    my situation is almost identical to yours.
     
    i came back to the US last year and started working in June. at first some retail jobs then in october i started my office job. my 2019 tax returns indicate about $18,500 as my income and nowhere do they say that i worked only for 6 months. i explained a bit of it in "additional pages" but then i also included a letter from my employer indicating my salary (Well over the poverty guidelines), and my last 6 months of paystubs. i also included pay statements from my part-time job.

    i used my explanation letter to compact a 6 year relationship (including two CRBAs, and across two continents) into a one page letter. i had to streth the margins and whatnot to make it fit.

    If by illegal you mean having a regular job (such as a waitress or a nanny) and getting paid under the table /nothing contract, then it's don't see any problems with you declaring it. Now if her illegal job is drug dealing or gun smuggling then you'll have some serious issues.

    Correct. This what I did and I got that yellow letter some weeks ago. I am planning to take my medical exam to the interview, but because I do not know when that's gonna be now with the COVID-19, I don't want my medical exam to expire.

    Do NOT file AOS with I-693. It is NOT required to included I-693 at the time of AOS filing due to the time that USCIS takes to review all the documents before the interview. they will send you either pink or yellow paper that says you are missing I-693 and that you should present it at the time of interivew. Work on I-693 once you get an interview notice...which will be a long time from now on.

    I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.

    First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered.   While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards  those fortunate to have their case dealt with quickly, or  critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!

    Secondly- in the info forums, you may get bad news.  When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed.  However, the emphasis is still on being welcoming and friendly.  If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive.  No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or  illegal actions in the past- instead, encourage and explain legal options for the future.  And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.

    Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums.  But if you feel that way, just scroll past- no need to criticise the OP for asking the question.

    so i'm guessing the correct way to answer this is actually "NO" but then don't include the 944, just fill out the 864?

    I see your thread and will post there shortly. I think there is some confusion and it is best to speak about your specific case in its own thread.
    Edit: Actually, I just saw that you were (correctly) advised to check "No" already. I misread your comment to imply you were told otherwise.

    Assemble all the documents.  Go the AOS way. She is here already. Your family is here. As in...just do it. And...don't forget to apply for EAD and Advance Parole.
     
    This is one of the best stories i have heard. When God is on your case, standard operating procedures become irrelevant.

    Oh man... thank you all for your advice. I think i made the mistake of watching too many youtube videos and most of them use super-organized binders. But you're right, they're visually appealing, but not practical for someone in an office trying to sort through hundreds of applications.

    hey juan, it indeed is a beautiful place with so many preventable problems. i pray one day we get the right leadership over there. regardless, i still love it. i'd rather be there than here in the US, but here is where the work is

    i would much rather she never have to go back. she certainly doesn't want to. i'm so confused now. everything you are all saying makes perfect sense. it's just odd having prepped myself for this for months, to suddenly have to re-evaluate. i'm definitely not gonna submit the 129f right away now.
     
    some more information, she came in april and has now been here two months. 6months will be up on october 22

    Yeah but that is all judge at entry. Once someone has entered there intent has already been judged. Or as it is so often simply put intent is judged at entry.

    Well, her intent was established at POE.  She was admitted and inspected on a visitor visa with plans to visit and then return home and pursue the K-1.
     
    Plans changed.  If you get married now, you have the right to petition her and she has the right tp apply for an adjustment of status as an immediate relative of a USC.
     
    There are many, many here on VJ who have done just that without issues.  There are also people who have entered and lied to CBP about intent, but from what you have said, that is clearly not your situation.
