    https://www.irs.gov/instructions/i2555

    Note.

If you did not live 330 full days in a foreign country, or countries, during a 12-month period, you are not entitled to claim the foreign earned income exclusion. The 330 qualifying days do not have to be consecutive.”

I just let TurboTax figure this stuff out.

PLEASE NOTE THERE ARE DIFFERENT TYPES OF MARRIAGE CERTIFICATES. For instance, if you require a marriage certificate for use in a foreign jurisdiction (including obtaining a passport from a US-based foreign consulate) you need an extended form which costs $35 for the initial copy and $30 for any additional copies. For most domestic purposes, you will need a short form which costs $15 for the initial copy and $10 for any additional copies. If you are unsure of the form of marriage certificate you need,

records for marriage in NYS are kept by the county clerk u married in

i sent USCiS the short form to show marriage to my late husband

cristinea2 reacted to CaLi90 in EAD Delay
These are very fast EAD approvals and very lucky, as previously it was taking 6-12 months. I deem myself lucky and I didn’t even receive my EAD before my AOS approval which took around 7months total.

You definitely shouldn’t be worried that yours hasn’t been yet as it’s well within processing time.

I hope your EAD gets approved shortly as I know it’s hard to see others get theirs and still be waiting .

    Good luck!🤞🏻

@cristinea2 can you give some examples please? Mine took 5.5 months in 2019, prepandemic. Things only got worse since then. Most of expedites are rejected, there's very few valid reasons when it could be approved.

The I-485, I-1311, and I-765 are all separate entities.  It is normal to receive I-797s for each.

cristinea2 reacted to powerpuff in I94 form and SSN
You need to apply before day 75 of the 90 days (sooner the better, you know how slow SSN works, even if you go before day 75 but if they don’t actually process it and issue it before then, they won’t give it to you), it can be before or after you marry, but it has to be in your maiden name because they have to match it to USCIS records.   After you get your EAD or GC (which will be in your married name) go back to SSN and change your name.

i94 has been electronic for years now.  SSA offices suspended walk-in services since the pandemic began and it’s been difficult for many to book an appointment. I suggest you get started on securing one now.

cristinea2 reacted to arken in I94 form and SSN
I94 info on cbp website has nothing to do with how SSO verifies your status with uscis database. It'll take a while that's why they say wait for 2 weeks. You can start calling the offices to get the appointment though, they may not be readily available.

Im not an expert but I have read that yes you can. There are some apps online too that can help you plus the US has an online tool that you check the photo. However i would personally dont risk it as any mistake can cause delays..

cristinea2 reacted to aaron2020 in K1 Visa - Tax question
If you marry on Dec. 31, 2021, then your husband's marital status for Tax Year 2021 is married.  He can file married filing separately with only his 2021 income.  Alternatively, he and you can file as married for Tax Year 2021.  You would need to include your worldwide income.  There may be foreign income tax exemptions.

Without knowing your income, it's impossible to tell you which is better for you.  Your accountant can help you with this.
