    It was revoked by USCIS. It was sent back to USCIS after being in AP for 2 years, received NOIR and responded in February, now received revocation notice.

    So, I received a revocation notice for my husbands I 130. Anyone who has gone thru this, is it better to appeal or start all over and submit a new application? We have been going thru this process for 4 years now and are so frustrated and disappointed.

    I'm so very sorry to hear this.  I know this has been a long road for you so far.  I agree with what others have already mentioned refiling will do nothing if these items in question are not overcome.  Unfortunately because we  read these horror stories on here we tend to go overboard with certain proof that may not even be necessary.   Gifts and affidavits are not nearly as helpful as proof of a husband and wife relationship. 
     
    I would do what I can to spend more time together (either by living together or a consistent visits every few months).  Take as many pictures you can of doing normal  things together.   Even screenshots of your daily video chats  to show how you live your daily life apart.  A few chats may be ok but more important would be the amount of communication.  Show logs of how many times a day you spend together.   
     
    A husband and wife relationship is like no other.  There should be a connection between you two.   This is what they need to see.
     
    I know its frustrating and disheartening to know you may have a few more years of this dreadful process but you can get through it.

    FYI, the revocation notice included a paragraph about gifts etc apparently being given at the same time as OP had declared bankruptcy, with USCIS having received no clear explanation as to who actually paid for the gifts, fees for filing etc.  I am not making a judgement here, simply pointing out that there were a number of different unexplained factors that led to the USCIS conclusion, many of which are not that easily explained away. 
     
    And again no judgement on this particular case, but the “family changes” thread is full to bursting of USCs who thought their relationships were genuine.  
     
    Regardless of anything else if OP wants to pursue this the only real way forward seems to be for her to find a way to go live with her husband for a year or maybe more. That should help reassure everyone involved, uscis particularly of course,  that the relationship is genuine. Us debating here the actual facts of the case is not going to help. Trying to figure out exactly what uscis might suspect is the case - and therefore how to overcome those suspicions - is probably about as helpful as a bunch of posters on the internet can be under the circumstances.

    After going through the OP's posting history, I am convinced that the marriage is genuine (from her side). For paid arrangements I would expect the American citizen to have long lost interest in the whole thing four years into AP etc.
     
    As to whether the pictures being staged is proof of a fake marriage, I disagree. Many genuine couples who don't naturally take many pictures together sometimes stage pictures for immigration purposes. That said, I think some of his answers to the questions hint at too much coaching, e.g. what my work office looks like , outside my house, where I park, my income are questions I do not expect an international spouse to know.
     
    I don't think there is much more anyone can tell you. After four years of frustration, you need to change tactics and it appears relocating temporarily to Pakistan for a period of six months or so is the only viable trump card. It is not as impossible as it sounds although not everyone can swing it. If you can work remotely, that would be very helpful.

    So you meet in 2016 and married September 2017. How many times have you been there? You say you have a small child is that from this marriage or previous?
    I think alot of this is lack of time together. You say you can't move because you have a small child, that's why I asked is he the father because why wouldn't your want the father to be there with his child.
    Also how in the world did they know you filed for bankruptcy/ Looking at the NOIR letter posted seems there was a real lack of vetting your evidence. You should know no matter the country it never is in a woman's favor to show she buys gifts for him and not the other way around. It seems to them maybe a Visa is being bought.
     
    If you decide to refile after a very long time together and a couple of visits. Use some quality evidence. Pictures should always be spontaneous not staged.
     
    And a appeal is futile. Appeals means you can show that USCIS made a mistake. What they have done is revoked (took back the original approval of the petition)
    This is very hard to overcome. Not impossible. I believe immigration is challenging you to get some strong evidence by priority 1 seeing each other in person and spending time together.

    sorry but an appeal at this point is more than likely useless as you can not offer proofs of the inconsistencies 
    impossible to prove what a person is thinking
     
    a lawyer, yeah,  one would take your money
    but be able to get the visa for him,  ????  questionable as a lawyer can't prove what a person thinks to appeal this decision
     
    if the CO asked all the questions you posted saying he knew your family and birthday and such,  he suspected the relationship 
     
    your only recourse is to spend quality time together if you want to continue with the process and reapply 
    just for your information,  reapplying still does not insure success

    Also, not an expert but hiding bars vertically rather than a few horizontal swipes is probably the best way to blur a bar code

    there are plenty of bona fide relationships that are light on evidence... making your response totally uncalled for and extremely cold..
     
    All of the points mentioned in the letter from USCIS apply to my case also, does that make my marriage BS too?
     
    Family must actually attend the wedding???? Seriously? My husbands family lives in the US... mine lives in the UK and I live in Australia where we got married does that mean our marriage is BS?

    Hello all I just Received a NOIR in the mail for my husbands Cr-1 after being in AP for 2 years. Would appreciate any advice from others on responding and if anyone has used a lawyer for this? Or is it best just to do on my own???

    You have a limited # of days to submit ACTUAL  proof showing that the reasons for the NOIR is wrong
    If you have ACTUAL proof and not just statements , you can respond to the NOIR
    it may be helpful  to read the following online site done by NOLO law
    Many of us have had to deal with a NOIR or NOID
    but even if you refile the I 130,  you have to respond to the issues brought up in the NOIR statement

    This is absolutely a waste of time. No one can escalte the f*cking process. The more you try, the more time it will take. The whole point of 221g is to f*uck with people's emotions and minds. Screw that background check garbage excuse. You don't need 6 months to check someone's bg. let alone 1 or more years.
    Some of the VOs are understanding and kind while others are simple-minded bitches who give a visa for people they shouldn't and put people who have a very valid reason to deserve it on hold.
    It all depends on your luck with these VOs. Screw their corrupted process, go live your life and be happy!

    That was exactly my point. You misunderstand the reason behind why i asked those questions. 
     
    At the same time, if anyone wants to share then they should have every right because this is a support group. But making judgements without any evidence or knowledge is unreasonable and just cruel. We are here to give each other hope and most importantly share our struggle so we feel comfort in the fact that this sh*** isnt just happening to me alone but there are in fact thousands out there who are in a similar if not a worse position. People who've been separated from their family members far longer...We should pray for each other and continue to give each other hope. And celebrate when one of us succeeds.

    Good point!!!! We here just to share our experience with each other, not to judge or investigate any one. but to support each other on this very long process that resulted in our families separations.

    Hello,
    My divorce was also In California. When I first applied for my Husband I only sent the Judgment page also and it was accepted by USCIS, but when we got to the NVC stage I only uploaded this again, but they sent me an email asking for the full decree (which was 16 pages) once I uploaded all pages it was accepted. Did not get anything certified just sent the judgment and decree. Also for his interview he took my original copy with him.
