  1. Agreed. I think Timona thought I might answer the question 61a/b Part 4. My mom lives outside of US that is why I dont fill in City/ State questions for 61a and 61b Part 4. I only filled for 62a/b/c Part 4 questions for consulate process. I was asking what city/state the application was filed for my mom when I submitted her application online in Part 5 for questions 3a/b.
  2. Yeah I did not enter US city state in other question for I-485 because she lives outside US. I chose outside of US and entered city/ country for consulate process. This question in other hands do not pop up country and it is same on hard copy with city and state.
  3. Hello, I filed petition for my mom online using I-130 form where she is living outside of US. I am now filing for my dad. I have question relating to Part 5 I-130 as followed: 1. Have you ever previously filed a petition for this beneficiary or any other lien? Yes as I filed for my mom. Provide name, place and date of filing where I have a hard time with place: City or Town and State. I filed her application online and she will have to go through consulate process. Which city and state I need to put here? Is it my city and state? There is no service center either as this is online process. Thanks.

  5. Hello, I am in process of filling out I-130 to sponsor my parents and I am now US citizen. I have few questions relating to I-130 Part 5 Mom petition: I am filling for my mom and I need help with Part 5 questions 1. Have you ever previously filed a petition for this beneficiary or any other alien. The answer should be No. No problem with this question. 2. If you are also submitting separate petitions for other relatives, provide names. The answer is I should include my Dad name there even I have not submitted it yet? Dad petition: 1. Have you ever previously filed a petition for this beneficiary or any other alien. The answer should be Yes as I filed for my mom at this time and provide my mom name/ date file etc. Is this correct? 2. If you are also submitting separate petitions for other relatives, provide names? Do I need to provide my mom’s name or I already filed for her and her application has my dad name already hence I dont need to mention it again? Thanks.

  8. I am his second marriage and I did fill out the first marriage that he divorced with date etc. I was thinking to add myself into it but it wont allow as it will ask date of marriage and end date of marriage. I will check all question again but this is weird to me.
  9. Hi all, I am trying to file N400 using online tool and got a roadblock. My current husband divorced his previous marriage to marry me. When I reviewed application before submitting, it said my husband got married once which is incorrect so I paused my application until I know how to fix it. On paper form, the question 8, part 10 I can type 2 easily but online tool does not have this question. It asked my husband prior marriage info date of marriage and divorced which I filled it. I might misunderstand the question 8 part 10 which might only ask total prior marriages without including current marriages which is me? Question8 part 10: How many times has your current spouse been married (including annulled marriages, marriages to other people, and marriages to same person)? If your current spouse has been married before, provide the following information about your current spouse’s prior spouse. Can someone educate me on question 8 part 10 whether it needs to be 1 or 2? If it is 2 then how can I fix by using online tool? I have not submitted the application yet. Thanks.
  10. I have heard multiple cases in Vietnam got denied because divorced and then re married the same person. Lets not talking about visa thing and ask ourselves: How many percent of people will remarry the same person in real life after divorced ? It is really rare so IO wont believe it.

  12. Hello All, I am asking these questions for my childhood’s friend. Her mother came to US under IR5 category (i.e. her oldest daughter that filed petition). Her mom now has greencard and want to petition her daughter in Vietnam that is above 21 years old for F2B category. Her daughter is still single at this point. It should be straightforward F2B case, however her daughter had been dating a guy and they now have a child together. 1. Her mom told her to not getting married as she can only petition non married son/daughter above 21 years old because her mom is permanent resident not US. Citizen. Will this complicate situation later where her daughter wanted to marry the guy and petition him to US under marriage category? 2. Can her mom petition her and child or child has to stay with her father? Note the birth certificate has father’s name. Is there some sort of paper that she needs to get father’s signature so that child can go with her? Thanks.
  13. What did your wife fill out a question in N-400 Part I question 3 “Other names you have used since birth”? Did she have any issue for Naturalization with incorrect name? Thanks.
  14. My sister and my aunt got the same issue but we did two different approaches. 1. I renewed my sister green card I-90 form and I realized her name was wrong on her old card. I changed her name on I-90 and need to show birth certificate etc to get approval. It was going back and forth with USCIS. They finally changed her name on green card then she used correct name for N-400. She needed green card to travel and it was expired when she was 12 which she could not apply US citizenship at the time. That was reason I-90 was filed instead N-400. 2. My aunt case was different a little. Her driver license has correct name because DMV people must look on the form instead of geeen card and I believed her SSN was wrong so I assumed her Green Card was wrong. She then applied N-400 back then and it was wrong as resulted her name on US passport was wrong. She recently wanted to change her incorrect name to correct name which she has to pay money to do so to match name on all cards.
  15. There was many people got this issue in the past. They suggested us to not doing anything and use name on greencard as official name as it would be hard to change it with I-90 as you cant say Vietnamese passport order is the problem. Vietnam passport order did not list First name is this or Middle name is that so it is not Consulate’s fault. What kind of documentation we need to show USCIS to correct it because their fault in I-90? How do we convince USCIS correct name is legit? My wife has 10 years greencard hence she does not do I-751. She will file N-400 at the end of this year and we will use her greencard name to be her name on N-400. She does not plan to change her name back on N-400 either. If she passes, her US passport name order will be Last name Middle name (green card first name or her wrong first name in US) and First name which will match to Vietnamese passport. It is not straightforward to us at all and we dont like to do this way. I agreed with other people said to correct it but it is not straightforward and I am not sure it will bring up more issues with I-90 or not.
  16. I dont think that someone put wrong order when they filed papers. It is Vietnamese passport name order issue. US passport name order lists Surname and Given Name. Given name for US passport lists as First name and then Middle Name. US name on order passport is Last name First name and Middle name. Vietnamese passport name order lists in weird way that is not standard as following: Last Name Middle Name and First Name. When American people look at Vietnamese passport, they thought it would be the same order as US does. That is why they would think Middle name on Vietnamese passport is First name (same order in US passport) and First name is Middle Name. Hence when Consulate printed visa, it needs to match to passport order which greencard will follow the same order as visa. Many Vietnamese people got this issue specially people come here with IR1 or CR1 visa including my wife. K1 visa people filed I-485 form in US which they put correct name on the form and USCIS prints it to match with the form so they dont have issue.
