Hobidyali reacted to 2018JNJ in K1 Fiance' Not Stay
After much time and money, my fiance came to USA 2 weeks ago.
She stepped off the plane saying she want go right back home.
She never try to adjust here..she miss home too much.

So my question, how long after she returns home, in a day or so, can I petition someone else?
I don't have anyone in mind at the moment.  Is it 2 years after first K1 approval?
    How does the waiver work?

Or would it be better to go the CR-1 route?
Does the 2 year wait apply there as well.

Just trying to see what my options are.

    Duffy probably knows..

    Thanks.

Life imitating art. This was a plot point in the tv series, The Americans.

OP, good luck at your infopass interview.

And we keep saying how people will lie about anything to get into the US and people still don't believe it happens.

    1) Limit unsupervised contact. You don't want him to even try to claim abuse. Somebody who deceives and lies like described is probably willing to do anything to get what they want.
    2) Contact USCIS to withdraw your I-864. No I-864 = AOS cannot be approved. This will need to be in written form, or you can schedule an InfoPass appointment to do so in person.
    3) No show at the interview = they won't approve AOS. You could appear, withdraw the I-864, and explain the situation there but it seems like an intense situation may develop.
    4) Material misrepresentation on an immigration form is a permanent bar. If you have evidence of any of the false information submitted, you can submit that as well. It won't hurt to submit evidence of the divorce as well.
    5) Bigamy is a crime.

    form itself is the 221g

221G Yellow Form : A 221g Yellow form is given for General administrative processing. They just want make sure that all documents provided by you and the employer are genuine.

This site best describes the 221g forms and colors and what they are used for

so, relax and do the wait and hopefully it won't be too long to get your visa

Please, when you receive notice from embassy,  write a review
We encourage to do this (approved or denied) as it helps others /no one can comment on the review site so no negative writeups will be there
allah yessir    good luck in iife in the US

I wouldnt put the pictures in loose, I would either put them in a ziplock bag, I opted for those photo things, either way doesn't matter, so long as it is easy for them to go through and scan things easily, they tear it all apart anyway.

The way you did it is the same way I did, I added our passport photos in a ziplock bag in the front and the pictures in photo dividers. Good luck.

even stated that in  the letter from court "said the reason did not support a good reason to deny"  but they still made me do new application
and my letter stated to submit a copy of it with new application

    it can be appealed
as i said above "i appealed and won my case"
but the appeal to the Immigation court of Appeals took over a year
and my letter back said "marriage is declared bona fida ,  reapply
so  i just could have applied and addressed the issue of "him not knowing what books i read "  in the new interview

Getting married won't solve the reason for denial. The OP needs to find out the reason for the denial, resolve that and then figure where to go from there. Getting married and reapplying for a cr-1 will not fix the reason for the denial. it will only lead to a second denial.

No one got trolled. I’ve already reached out to the moderators day before yesterday. If any of you guys have been following the original post you’ll understand I had a friend  stay with me after finding out her fiancé had other motives. Thats the short of it.  I put her on Visa Journey   so you all can better help her get answers. She stayed with me for five days as some of you who know being it was direct more than a tough time for her. She left home several days ago but she was the last one logged on visa  journey. Unfortunately and unbeknownst to me here I am posting away on my thread and other thread under her profile. Thats all there is to it @TBoneTX is aware as I reached out to directly first to help fix this so him and captain are aware. Thats all - no trolling.

Well, technically, making this thread is "continuing a conversation" about a locked thread...but, hey, nothing we can do about it.
I'm pretty certain this thread will be locked soon, too.

In the out-reaching arms of the VJ TOS, even referring to a locked thread (as noted in the original post with the thread title) can sometimes have the Mods unleash all sorts of fury, fire and brimstone.

(well, ok, perhaps not the fire and brimstone part----tar and feathers, maybe?)

    I should have added
there are a lot of comments here and a lot of good advise

but no one here is saying "don't quit"
most of Americans came from other countries / i have one Iroquois Indian (that is a US tribe ) grandparent,  the other 3 came from Finland, Germany and UK
I wouldn't be me if they hadn't immigrated
    this is the American dream
    nothing wrong with it
nothing wrong with marring an American if you have found the right person
long road ahead if you follow thru with the process
a visa is never guaranteed  it is a privilege
if you are granted a visa,  thru marriage,  honor your wife and the US
and work hard here to have the "american dream" make your life what you hope it can be

For Casa and your personal issues this is what is needed:   and i do know as we went thru this

CO will need to see sincerity,  he/ she knows you 2 want to be to together in the USA but that is now / they need to see a furture with you 2 together.
CO needs to see serious intention / they are quite serious about giving out visas in Casa embassy ,  so you need to be completely serious about all things
CO needs to see a level of trust between the 2 of you

    Now to do all this:
needs multiple visits with quality time spent / not just   a vacation or holiday but time for the USC to know you and your family,  your culture and your religion .   you may be coming here but a lot of Morocco culture will come with you .   i grow moroccan mint that Adil bought here .  We have a tanjine pot .  We fast.  these things will be important for you to feel comfortable here.  she will have to be able to adapt to you and you to her and the US. it is not easy sometimes.
Seriousness is shown  not just thru marriage but by going the distance to go thru these heartbreaking times and stay together and marry and do the multiple trips.   If she can't afford it,  then she can't afford the immigration process.  It is not easy.  It is not fast.   It is not cheap.
Trust is shown in many ways .   Sharing all things but for Casa, it is commingling of finances after marriage.   If you are able to marry in 2019 ,  she will have to add you to tax returns for 2019 next spring /  this will be in time for any interview you have for a spouse visa.
You are looking at over a year to marry,   apply and show good intentions at an interview.

Don't give up but work on this
Americans are known for working hard so adapt now to that by doing all you can do to make this work

Yeah Visa issued this morning: Thank you all and the best of luck to everyone. They have not called her yet but system updated to issued this morning.
Basically in my case approximately 3 months. It sounds to me that the consulate of Morocco are backed up where it comes to AP status.
She sent the passport on January 21 got the visa issued April 17 today
Keep emailing and inquiring after 2 months. It seems to me that a letter from a senator or congressman is key. My senator sent them a letter 3-4 weeks ago along with letters I sent.
Again best of luck to everyone I hope they call her tomorrow to pick up her passport and paperwork
