Just Paul got a reaction from Crazy Cat in IR1 Process Query
Only available under "exceptional circumstances". See the consulate website for details.
Your wife is always the primary sponsor. Her Aunt can be a joint sponsor.
You can work on the first day. You will need to get a social security number if you want to get paid.
That is a good range to use. Not much to do to speed things up. In part it is based on whether you get assigned to a fast service center or a slow one.
Your wife will also need to re-establish US domicile before the visa is issued or show that she will do so when you enter the US. She will also need to be current on her US tax reporting.

Just the person with the VISA needs to enter the US and can turn right around and leave. That will use the visa and get you an I-551 stamp good for a year,

Just Paul got a reaction from TBoneTX in I-129F for Russian fiance, questions about her interview
If you update your profile to include russia, you would have quick access to the Russia Portal.
In the meantime https://www.visajourney.com/portals/index.php?country=Russia under quicklinks hit the Consulate Reviews.
Typically the interview can be in the local language plus english.

I’m not wasting my time repeating stuff you willfully ignore anymore, please feel free to come back and update the thread when all these reports of existing green card holders being denied entry start rolling in as you expect.

You can enter the US and activate your green card anytime before it expires. Then you can return to Canada and do your move.

Just Paul got a reaction from DanMeirian in Bringing fiance's kids
If you didn't get K2 visas for them you have 1 year from the date of her interview to have them in the US as follow to join. After that requires a CR2 for each of them.

You won't get those back and won't need them later in the process.
As for the marriage certificate, if you dint being a copy then don't expect it back There is a form to use to try to get that back. You don't have other copies of the marriage certificate?

Just Paul got a reaction from Boiler in Need Advise. Please help.
For Vietnam I don't think that having your parents there is major deal. In most counties it isn't an issue. Plenty of people do just a court wedding. What is important, at the petition stage, is that you have proof of the trip with passport stamps and boarding passes and a marriage certificate. Photos are secondary evidence. Affidavits are the worst evidence. Add your spouse as a beneficiary to your life insurance, add them to you checking account, co-mingle finances as you can.

You might have to consider re-locating to Mexico for the next year or so.......many people don't realize just how serious drug use is to US immigration officials.

Just Paul got a reaction from kimme79 in USC being threatned with VAWA.
She won't need you for ROC/ 10 year green card. She can file that on her own with a Divorce Waiver. In fact if she was divorced from you she can get the 10 year card without waiting for the 2nd year. Use that to "negotiate" with her and get this over with.

Just Paul got a reaction from SusieQQQ in Supreme Court allows Trump administration to move forward with 'public charge' rule (merged)
They have always been denying based on public charge i.e. the totality of the circumstances. Now there is an official form to help.
He should take the DS-5540 form with him and an updated I-864 too if there were any changes since the NVC.

Just Paul got a reaction from *Rachel* in Married within K1 - do I need to file I-130?
You married in the 90 days. That is 99.999999% of the battle, well other then the I-864. The I-131(not every section applies) and I-765 are pretty easy and the I-944 has a bunch of questions that most K1s won't have an answer for. Toss in the G-1145 for each and review the checklist at the end of each instructions and you will be fine.

Just Paul got a reaction from *Rachel* in Married within K1 - do I need to file I-130?
A very high number of people marry late in the 90 days and have to wait for the marriage certificate to be recorded and therefore have no status. Most K1 simply leave it blank or write in none. The I-485 form, like many others (see I-131), is used for multiple types of Adjustment of Status. Not every question applies to every circumstance.
When I help out at the immigration clinic I put the current status in as it applies: F1(student), B2, K1, TN, etc or none.

Just Paul got a reaction from pushbrk in A few questions about filing form I-130
Not knowing the country where you are interviewing and if there are any red flags gets you the following stock answers. You can update your profile to include the country to get better answers quicker. I have to read down the 5 question to find out it is Vietnam.
There is no way that a petition of several hundreds or color copies needed. Quality over quantity. A few photos reduced to a 8 to 12 on a page is all that is needed. If you include chat logs only a few pages are needed and can be printer from 2 or 4 reduced pages on one page.
If you file online there is a limit to each pdf upload.
Yes
read the instructions and follow them literally.
What do the instructions say?
Again, hundreds of pages, does not equal quality. Upload the best evidence. You aren't going to be able to upload all that in one PDF. And no one will be anxious to scan in or read a large box representing a case.
If it can't fit into a USPS priority letter envelope or a padded envelope, you are probably sending in too much. I looked at ours and it was 30 pages long but front loaded as we were filing directly at the consulate (at UCSIS office) and had documents from 4 countries.
