If the check has been cashed by USCIS, then they have accepted your petition and have started processing on it (this takes 6.5 - 7.5 months currently). They are processing it, if they had already rejected your application you would have received a rejection notice via mail. I have no idea about this, I don't think that's entirely accurate. Their website states that the USCIS Adjudicator can deny it without asking for more evidence, but for an Alien Fiancé visa I doubt they would do this. I may be wrong, but I think some people have recently posted about a RFE. You wouldn't get an RFE this early anyway, so this is definitely not the issue.
In the mean time, check the details on your application are correct. Check the mailing address you supplied for the USC.

Just as a tip, if your fiancé isn't going to be in the country when you mail the paperwork (I wasn't when my partner mailed ours in), leave all that blank. They want to see if you have overstayed.

It's also worth reading the instruction booklet provided too (https://www.uscis.gov/system/files_force/files/form/i-129finstr.pdf?download=1), this does go over how to fill in each section correctly.

It's worth noting that it's unlikely it'll be picked up until 6-7 months from now anyway, your fiancé might not be in the country right now, but they could be when they actually look at your file.

I wouldn't stress. Just leave it blank.

    Hello everyone,

In case you haven't notice yet, processing times have gone back from 5.5 - 7.5 months to 5 - 7 as it was when I filed back in april. Good news for new filers.

I can only assume you will have questions as you go along. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline or your Embassy it's hard for us to give you a factual answer. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine your Embassy. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile.

So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Go to the top right of this page select your name (it's on the upper right-hand corner)>my profile>[below your picture on the right column] edit my profile. Scroll to the bottom and fill in "Immigration Info". There now we can better serve you.

    Thanks

I have a feeling OP received an RFE due to only filling this in.

I think if you spend timing typing up a document and attaching it, scanning passports and travel stamps, you should be fine. All they want is proof you are a real couple and have met.

The only requirement is that you are free to marry when you submit the I-129F.

edit: This also says he visited on Dec 4th to Dec 21st of 2018. Unless you're a time traveller, this hasn't happened yet lol - this may be a reason you were flagged.

Glad to see I'm fairly similar to you - we have countless trips between the UK and US, any common sense should see that we are a real couple. Who has the time to visit the UK and spend 2-3 months away from their apparent husband without him being concerned? lol

We're in the same boat as you there, except for the age. We have an age gap, but it's only 12 years so I see this coming up at my interview.

It'll be interesting to see if you receive an RFE. My only issue with this whole thing is, what are we supposed to prove? At the end of the day, you are divorced at the time of filing and you are legally able to marry. A lot of people are in new relationships before a divorce is finalised.

I just really am not sure what "evidence" you can provide for this.

Eek, guess it is what it is then.
I think sadly, a lot of it is down to whether they suspect fraud. Certain embassies likely flag for stuff more than others.

Thank you for the quick reply.

Your NOA1 date is the same date you got the text, or a day after the tracking says it got to Dallas. (normally).
Getting a text message just means they have received it. A RFE can come at any time. Usually closer to the end of the 5.5 - 7.5 month spell.

Ask the USC petitioner to call them. If you’re an October filer, it’s too soon to be calling the NVC.

We sent the full 3 page document we received. It has around 30 points about how everything would be divided, who's responsible for what, etc. as well as being stamped and signed.

It doesn’t really matter where your partner lives. It’ll take around 5.5-7.5 months to get your NOA2. NOA1 times are averaging around a week.

its gonna be a long process. Just enjoy it

Absolutely wait if you chose to file a K-1 Visa. You have to show proof you have met within the last 2 years.

If you decide to go down the CR1 route, that is also fine. My suggestion would be to meet and actually date and then file for a K-1. Being engaged without meeting your SO is going to be a huge red flag.
