    William&Emily got a reaction from Sarge21555 in December 2019 - AOS Filers
    Hi,
My case has that I'm ready to be scheduled for an interview for the AOS. And fingerprints taken for the EAD and AP.
Does anyone know if there's an in between stage for EAD before they update to send the card? I can see many people's cases are pushing forward throughout the covid stuff which is promising

From “ fingerprints”, I received the following notices ( online )

    * new card is being produced
    * case was approved
    * card was mailed to me
——- now I’m waiting for “ card was picked up by USPS”  😊🙏🤞And “ card was delivered to me by USPS“

it’s so good to see a lot of EAD and AP approvals 😊

No. He paid into it so he can use it. Not public charge consideration.

Unemployment compensation is not a public charge issue. No worries there.

His ability to be your sponsor, if still unemployed, obviously can be impacted. But unless you get an RFE/RFIE for the I-864, that's likely not a worry for quite some time (and only if the IO wants to see a new I-864).

Usually RFEs worded that way means that your 2018 tax return submission did not include all the elements to be considered “complete”.  Complete would be a photocopy of every page of every Form and Schedule in the return PLUS the corresponding W2 or 1099 showing the wages.  If you will get the 2018 transcript from the IRS, then you don’t have to worry if you had all the right pages and W2 statements.  The transcript is complete by itself.

2019 taxes are not due yet so the USCIS can not require them.  If you have filed already, you can put together a 2019 “complete tax return”—-all forms, schedules, and W2s/1099s.

    Do not send:
a tax return without the W2. a W2 without a tax return. Both of those would be considered incomplete and would get an RFE.

A couple of people in the December 2019 AOS thread received a RFE for the most recent return/ transcript though that they had sent the 2018 one. Something weird is going on at USCIS 🤷‍♀️

Yes, and the transcripts are preferred.

Filed our AOS, EAD & AP today!

Honestly,  I'm kinda happy to be just filing and waiting for a bit. 😀 All the last parts of k1 were a whirlwind for us.

    Hi everyone
Just for anyone who finds this and has the same issue.
Firstly my package was intercepted so it's being returned to me however...
I called first thing on Monday morning and they reassured me the best thing to do, once you get your receipt of acceptance that they have it, use the number and location on that to send a letter with the correction on and it will be easily rectified

(a)(6) is for an EAD based on K-1 status. It requires the fee and expires at the end of the 90 days of legal status from POE.
If they already deposited the payment, then there is nothing to do now. They will put the application in line for processing. When it reaches or surpasses 90 days and they get to it, they should deny the application. It is currently taking ~4-7 months for processing.
If they did not deposit the payment, then you can try to cancel it and recover that, minus possibly a fee (both for doing it and from USCIS).

When you file for an EAD alongside or otherwise due to an AOS application  that fall sunder (c)(9) and no additional fee is paid.

If you provided payment for the I-765 with the I-485 payment in one packet, they may reject the entire packet due to incorrect payment.

So we sent all our adjustment stuff today! Yey (kinda)
Then I was looking around just randomly and found this "BE SURE TO USE CODE (C)(9) FOR A 1-YEAR EAD CARD (when filing concurrently with I-485)!!!"
I used a different code since on the instructions it says to only use that code: "If you have a pending application for adjustment of status, you should file under category (c)(9)"
I used the code a6 which I assume is similar since on the instructions it uses that code next to the K1 section because I figured pending application meant I have already sent one out.,
Will this cause any issues you think or will I be ok?
    Thank you!

They're probably gonna reject your EAD form and return it to you. You will need to resubmit it with the correct category.

I got engaged in September but my fiance is in Pakistan. His mom and other family were here in USA and she put the ring on me. I am going to go visit him in January.  Should I apply for the Fiance Visa? Or is it just safer and more guarantee to get the Spouse Visa from a country like Pakistan? I would obviously marry him when in Pakistan but I want to know which Visa is better for Pakistan... Fiance or Spouse?

Are Pakistani people getting approved for fiance visas without much problem and how long is taking them??

Appreciate any kind of help. Thanks!

William&Emily reacted to jaysaldi in What if i don't get the recorded marriage certificate back before the 90 day K1 fiance visa expires?
I am getting married next week and just learned that it may take weeks to get the recorded marriage certificate mailed to me.  This will put us beyond the 90 days. The officiant says he can take a photo of what he files at the courthouse (is that a file stamped non-recorded marriage certificate or something else)? But I am worried that it won't be sufficient to adjust status.

    What should I do?

    1. File for AoS before the 90 days expires with the photo of documentation he sends me and possibly/probably get an RFE?
    2.  Wait beyond the ninety days and file for AoS?
    3. File for AoS within and then supplement that filing in a few weeks with a nice copy of the recorded marriage certificate?

Also, after we file for AoS, what paperwork should my fiancee carry with her to prove she is in the country legally?

    Thanks

I called and spoke to the head of CBP at my POE airport. He said write "household goods" with no valuation. If you have any new things like we did (tea bags, cheese, candy, gifts) then itemize those with a value.

General tip: If you have a choice of lines, always pick Immigrant. Usually the shorter line. The Immigrant Visa Unit is conducting your interview even though you Visa will be non-immigrant.

When you get in line outside, your interview confirmation shows you have an appointment and have your passport handy. Security booth may ask for same.

Inside reception desk person will want to see your interview confirmation again and will put stickers with you number for the day...like an Argos ticket that they will call out when your time comes.

You turn in all documentation at the first window called to. That is a document collector/organizer. That is not the interview ---confirmation, passport, birth certificate,  police certificate, passport photo, I-134, etc. No photocopies of anything are needed. No relationship stuff or anything from the petition.

That's it for turning in things. Second window called is the interview. They just take your fingerprints. They don't want to see any proof of relationship in London. No trips, no engagement, no photos.

Sorry if I’m repeating anything already posted, it’s late, so not read through everything.

He doesn’t need to go to his original childhood doctor. He can join any local NHS GP and they will be able to access his medical records and print him off a healthcare summary. He would likely need to go to a ‘new patient appointment’, where he’d be weighed, asked some questions (do you smoke, how much alcohol do you drink, etc) and have a blood pressure test. That’s it. However, I think for your full records to transfer over, including vaccination history, it can take 2-4 weeks on average.
