    K-1 usually has shorter wait times and money spread out into different forms.  It winds up costing a little more but your fiancé is in the usa quicker and the cost is spread out. You still have to do a lot of the paperwork when they get to the usa bc they don't have their green card / residence permit and you need to pay for the form for them to work.  
     
    Cr-1 i think takes about a year before your fiancé is in the USA but all the money and forms are done at once so the cost is all upfront.  When they come they have their green card already.  I think they can work automatically too. 
     
    Bc of Coronavirus everything is taking longer and uscis is increasing the price of all their forms.  
     
    Idk about the cr-1 requirements bc I'm doing the k-1 Visa.  It's been about a year at this point and he's still not here but that's bc of coronavirus.  Unless the situation with covid 19 improves I'd suggest the cr-1. Idk how you will do it with no income though bc I think the income requirements are higher.  Please look it up and see.

    At this moment in time I would do the CR-1 Visa. My fiancé and I decided to do the K1 back in February, as back then the processing times were slower and we thought it would less waiting time for us to live together. Then COVID-19 happened and the processing time for the K1 turned into about the same as the CR-1, except I'll now have to wait an extra 5 months to work when I do arrive in the US. My fiancé and I both agree with hindsight that the CR-1 would have been the better option. Hope that's useful, way up the comparisons and choose what is best for your situation!

    The i129f discussion seems to just be about getting your noa2. We are past that stage.  We have all of our documents and we're ready for the interview.  
     
    The coronavirus thread is helpful but alarming.  One post said Turkey won't open til feb 2021. I hope that's not the case.

    Each embassy is going to open when it is safe to open in that part of the world. Some will open sooner than others. We know of two that have opened for scheduling with interview beginning next month.

    Our visa appointment has been delayed 3 times since March. The last appointment for july 6th was canceled by them.
     
    Our k1 (noa2 validity) expired may 31st. We emailed 2x each and I sent 2 faxes about extending it with no response.  I don't know if it is extended or not. No communication.  What do  I do about this? Is there a way to check if it's been extended? How long can they extend it?

    So far haven't seen one need a waiver if they are not subject to the 2 year rule but I could be wrong of course.

    I was here on both a J1 and an F1 before my K1 and had no issues. Was your friend subject to the 2 year home rule?

    Think "jointly and severally liable" - each individually is fully and equally responsible for the obligations on their own. If you have a lease for $1000/month and have a roommate on the lease, that doesn't mean the landlord can't require $1,000 from just you if your roommate refuses to pay (although addressing their non-payment would be a separate issue for you).
    Other than that, it's just the term they use to designate somebody who is joining their I-864 packet (not income/assets) with yours.
     
    If one meets the requirements of the I-864A (https://www.uscis.gov/sites/default/files/files/form/i-864ainstr.pdf), then the income can be combined.
    Item #2 would only apply if you are currently living with them.
     
    In that case, she can be a household member via an I-864A at that time. Note that this is NOT a joint sponsor - you are still the primary and only sponsor here. And yes, the household size would be 3 again, so the $26,662 figure applies as the minimum.
     
    The I-134 has no equivalent of an I-864A. It only has sponsors and co sponsors. So you would each provide an I-134. Your household size would be 2 (you and him), and hers would be 2 (her and him). I get it seems odd, but keep in mind they are separate here.

    Not quite random..it is fairly well known with immigration questions. That speaks nothing of it's accuracy in general, let alone this specific case, though.
     
    That's actually a document based on the I-864 from 2016. They revised the I-864 in 2017 or so and updated the wording to:
    "Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value.
     
    You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home. "
    (And yes I know I said I-864 and this is a K-1 case so there's an I-134 instead...but those instructions linked are for an immigrant visa, which uses the I-864. For a K-1, the current instructions are here: https://tr.usembassy.gov/wp-content/uploads/sites/91/2017/06/K1K2-Visa-Instructions-EN.pdf. And for the I-864, that will be handled by USCIS based upon their own instructions).
     
