    My husband had to file for my mother in law in a similar situation as your mum. 
    For the health insurance question she wrote: "I do  not have health insurance, my two American citizen sons take care of my medical expenses. I plan on enrolling in an health insurance plan once I receive a Social Security number. "
     
    For the diplomas she does have some copies back home but we didnt have time with her I94 expiring and didnt want her to be out of status so we listed them without including copies.
     
    For the money part, we listed just her available balance from her checking, she got a copy of her bank statement and her retirement pension, Showing she is receiving monthly income. She owns her home but didnt have the paperwork with her so we didnt list it.
     
    You do not need to list yourself, remember we are talking about her household back home, she is not a PR yet so if she has to list whoever is living "officially" back home with her.
     
    Her file was accepted and we got copies of her receipt by mail.

    Thank you so much for your reply! I am thinking when the local field office reopen in June, I will use an infopass to pay a visit asking if any further notice regarding the RFE response will be issued or if my case has already been transferred to Texas center. Beside this, I guess the only thing I can do is to wait with patience.

    Thanks for the reply. Not expecting any interviews for a months even tho my PD is current, a few other issues.
    Hoping more for the dropping of employment based interviews for the next 6 months 😀

    Unemployment is not public assistance as it is funded by insurance payments made by employers. So this will not be a problem.

    Had my interview today and it went good. He didn't say if I was approved or not but when I got home my status had changed to "new card is being produced" 😁

    Oh really, sorry about that. I was in the exact same situation and they let me do it, I renewed my license with no issue for another 10 years.
    Maybe try to go to another DMV or speak with a supervisor

    Here is an update. On Nov 30th I was pleasantly surprised to find the 10 year Green Card in my mailbox. I was discussing with my wife about filing a status inquiry after collecting the mail. As I was going through the pile of mail and dumping out the trash (newsletters, coupons etc) I was surprised to see an of envelope from USCIS. I was expecting it to be the RFE. Opened the envelope, and it contained a letter saying my GC was approved. And then I saw another envelope, opened it and there was the GC.

    Thank you. Me as well. I am sure it will. There may be some back and forth but all of it will be solved online since I e-filed. Should be straight forward. I made a check list and checked it twice.

    UPDATE: 
     
    We had our court date and everything went super smoothly. We have a continued court hearing in July 2020. This courtdate will most likely get pushed and only be in communication with writing between the lawyer and I.
     
    The $1,500 investment in a lawyer was worth it. It just makes the entire process more straight forward. My wife got her Authorization to work through her Asylum application.
     
    Once the I-130 & I-130A gets approved we will file for I-485. The lawyer said we can wait until then to file because we must wait for I-130/I-130A is approved first.
     
    She was in removal preceding's during this court hearing in Jan 2020. The lawyer admitted to her 4 reasons on the notice to appear and than handed the I-130 application receipt to the judge. It took all of 5 mins while waiting 2 hours for the judge to start the court and get through other cases. 
     
    I e-filed which made it so simple. I got my IOE number that same night I filed.
     
    PLEASE DO NOT FORGET TO FILE FOR EXEMPTION: You need to state these laws in your example to become exempt from a non legal marriage during removal precedings in a pdf and attach it online or mail it in. You will be DENIED if you do not send this in with an explanation to your legitimate relationship/marriage and how you met. 
     
    This must be in your explaination or your I-130 / I-130 A will not be approved. Laws have recently changed.
    It has been explained to me that pursuant to §204 (g) of the Immigration and Nationality Act (INA) and Title 8 Code of Federal Regulation (CFR) §204.2 (a) (iii) the petition I filed on behalf of my spouse cannot be approved because the marriage on which the petition is based occurred after November 10, 1986 and while my spouse was in exclusion, deportation, or removal proceedings, or judicial proceedings.


     
    §204.2(a)(iii) Marriage during proceedings – general probation against approval of visa petition. A visa petition filed on behalf of an alien by a United States citizen or a lawful permanent resident spouse shall not be approved if the marriage creating the relationship occurred on or after November 10, 1986 and while the alien was in exclusion, deportation, or removal proceedings or judicial proceedings relation thereto.  Determination of commencement and termination of proceedings and exemptions shall be in accordance with § 245.1(c)(9) of this chapter, except that the burden in visa petition proceedings to establish eligibility for the exemption in § 245.1(c)(9)(iii)(F) of this chapter shall rest with the petitioner.


     
    (A) Request for exemption.  Not application or fee is required to request an exemption.  The request must be made in writing and submitted with the Form I-130.  The request must state the reason for seeking the exemption and must be supported by documentary evidence establishing eligibility for the exemption.


     
    In accordance with Title 8 CFR §204.2 (a)(iii)(A) I am hereby requesting an exemption to the approval bar for the following reason(s):


    EXPLAINATION...
     
     
    I further understand that I must provide clear and convincing evidence that the marriage is bona fide.  I must submit documents which establish that the marriage was entered into in good faith and not entered into for the purpose of procuring the alien’s entry as an immigrant.

    So much nonsense in this thread. OP, you can file for AOS tomorrow and you'll be fine. Go ahead and send do it as soon as possible, so that you can get your green card as soon as possible. 
     
    Your intent while crossing the border is irrelevant because now you're an immediate relative and your intent is ignored. All that matters now is you proving that your marriage is real and that your wife makes enough money for the affidavit of support. Ignore everything else in this thread, you're not in trouble.

