    A k1 is not a v series visa.
     
    If you filed the AOS prior to the medical expiring then you do not need a new medical as long as it is marked complete.

    CSC rarely processes CR1s.  If you file the I-130 your case can be moved from center to center.  Think of adjudication like a checkout line at a grocery store.  Some lines move faster.  Sometimes the shortest line has an issue.  Every I-130 is different as it is based on the two parties and the particulares.  We didn't even consider the US initially for residency when we got married. We moved to Mexico.  Then life happened and there were fortunate circumstances and we got here super fast.
     
    If you withdraw the I-129F and file for the spousal make sure your petition is complete and accurate.

    We married after just less than a year of dating. We had our consulate interview after being married just short of 7 months. Fast forward and Mary has her citizenship interview in 2 weeks.  Spending time together before filing is very helpful. The more time together the better.  Our time together, and travel together, was brought up at the interview but really just as a way of verifying that we in a bonafide relationship.

    @GarLeb, Dont miss the forest from the trees.  Too many believe the goal is just being together.  That may or may not be doing a disservice to both of you.  Take a step back and look at what YOU really believe is your priority.  WE can't answer that for you and there is no wrong answer.  If the year of no work and not being able to return from an international trip are not a concern, stick with the already filed K-1.  There is nothing wrong with that.If your goal is to be settled quicker with the beneficiary able to work and travel internationally, the timelines really dont matter.  Spousal will always beat K-1 to the green card.  This is really a decision the two of you need to make together.  Once you make it, DON'T LOOK BACK!  You will drive yourself crazy with "what ifs".  Make your decision and stick to it.  Both will get you to the same place.
     
    One last comment, don't focus so much on the process.  Focus on why you are doing this process.  It is long but it isn't difficult unless you make it that way.  The love is where your focus should be.  It will make this journey a little easier.

    File a CRBA for the children at the consulate.  They will be handled in Australia.  File the I-130 for your wife either online or by mail to the US . . . and wait.  You will need to figure out what you need to do for sponsorship and what you are going to do in the US.

    No problem.  You can remain a student under F1.  There is no immigration need to adjust.   It can affect benefits, like insurance, and taxes tho. 
    If you are starting a bachelors program, 4 years, that is enough time to AOS, ROC and file for citizenship which may be of benefit to you.
     
    Of course entering the US under F1 with the intent to AOS is fraud. So the above only works if you re already in the US.

    That is the whole purpose of the Extension Letter.   Make sure you keep the trip quick incase your end up scheduled for something.
     
    Hopefully nothing gets scheduled and you can take care of your family.

    So USCIS approved the petition initially (they are verifying that the petition and beneficiary appear to be eligible for the immigration benefit).  The consulate eventually denied the visa.  The petition was returned to, and reviewed by USCIS (something a K1 isn't eligible for).  The petitioner wasn't able to address the issues in the NOIR and have the petition sent back to the consulate.  There doesn't appear to be anything that USCIS err in but that doesn't stop an appeal from taking place.  It doesn't sound like the petitioner wants to live in Pakistan and build up a better case and refile. Regardless, it will cost more money and time - which the petitioner should use to strengthen her case by spending more time with her husband.

    There is no deadline to file .   But you are out of legal status until filed.  Yes people have taken months and even years to file AOS.  Again being here without legal status.
     
    If you got married on 2/23 you didn't have to have the 1099 to file until after 4/15.
     
    Your case is evidence of what can happen.  I'm sorry for your experience.

    We entered on a sunday and were back on the Mexican beach friday.   There are people who enter just to activate the physical green card process and then return to their home country to wrap up things.

    Thank you! I sent them an email and they accepted my exceptional circumstance. I just sent the i 130 and the rest of the supporting documents yesterday. If that gets approved do you think I can go back or do I need to stay still? I know there are other packages that need to be sent, but my husband can obviously do that if I'm already gone I thought?

    Did he not keep in contact with the consulate?  Check in CEAC and if the petition is still at the consulate file a new DS260.  If the petition has been returned to USCIS then you need to do an I-824 to get it sent back to the consulate.

    IOE is online and anything scanned.  So the Service Center is not part of the receipt number.
    They are two separate petitions.
    When they get to the NVC you can ask to schedule them together.

    They are supposed to and usually do (for K1 and CR1/IR1)