    That said, the first paragraph still applies regarding not causing an undue hardship.  It's still not believable that one would sell their home to sponsor an immigrant. But say they had significant equity in the home and/or it was highly valued - it's not that unreasonable that one would refinance or move to a less expensive home as needed for an immediate relative. To be clear, I'm not saying that means it is wise to just use the entire net value of the home in lieu of income....but if one's case was closer to the borderline of being deemed satisfactory by the CO to address the public charge issue (via income or other assets), then it may be considered.
     
    tldr: A primary home can be considered an asset for the public charge issue, but is only actually useful in limited situations. Generally one should meet the income/asset minimum with liquid or substantial non-primary assets (second car/home/etc.), and a home can supplement.
    In practical terms, would a CO believe that a retired mother would not face an undue hardship by selling or refinancing their home...as they continue through retirement? Keep in mind the I-864 (for AOS) has no definitive expiration period...it can be a lifetime commitment. I'm just not seeing that happening, sorry.

    Are you sure it absolutely sure it can't count?

    Difficult because he won’t be able to work for 6 or more months - and likely won’t be able to drive - and won’t have income to do things. This makes it very hard to travel and make friends.
     
    When he visited in the past, he was obviously on a different visa and ergo, the scenario was very different...

    Unfortunately, the house in which she lives cannot be counted, as the point of the income/assets/savings is to demonstrate that she can financially support the immigrant...if he has medical bills that need paying, she’s not going to be able to use the house she lives in to pay them off.
     
    Your $15K can absolutely be counted - but it isn’t enough on it’s own...

    Why not just get married at the Turkish equivalent of a courthouse without any family there, and then apply for a spousal visa and then do your 'proper' wedding in the US with all your friends and family once the visa is acquired? Family may get offended, but they would most likely be supportive of your decision and understand the reasons why.
     
    We did something similar, got married in a courthouse in the US with just our daughter as a witness, and then a year later did a 'proper' wedding celebration in the UK with all our friends and families. Most people attending the wedding in the UK didn't even know we were already legally married as we just kept that info to our family and close friends, as in our eyes the UK wedding celebration with our friends and families was when we were properly married, the courthouse ceremony was to satisfy visa requirements.

    Have you looked at the differences between a K-1 and a CR-1 closely?   You can always marry outside the US, then have another ceremony later with your family...
     
    Every couple has their own priorities, and each couple must decide which visa is better for their situation.
    K-1
        Slightly faster arrival in the US (currently about 5 months sooner)    
        More expensive than CR-1    
        Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
        Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
        Spouse can not work until she/he receives EAD (approx 5-6 months)    
        Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
        Spouse will not receive Green Card for many months after Adjustment of Status is filed.
      
    CR-1
        Slightly slower arrival in the US (currently about 5 months later)
        Less expensive than K-1    
        No Adjustment of Status(I-485, I-131, I-765) required.    
        Spouse can immediately travel outside the US    
        Spouse is authorized to work immediately upon arrival.    
        Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
        Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
        Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

    Not sure if this has already been covered in earlier replies, but when you do get to the needing-a-joint-sponsor stage (at the interview for a K1), the house your mum lives in would not be considered an acceptable asset. Basically, it needs to be assets that could quickly and easily be sold if needed to support your fiancé whilst he can’t work - the house you live in, the primary car you drive, etc, are not acceptable for this.
     
    As such, it doesn’t sound like your mother would be a suitable joint sponsor, so you’d need to look for an alternative one, or return to the US and find a job that earns enough so you don’t need a sponsor.

    Yeah, we are living together in Turkey but I'm working off savings, so the longer we're waiting here the worse it is for me. When we get back to the USA I can at least work.
     
    (A wedding here would also cost a lot of money too because everyone would get offended if they're not invited and neither me nor my fiance like Turkish style weddings. It's more about flashing cash - like how much you spent rather than creating an enjoyable experience. People go to show their face or represent their family but not to enjoy the celebration. At least that's the feedback I've heard so far). 
     
    Even in America, we just want something small. We're not into the pomp. It's better to save our money or donate it to a worthwhile cause that helps others.

    For the house you may need to get it appraised. Note that if the house is the primary residence you will be living in they may not consider it, since it can’t be liquidated to provide support. They really Are looking for liquid assets, since they are making a judgment on the sponsors ability to pay your living expenses.
