15 years age gap between me & my husband and I don’t even feel that because both of us are old .
Your age gap is not a problem at all .
    Good luck !

I received a courtesy letter on Saturday regarding the medical. It said that an RFE would be sent IF an interview was not required, but I know it is required so I would expect not to receive one. That said, USCIS works in mysterious ways and they may still send one. My plan is to schedule my medical as soon as I receive an RFE or an interview date. Then either submit it or take it to interview. Not sure how helpful this response it now that I've written it 😂

But the law allows a person who came into the US a visitor to adjust their status if they did not enter with intent....unless she misrepresented her intent at the border when she entered, she can legally adjust.
  7. Confused
RedroseMT reacted to amah91 in Married with an ESTA (tourist) visa
Because for marriage purposes you're supposed to apply either for a K1 or a CR1 visa. ESTA is used for tourist purposes.
But I'm assuming being here you already know this information.

Yeah, none of this is real.
Intent is determined at the border, OP didn't lie to CBP, and why on Earth would you need ties to your home country if you're applying for AOS to stay in the US?

I am 100% as well and have my family enrolled in Champ as a secondary insurance. They saved me from a $2500 bill already this year.

Then she will have to follow the link here to enroll in ChampVA: https://www.va.gov/COMMUNITYCARE/programs/dependents/champva/champva_apply.asp

Did the VA tell you are qualified for Tricare or VA health care?
Military benefits are not considered as public charge .

What will be with disabled people? Older people?
Don’t get me wrong- I don’t think that every Green card application must be approved but they should concentrate more at illegals who “ suck “ a lot of tax payers money by all the benefits they get .

250% seems way too high...I feel like most of us on here (and most americans) dont make that kind of money. I am grateful I am just waiting for my interview now...I hope some of these rules are reduced in the next couple of months.

This rule only affects on any applications which postmarked (filled) on or after its efficient date. Any pending cases will still be adjusticated based on the 1999 Interim Field Guidance, which only requires the sponsor satisfies 125% Poverty Guideline. You still have less than 60 days to file your case, unless you want to play this rule in which the Poverty Guideline can be raised up to 250%. Again, this is a move only to bar poor people from entering this country!

Pending applications before the effective date won't be subjected to this rule, but this is basically still the same with the current rule, they just added more clarifications on it.

I don't recall it being applicable to an adjustment of status interview.........more of a practical issue.  Since a veteran's  family members being covered by the VA is rare, health insurance is especially important....good luck.

I carry a 10% VA rating and nothing is available to my family members

According to the VA the Veteran Spouse would have to be 100% disabled (or dead, likely not the case here):
Family members are a key part of Veterans good health and support network. VA health care coverage is available for family members of certain Veterans who are permanently and totally disabled or died serving our country and in some cases, Veterans with children who have Spina Bifida.

No, health insurance has nothing to do with it. The only consequence of not having insurance is if you get sick, you will have no coverage and it will cost a gazillion dollars. A trip to an Emergency Room will cost several thousand dollars. That's if they finds nothing wrong and send you home. If they put a band-aid on you at the ER, it'll be $10. An aspirin will be $20. A 2-3 days hospital stay can easily cost $20,000.

From lawyer’s perspective there is not a single reason why one shouldn't hire lawyers. If you tell them “my spouse farts often, if that’ll be a problem for visa interview”, they will say “oh you definitely need a lawyer in that case”.

Sounds unlikely.  The marriage certificate being in the car smells fishy.

The wife saying the officer threatened her to withdraw.  I don’t believe that for a second.

Sounds like you’ve been lied to and/or you friend and wife are lying to each other.
