thatguyuknow reacted to Penguin_ie in Negative attitudes in the forum
I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.

First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered.   While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards  those fortunate to have their case dealt with quickly, or  critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!

Secondly- in the info forums, you may get bad news.  When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed.  However, the emphasis is still on being welcoming and friendly.  If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive.  No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or  illegal actions in the past- instead, encourage and explain legal options for the future.  And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.

Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums.  But if you feel that way, just scroll past- no need to criticise the OP for asking the question.

Thought I would post an update

    1. Tried to walk into a USCIS office - No dice. Spoke to a really nice security agent (I know if she could've helped me she would have) - She said there was no one physically there to see me/refer me to.
    2. Called USCIS again to pled my case, spoke to a really helpful agent. Turns out they posted me the 24 month extension letter on Tuesday!!! Signed up for informed delivery and got it yesterday. What a stoke of luck! It was meant to be I suppose. (Why they wouldn't just tell me this and have me go through the infopass nonsense I dont know)

Well thats the end of that. Thanks everyone

You need an emergency Infopass appointment for an ADIT stamp.  In September, my wife had a stamp within 24 hours after I called them.  But, your time is short.
    1.  Yes, you can leave.  No one processes through immigration when leaving the US.
    2.  Maybe.....If the airlines will let you board the flight back to the US.
    3.  USCIS issues ADIT stamps, not DOS.
    4.  Try to get an EMERGENCY infopass appointment.

There is no USCIS office in London. The embassy is Dept of State. They have no authority to stamp passports.

If you have an expired greencard and a photocopy of your extension letter, you ought to be able to talk your way onboard the plane. Tell them you only carry a photocopy so you don’t lose the original. Arriving in the US, the immigration people can look up your record if needed to verify your extension.

Meh, it is what it is. Some people are just evil. Worst part was it wasn't just one person but 3 randoms, also one was married with 2 kids, so there is that.

Honestly this forum is incredible. I honestly can't thank you guys enough.

You can change from a joint petition to a divorce waiver at the interview. You might have the divorce decree by then.

You could write to them now......but they might issue an RFE NOW.  That would give you only a limited time to submit the divorce decree.  Waiting until your interview will give you more time.  Just an idea.

I'm not an expert in the area of divorce waivers.  Hopefully, more experienced members can chime in.  Personally, my wife's case is at MSC.  We filed her I-751 in March 2019.  We are still waiting for an interview....😒.  Since she entered via a CR-1, we WILL get an interview.

I agree.  It seems to me that waiting until the interviews to declare a change to a divorce waiver gives @thatguyuknow more flexibility.....

    Yes, no, maybe.
In the eyes of USCIS there is married or divorced - no separated so until you notify them, it is still a joint filing.

The timing here is tricky because you have already filed.
The problem is that if you tell them now, they may RFE you for the final decree immediately, or it may take time.
If they do so immediately and, say divorce take a year in your state, then you have problems as you can't provide it in time.

There is no guarantee you will get an interview as your current filing is joint, and consequently you may also get approved before notifying them, which has its own set of potential problems further down the line as you correctly note.

You are best off waiting until after filing for divorce and before the divorce is final, but when you know it will be final in a few months, and writing to them then to notify them then. That way if an RFE comes quickly you can provide it.

No. Accepted policy is to switch from a joint to solo filing in the event of divorce. No refiling or fee required.

If at interview you requested a switch, they would RFE you. Standard response time for an RFE is 90 days but can be less.
If you cant provide it when RFE'd, then yes, you would get a denial.
You could then go to court and provide the decree to the judge, or you could refile.
This is why the timing is tricky for you...but that is a whole different scenario of what ifs or maybes, that you are a long way from, so don't stress about it for now.

Divorce is not a reason for denial. A bitter spouse talking (removed) may well lead to one (take me as a perfect example that this can happen).
Unlike a joint filing where the spouse MUST attend, your former spouse does not have to attend any interview if you have switched or are switching to a divorce waiver. You are welcome to bring them along if they will support your case and aren't malicious, but it is not a requirement at all.

Random thread, but I wanted to raise it with people that would understand.

Today while in Walmart I had a craving for beans on toast. So I bought English muffins and a tin of Bush’s beans. I got the vegetarian ones because I thought they’d be like what I was used to.

Oh my! Those Bush’s beans transported me back to my childhood. You remember when Heinz beans were good? Before they removed all the salt and the sugar. I experienced something special today.

I just wanted to share my experience, what an amazing day it has been. I can’t get those beans out my head.

God bless America, land of the beans.

If you’ve worked all your life it’s going to be hard. I was idle for 5 months over the summer last year and was practically pulling the walls down. Did a lot of cooking, fishing,  swimming and bought a bike, things I never had time for before.

I was lucky, I’m really close with my in-laws and they are so kind to me. I just did what they did and followed along. They would regularly pick me up to do stuff when my partner was at work. Even my partners grandfather would pick me up and we’d go mootchin around loving life. Maybe try and get in with your in-laws?

When  you do get a job and you like it, boy does it feel good. I’ve been at my  job since aug 19 and already been promoted. Working here is so much better than the uk. Geez, I used to struggle to go to work when I worked in the uk, everyone is so miserable at work, it would bring me down.

You  have some  big, exciting things coming! This covid business does suck but that’ll pass. If you want maybe apply for some remote work jobs?
