    This applies in all non immigrant entries, ESTA, B visas, etc,  whether there is an I103 filed or not.
    Very untrue. People denied entry are still eligible for immigrant visas.
     
    Length of stay is determined at the POE.  Coming and going like that makes it look like you are trying to live here.   Make sure you spend plenty of time outside the US.
     
    Not needed.   You case is pretty simple.  You have ESTA, no criminal history and no sponsorship issues.  Ironically using an attorney often makes the process slower, they make errors and you end up supplying everything to them that you could have entered on the forms for free.

    You are the train with unlimited seats.     There is no waiting for a visa to become available for you.   Once the USCIS is done with your petition it goes straight to the NVC.

    No, let's try math again.   Let's say his visa is approved on July 1.   He would need to be in the US 6 months later (6 months from medical technically)  and all of the other derivatives would need to be in the US by June 30, 2021.
     
    Is the second batch of kids old enough to leave and fly alone?

    You need to be careful on the timing of the second group of kids.  The kids have to be in the US within the year that the K1 visa is issued.   Depending on the age of the kids and the requirements for them to travel alone, the beneficiary may have to travel with them.  Time to get married, copy of the birth certificate, and get the AP needs to be remembered in the process.

    Correct he can apply.
    He would need to show strong ties to UAE.   Not easy for someone to do as a third country national.   $160 and a petition filed it all you need to do to find out.

    Police certificates are requested by the consulate / Department of State.  CBP is going to check that you have a valid Visa.

    sorry if I sound stupid but as far as tax I’ve not lived in the US for 19 years I’ve been paying my taxes in the U.K. as a British citizen ..I’ve only just started working back in the us this year .

    Don't sign an I-407 if they ask you to.   That indicates you have voluntarily surrendered it.  Ask for a hearing.

    He can try to enter on the expired green card.   There was a lady recently on here who was able to get in without and issue.   That should have been a rare case.   If there is an issue with CBP he can ask to go before an immigration judge and then he would be paroled into the country.  Don't surrender the green card at the POE.
     
    The other options is to apply for the SB-1 which can be hard to obtain.

    Yes, but being on a tourist visa does not affect domicile the way being on a resident visa does.   A tourist is going to maintain stronger ties back to the US, keeping his housing, insurance, etc.
     
    Petitioner is going to have assets at NVC with the I-864.

    Affidavits are used when you have nothing else to submit.  Based on what you have you don't nrrd them.
