trucphong got a reaction from TBoneTX in Original/ copy Naturalization Certificate for Interview
I did send it through Fedex 2 days shipping. Some families have more than one birth certificates. I heard that as long as there is red stamp on birth certificates then it is ok. I have not heard the certified copy.
Just FYI, if you dont have the documents that they require, they will either send you home (no interview) or ask to submit it later. It will delay the visa for weeks or months not 10 days.

Don't know the answer about original vs copy, but you could consider getting a "certified true copy" of the certificate (basically a notarized by USCIS copy). Those can be obtained at a field office but you have to make an appointment.

trucphong reacted to pushbrk in I-864/I-864A Income Question
The entries for total income from tax returns are what they are. Enter the number you see. Deal with your current personal income completely separately. Become an A-Student of those form instructions where this is made clear.

2) No

Incorrect. Having done IR 5 it is No to both. Stand-alone petitions.. no derivatives allowed either “with” or “ to “ follow “

trucphong reacted to Lil bear in IR5 NVC Financial Documents for I-864 and I-864A
Explaining simply can preempt a question so yes. You are always the principal sponsor even when using a household member or joint sponsor to meet the requirements

trucphong reacted to Dashinka in I-864/I-864A Income Question
Always a good idea for a primary sponsor (I864 signatory) to have their spouse file an I864A particularly when going through consular processing.
I believe you only put your specific AGI here which in your case would be $0, but others may know this better.
Good Luck!

Try skipping that part and not putting anything. Long since I filed a petition online.

trucphong reacted to Rocio0010 in Total marriages are wrong with N400 online filing
I have seen so many of these cases whereby the total marriages are wrong (myself included!) that I am thinking it might be a glitch in the system.
Two options: either you proceed online and clarify at the interview (I did that, but that's because I didn't realize this mistake until the day prior to the interview) or you file by paper.

trucphong got a reaction from LexieJ in Green card holder and previous spouse (a bit complicated)
I have heard multiple cases in Vietnam got denied because divorced and then re married the same person.
Lets not talking about visa thing and ask ourselves: How many percent of people will remarry the same person in real life after divorced ? It is really rare so IO wont believe it.

trucphong reacted to JeanneAdil in F2B visa for daughter over 21 years old that has child
Tell the green card woman not to naturalize till the process is ove
if she natualizes the visa type changes and Nolo law says::
https://www.nolo.com/legal-encyclopedia/how-naturalization-affects-your-child-s-application-for-a-u-s-green-card.html
and also discussed on immigration site
https://fam.state.gov/fam/09FAM/09FAM050201.html
If your child is over the age of 21 (thus called a "son or daughter" in legal lingo), and already has an application in the F2B category, naturalizing might automatically put the child into category "F1," for unmarried sons and daughters of U.S. citizens over the age of 21.
That could present a problem. There has been more demand for F1 immigrant visas in recent years than for F2B visas, with the result that the waitlist tends to move slowly (though this could change). The difference can be several years' worth. So, by naturalizing, the petitioner could seriously delay the child's application for a U.S. green card.

trucphong got a reaction from thanhmakeysother in "What is your current legal name?" If your birth certificate doesn't match the name on your green card, which name should you use?
There was many people got this issue in the past. They suggested us to not doing anything and use name on greencard as official name as it would be hard to change it with I-90 as you cant say Vietnamese passport order is the problem. Vietnam passport order did not list First name is this or Middle name is that so it is not Consulate’s fault. What kind of documentation we need to show USCIS to correct it because their fault in I-90? How do we convince USCIS correct name is legit?
My wife has 10 years greencard hence she does not do I-751. She will file N-400 at the end of this year and we will use her greencard name to be her name on N-400. She does not plan to change her name back on N-400 either. If she passes, her US passport name order will be Last name Middle name (green card first name or her wrong first name in US) and First name which will match to Vietnamese passport.
It is not straightforward to us at all and we dont like to do this way. I agreed with other people said to correct it but it is not straightforward and I am not sure it will bring up more issues with I-90 or not.

trucphong got a reaction from thanhmakeysother in "What is your current legal name?" If your birth certificate doesn't match the name on your green card, which name should you use?
I dont think that someone put wrong order when they filed papers. It is Vietnamese passport name order issue.
US passport name order lists Surname and Given Name. Given name for US passport lists as First name and then Middle Name. US name on order passport is Last name First name and Middle name.
Vietnamese passport name order lists in weird way that is not standard as following: Last Name Middle Name and First Name.
When American people look at Vietnamese passport, they thought it would be the same order as US does. That is why they would think Middle name on Vietnamese passport is First name (same order in US passport) and First name is Middle Name. Hence when Consulate printed visa, it needs to match to passport order which greencard will follow the same order as visa.
Many Vietnamese people got this issue specially people come here with IR1 or CR1 visa including my wife. K1 visa people filed I-485 form in US which they put correct name on the form and USCIS prints it to match with the form so they dont have issue.

trucphong got a reaction from Lemonslice in K1 Visa Rejected Due to Lack of Evidence of Relationship (Vietnam)
Yeah. That is correct. It mentions on top of letter R2-A type of blue sheet. This is what I observed on many blue sheets from Vietnam.

trucphong got a reaction from DamianB in Tax Returns vs. IRS Transcript (Interview)
US Consulate in Vietnam asked us to upload tax transcript, W-2 for 2019. My tax 2019 return is still at IRS. I uploaded my copy of I-1040 with all schedules, W-2 and paytub on CEAC. They dont have issue with it at all. Good luck.

trucphong got a reaction from NotAFish in Family Tree for K1 interview in Vietnam?
Just wanted to give an update on my wife’s interview. It went smoother than what I predicted. She saw pink sheet with her name on it before interview but officer asked us to upload I-864, 2019 tax, and W-2. They dont accept I-864EZ but NVC wasnt concerned at the time. Anyway we did what officer asked and got appoved.
Good Luck everyone.

Thanks, Jason. She is on her way to Embassy now for interview. Unfortunately, I could not go with her due to Covid-19. This interview will be tough for us as I had petitioned my ex-wife previously.
