    Our interview originally scheduled for April 1 was cancelled on March 17 due to the coronavirus with no estimation of when it will be rescheduled. I am not expecting things to calm down enough this month for a May interview but maybe in May it will be calmed enough to get something for June..

    Adjustment of status is not an option if she comes on ESTA... preconceived intent to adjust status on ESTA will be visa fraud and she can be banned from the US permanently and her ESTA revoked
     
    She won't be eligible for an F1 visa, it's not dual intent so she will have to be able to prove she plans on moving back to Sweden after her education in the US is over, which will be impossible to do with a current pending CR1 and the fact she is married to a US citizen. Also, she will have to prove she has the means herself to pay for everything out of pocket, since she won't be eligible for any government benefits for schooling from the US. This is a huge inconvenience in comparison to if she goes to school as a permanent resident after getting a CR1 visa, since as a green card holder she'd be able to apply for things such as financial aid..

    Yay! Time to join the Case Complete forum! DQ yesterday April 6, 2020. Finally.
    Now to start the long wait for the Montreal Consulate.

    My timelines are the following:
     
    USCIS:
    May-03-2019 --- NOA1 (Potomac Service Center -  IOE receipt#)
    Nov-07-2019 --- RFE
    Nov-08-2019 --- RFE replied (via online)
    Nov-14-2019 --- NOA2
     
    NVC:
    Jan-20-2020 --- Case number received
    Jan-21-2020 --- Fees paid
    Jan-28-2020 --- AOS and IV documents submitted
     Apr-03-2020 --- All documents accepted except my I864EZ form. They said I did not qualify to use EZ form. However, I, for sure, am qualified to use EZ form. I called NVC on Apr-3, could not talk to a supervisor.
    Apr-06-2020 --- I called NVC on Apr-6 again and talked to a supervisor. The supervisor stated that EZ form can be used in my situation.
    Apr-07-2020 --- Documentarily qualified. Thank you NVC.

    Me too but most importantly I hope the virus slows down soon! I saw that as well, however even if we did manage to reschedule, the medical office in Copenhagen is not taking visa medical appointments until further notice, and since we don't know when things will go back to normal, I don't want to really schedule something that will most likely be cancelled again (since all the consulates are closed for the foreseeable future with no "end date" for the closures in place). My husband also has to travel to another country (from Denmark to Sweden) for his interview and I'd rather not have him fly and travel to a big city like Stockholm with all the rising cases in Sweden right now..It is sad and I wish that none of this had to happen, but I think it's better safe than sorry since at this rate I think interviews for May might even be cancelled. I want my husband here ASAP but I think our best choice right now is to wait for this to all blow over and wait for the consulate to contact us. When the consulates reopen again, I think we can consider it (at least somewhat) "safe" to travel again and hopefully be sure that the interview will not be cancelled

    Not all too uncommon, I've seen some other quick approvals from Vermont after being transferred there (though of course not everyone yet) despite the long processing time on their site, congrats!!

    Well.. either way something's gotta be mailed. Either the application for an ITIN, or the petitioner's taxes, because if you do MFS, it's gotta be mailed (with NRA written on the space for your (spouse's) SSN usually goes), since you can't e-file without the foreign spouse having an SSN or ITIN

    If the are any folks at NVC reading these comments - THANK YOU for continuing to work and even if you did not have the choice, we have a great deal of respect for you! You continue to give us hope. Many of us who are just wanting to be home with our families and seeing cases still being processed is helping a lot of us cope in this wired time.

    DS5540 is required but healthcare is not required. Though it will heavily play against you in terms of public charge at the interview if you won’t have insurance within 30 days of arriving

    For DHS it isn’t required. But for DOS (NVC and consulate level) they are applying it to everyone across the board. My consulate told us they are requiring it now from everyone no matter DQ or petition date

    No not really, there’s exceptions for spouses of USC’s so the attached isn’t really applicable - people adjust from VWP all the time, provided their case is legitimate there shouldn’t really be any issues

    Appointment cancelled! They told us the 16th it was still confirmed but unfortunately the next day they cancelled it, we didn’t see the cancellation email until today

    I would attempt to reach out to them. As far as I know the embassy is closed. If I remember correctly I read earlier here someone in Lagos showed up, and they and a bunch of other people who were waiting outside were told all interviews were cancelled and that due to backlog they were unable to email everyone about cancellation

    Yes you can get a new passport with your married name. Your green card will be issued with the name your passport is in so if you want your green card and visa in your married name, change your passport to your married name. You can update your name to your married name at NVC, it's ok that you used maiden name on the I130. Just update it at NVC once you change it

    There are numerous excellent data security reasons as to why these people can't work from home actually. While they could be doing a lot to improve the situation at work, working from home isn't one of them without millions of dollars being invested in a secure system that even then is extremely susceptible to social hacking. So no, they aren't going to go down the route of making everyone's social security numbers, passport info, family details and other info that are great to know in order to steal additional info, and countless other sensitive documents easily intercepted.
