i honestly have a child with this man and we just do not get along. I do not want to ruin his life but do not want to be his sponsor because he is very irresponsible. This is so difficult.

I do agree that the whole thing with children/ stepchildren is confusing with USCIS. I have been there with my AOS. I am the beneficiary, husband is my sponsor. I myself don’t have kids, but hubby has one from a previous relationship. So when I filled out my I-485, I put “no” to the question if I have children, because I thought they meant bio kids. Our interview got waived, approved and everything but the other day I was thinking about it. I called Hacking and his colleagues told me that for USCIS, stepchildren and bio children are all the same. So now, when I do my ROC, I have to put my stepson, even though he’s not applying with me. I was also looking at the N400 and this is the only form that mentions “stepchildren”. So it is VERY misleading!

So therefore I am stuck with being his sponsor for the next 10 years unless he decides to change it. He has every right now but I have no rights in this as an american citizen.

I wouldn't worry about it. The govt won't come after you telling to feed him or to give him money or recuperate money if he uses any benefits. It can but it won't.
You worry about divorce terms if you are heading there.

Dear Group,
I write with a very heavy heart. My beloved wife came to the US on a K-1 visa in June 2020. We married immediately and filed the whole I-485 packet including all the supporting forms and received the NOAs for all. While waiting for the AOS interview, she died from covid and that has pretty much destroyed my life. I called the USCIS hotline for advice on how best to withdraw the application, but they seemed very befuddled and recommended that I file form I-140 (which has nothing do with withdrawing a petition -- completely wrong) with the center that is handling my case. They gave me an address based on my zip code, but I'm questioning if that's correct based on their recommendation of an incorrect form.
I just got notice yesterday that the AOS interview has been scheduled and a notice has been sent out. Should I wait for this notice and then send a letter with a copy of the notice and death certificate to the address on the notice. That seems to make the most sense. Thank you for any advice. Normally I would be able to figure this stuff out on my own (we got this far . . .), but my brain is very muddled these days. My apologies.

June 17th filer here just saw our EAD status was updated on september 11th to card is being processed and our I 485 is ready for scheduling. This is quicker than i expected. God is good.

Hi! I'm glad to read this, I'm also in OK and I went to DMV and they told me exactly the same. They said they can't issue a drivers license or state ID on a K1, but I can drive on my foreign license in the meantime. I wasn't too convinced if that info was right because of what I've read on VJ but now that I know they told you the same I feel more confident about it. I guess it is just different on every state.

For k-1 visa holders is not needed because you already did a medical to enter the States. Now, if by the time you get your interview, it has been a year since your medical, you'll have to do it again. That's the only condition. I recently got my green card and I didn't have to do the medical again. You can also read the instructions of that form if you're still unsure.

Please have a doctor talk to your fiancé to make sure there are no chances of them developing a clot or have any cardiac issues. The doctors think my fiancé developed a clot during his flight. When I picked him up from the airport he complained of being exhausted, fatigued, stomach pains he thought from the airline food. He took something for the stomach pain and insisted that he just needed rest. He slept until about 3am and felt better and said the stomachache had gone. We talked for a while and planned the next day and went back to sleep. When he awoke the next morning he complained that maybe he had malaria because he felt really weak and his chest felt tight. I took him to the ER and his heart stopped moments after we arrived. He wasn’t here for a full day and he was gone. They were unable to revive him. The preliminary for autopsy revealed a clot had formed and had traveled to his heart.This is a nightmare and we are just devastated by his passing. All the time wasted in waiting for this process to end. All the plans we had made together and the life we wanted to share, just gone. I can’t let this happen to anyone else, so please please please make sure that you have your fiancé checked out thoroughly and educated about flight safety. I would have left everything here to be with him, but he wanted to ask my father for my hand in marriage. He was my world. I just thought you all should know if there’s a chance it could help someone else. It should really be a part of the P3 to educate first time flights

@Greenbaum I would like to thank you so much from the bottom of my heart for your assistance, diligence in responding in a timely manner, and always providing top quality (hilarious) responses. It has been over a year and a half going through this process for us with tons of bumps, mistakes and all out burst of tears. However, every time we got down we looked to a higher power and knew that things would work out according to plans. We were issued the visa today and my fiance can finally meet his 8 month old son for the first time and my heart is so heavy. I thank you to all of you who have posted and responded as I have sometimes just been behind the scenes reading others experiences and trying to keep my head above water.
Happy Valentines Day as this is the best Valentines I have ever had!!!!!

Hi everyone,
After a long K1 process my fiancé and I received the bad news a couple weeks ago that he has active tuberculosis and won't be permitted to travel to the US until he completes 6 months of supervised medical treatment and then re-takes the medical portion of the application and the sputum test (processing time is 2 months for this). So we're looking at an additional 8 months or more apart. 😥I have a few questions regarding the next steps and if anyone has been in this situation before or has insight into this kind of medical delay any help would be appreciated!
Our timeline went something like this:
Nov 2018: Fiancé has medical examination and the physician notices scarring on his chest x-ray and he takes the first sputum test for TB Dec 2018: Fiancé has interview in Johannesburg, South Africa and gets the news that our K1 visa has been approved! The embassy just needs his medical results before they give him his passport/visa Jan 2018: Fiancé finds out that he has active TB and won't be permitted to travel to the US as planned. He begins TB treatment immediately under the supervision of the original doctor who administered the medical exam.
Do we have to notify the Johannesburg consulate that my fiancé is actively doing the TB treatment? As soon as the clinic realized he had TB, they sent the results to the embassy. We were told this would put his case in a 'dormant' state and that as soon as treatment is completed he would be cleared for travel without issue. Is this correct? Do I need to worry about our case or any of our documents he provided at the interview expiring? Do we have to prepare ourselves to re-do any other portion of the visa process? I assume since he passed his interview prior to learning of his TB diagnosis and they "approved" his visa that all they need at this point is a clean bill of health 8 months from now?
If anyone has any information at all about what we should be preparing for in this situation please let me know. Most of my research of VisaJourney has turned up people getting diagnosed with TB prior to their interview, so I just want some assurance that as soon as he completes his medical treatment and is TB negative they will release his passport with the visa in it.

I got mine 3 days after my interview.. but I was obviously not put in AP.
Good Luck!! If the only thing "wrong" was the medical results you should be fine.. is just a little hiccup

Usually if they told you that you are approved and only waiting on medical and IF the medical is signed off on then 99% of the time you get your visa. There are very rare cases that someone gets denied after coming this far. If there anything wrong then they would have caught it at USCIS.

That is another issue. Could have been something out of the Embassy's hands. The results could have gotten lost or something. Remember, the Embassy is a separate entity of the health facility where the medical is performed. When a third party org is used then things can happen like delays or lost items.
