    Why did you marry if you are still pursuing the K-1?   And, unfortunately, no other country’s ministry of foreign affairs can “make” the US department of state give anyone a visa.

    My gut is telling me he was denied CR1 with the old wife and is now divorcing her to try someone else and if that is the case he is even more likely to be denied the second time around. Has he asked specifically what your income is?

    Long story short, my wife attempted to enter the US with me and received the 5 year ban; she came on a tourist visa and we intended to stay shortly.
     
    The judgement was based on fabricated answers from the transcript, saying she worked for a US company. She did not work for a US company.
     
    We have talked with an immigration lawyer and he indicated chances are high that I can challenge the travel ban and reverse it, without the waiver. Primarily because of the crazy transcript.
     
    The cost is way too much for us to afford at the moment.
     
    I'm not interested in discussing details of our case. My main question is would a go fund me campaign mentioning details of our case (fabricated answers and questions, bad english from CBP officer on transcript, experience being detained, harsh treatment, etc.) be damaging in our process? I.E. would the government look at it negatively in any way?
     
    We want to lift the ban and move back to the US and obtain a green card and citizenship.

    My friend asked me this question and I was unsure to answer her so seeking help here.
     
    my friend, Z, is married to a US Citizen, and is moving to US on May 1, 2021, before her 6 month visa is expired on 5th May, 2021. In 2022, she plans to apply for citizenship after her 4 years of marriage. ( or is the time 3 years counted from the date of entry in USA? To be eligible for citizenship)? She wants to call her sick mother ASAP to USA, because she’s a heart patient... she asked me how soon can she apply for her to immigrate and in how many years her mother could arrive to USA? Any general idea for time frame would be helpful to her..?

    Can I share somethings with you that I learned long ago about this process?

        • "the man with the gold makes the rules"
        • it will take as long as it will take 
        • no one with any certainty can tell you when some process will be completed
        • Your sense of urgency will never be equaled to what USCIS, NVC or your embassy demonstrates
        • Your journey is not going to mirror someone else's experience - yours and theirs are not the same
        • They only promised you a YES or NO answer. Never an exact time that their decision would be completed
        • Lowering your expectations will make you a much more relaxed individual
     
    We have a constitution with a bill of rights. In that document everything President Trump is doing is law of the Constitution Country of ours. There have been other Presidents who have exercised their due diligence to help protect the American public and they too have abided by that same set of laws.

    USCIS, like other Federal Agencies, does a tremendous amount of work, is seldom appreciated, or praised, and the scale of work they do is several orders of magnitude larger than private companies but we as the world outside, and the consultants who often have worked on small to middling projects seem to be obsessed with private enterprise as a model to emulate!
    Sometimes the tallest building seems small when shrouded in clouds.

    But the embassy’s job is not to “help” someone get a visa. I’m not saying I agree with that stance, so don’t shoot the messenger. 
     
    They don’t know your wife from a bar of soap. What they do know is that many, many people in the past have walked into the embassy with piles of evidence of ties: property, children, jobs, elderly relatives, and so on yet still they overstay. Statistically speaking your wife falls into the category of those most likely to overstay - the love interest of a USC. Reason? Because she has a guaranteed path to residency (if she wants it) with no repercussions. Even illegal working is forgiven for spouses of USCs - not that we condone that here but just throwing it out there to highlight how “easy” it is for spouses to arrive as a visitor and never leave. She would have nothing to lose. 
     
    Compare that with Mr. and Mrs. X who just want to take their 2 kids to Disney. They have no way of being able to stay, if they do overstay they risk deportation and a subsequent ban, they cannot work, they have no family support network here. Healthcare would be an issue. They won’t have SSNs so conducting day-to-day business will be difficult (we tried to rent an apartment before my SSN card arrived and boy, it was impossible - even though I was a green card holder), they would be constantly looking over their shoulder and life would be miserable and eventually the money would run out with no legal path to get more. Your wife has none of those concerns. That’s why the embassy officials are immediately suspicious of her and any other spouse of a USC. 
     
    Even previous trips don’t count for much. I visited my husband over 40 times before I immigrated. On visit number 39 or 40 I was interrogated and the CBP Officer repeatedly said to me “Tell me the truth! You are here so that your husband can file an adjustment of status for you and you have no intention of leaving!” For an hour I was questioned like this. Despite in the region of 40 successful visits in the past (ranging in length from 4 days to 3 weeks) and a job with an airline that depends on my ability to be able to travel in and out freely. 
     
    If she mentioned on the DS-160 or at the interview that she was wanting to go for 3 months then that was probably her downfall. If she can abandon her life for 3 months, what’s to stop her from abandoning it for 6, 9 or 12 months? That’s how the officer sees it.

    I don’t often say this but you have no idea what you are talking about. The 5-year ban has been in place for years. Canada is irrelevant to OP. The i130 is not a “visa”, it is the petition form that everyone petitioning for a family member uses - which includes both banned and unbanned visa categories. You missed that OP is an LPR, which means the visa type for her husband does in fact fall under a currently banned category.

    No. 1  should be your post office. To make sure  ask your  mail carrier or a neighbour.

    Honey.... from a womans perspective here....I need to say something. For an engaged woman to get pregnant by another man is more than just cheating. Are there no more chances in life for you where you can't POSSIBLY find another woman to love and respect you? Run now while you can! For so many reasons. Stop the bleeding while you can. You will be raising another mans child because whether you like it or not, she's now a "package deal".

    Having the visa in your hands is better than it is sitting with the Embassy. Simple connotation reflective of your case. Everyone here has opined that she would have picked up the visa and she didn't. You asked for opinions and now you have mine.

    I love your stories and think you should become a writer!! Good luck 🍀 and hope all will go well in the future!!! I’ve been here since 3 weeks now, and I can tell you, everything is closed due to corona so thinks take FOREVER right now lol. But it all doesn’t even matter I’m so glad I’m here with my new HUSBAND. it’s all worth it!!!