    Honestly, I hate coming across threads like this. Everyone bouncing off of each other's comments and badgering the OP for asking an honest question. I thought the purpose of this forum was to learn more about the process by asking questions, raising concerns and seeking advice, not to get bullied by a mob. "That's why people from your country are denied visas..." I mean really...
     
    OP, you can file for AOS now that you are the spouse of a USC and in the US. I suggest waiting a few months to collect evidence, get a copy of your marriage certificate and get your affairs in order. If you can afford it, get a consultation with a lawyer (~$100). Best of luck to you!

    ~~Mod warning that this has gone on long enough. It no longer matters what his/her intent was before entry. CBP granted entry than the OP is allowed to AOS. Stick to helping with his or hers AOS questions or move on. Badgering the OP about Intent is over it no longer applies.Further similar comments will result in suspension.~~

    I just checked my EAD case status earlier this morning, and it turns out my request to expedite was approved and my card is in production! Just wanted to give a huge thanks to the VisaJourney community and everyone who has ever shared their timelines (I probably read every single timeline out there while in nervous anticipation...). Below is my detailed timeline and process notes in case anyone is / will be in the same boat as I was.
     
    Timeline:
    05/16: Married to USC 05/24: Submitted I-130, I-485, I-765 and I-131 applications 05/25: Priority date 06/01: Received job offer to start August 6, 2018 06/07: Received NOA1 in mail (notice date of 05/31); application being processed by National Benefits Center 06/09: Received Biometrics appointment notice in mail (notice date of 06/01) 06/19: Biometrics appointment completed (could have done early walk-in, but wanted to get expedite supporting documents ready first) 06/19: Called USCIS and submitted service request to expedite EAD on the basis of Severe Financial Loss (end of current employment on 6/29 plus pending job offer to start 8/6) 06/20: Walked in to Congresswoman's office and hand-delivered case form, cover letter, and supporting documents (see list below) to Constituent Services Representative 06/22: Email response from USCIS asking for supporting documents for request to expedite: "Upon receipt of your request for expeditious processing, your case was reviewed and a determination was made that we need additional information to make a decision regarding your request. Please fax proof of a pending job offer to ###-###-####, Attn:  AA####, Div #, Team #." 06/22: Forwarded USCIS email response to Constituent Services Representative, who confirmed that an expedite request has been submitted on his end as well 06/22: Faxed over supporting documents to USCIS fax number provided in email response Cover Letter; USCIS Email Response Above (they request you include in your fax); Pending Job Offer, with 8/6 start date; and Statement from Current Employer (at the time) on Termination of Employment 6/29 06/22: Submitted case to Ombudsman (https://www.dhs.gov/case-assistance) with cover letter and supporting documents 06/26: Email response from USCIS: "We received your request to expedite the decision on your application. Your case is currently under review. You will receive a decision or notice of further action shortly." 06/29: End of current employment (at the time); effectively unemployed 07/06: Ombudsman responded saying my case is within normal processing times, but to respond if I believe I qualify for expedited processing. I responded and reattached cover letter and supporting documents 07/06: Constituent Services Representative from Congresswoman's office followed up with USCIS 07/06: Case status online changed to "Card in Production"!  
    Notes on a couple factors (real / intangible) that may have affected my expedited processing:
    I am a Canadian citizen marrying a USC. I have been in the U.S. three years under the TN work visa, and four years prior to that as a student and working in the U.S. every summer. Seems like a fairly vanilla case Just a pending job offer is rarely enough anymore, but my current employment at the time was ending as well. Furthermore, when I applied, my wife was in between jobs, so our application paperwork has her down as unemployed as well. Having both of us unemployed may have pushed my situation towards the "severe" side Since these things are always subjective, I believe a good cover letter can really make the difference. In mine, I emphasized how, more important than the money, I am a young college graduate about to lose a once-in-a-lifetime opportunity, which would be a major setback to my dreams My birthday is today (07/07), which may or may not have affected anything haha

    I went to the post office Wednesday afternoon in Las Vegas to mail my (OK, my wife's)  I-485 AoS package.  The options were Priority Mail for about $7, which would take 2-3 days, or Priority Mail Express for $25.50, with a money back guarantee to arrive by noon the next day.
     
    I figured I've spent so much already on this process that I might as well plunk down my credit card and pay $25.50 for the next day service.  But I wasn't happy about it.
     
    Went online with the tracking number and set up email and text message notifications, because I'm neurotic.
     
    I was alerted yesterday that the package arrived at the P.O. Box in Chicago at 12:39 p.m. local time.
     
    Did I go back to the post office today to claim my $25.50 refund because the package didn't arrive by noon? I did. 
     
    And she handed me back cash, which felt even sweeter.

    Hello,
     
    Sorry for the long wait, there is not much you can do except trying to contact the local Senator and Congressman and also Ombudsman and hope for the best. I was in a similar situation until 1 day, 1 year after our interview   most likely because we moved and filed AR-11, that they looked at our file again and approved it

    Seconding Chase and Bank of America! Chase required a government ID and a proof of address. I also highly recommend looking into applying for an ITIN, it will make it much easier to add your husband to things like credit cards and bank accounts.

    Try to contact your embassy and see if they have something called a "laissez passer" sorry dont know The word in English.
    This document is something you get from your embassy that you use when you lose your passport for travel. Usually it is valid for a few weeks, 1 month maximum. That is the only option you have because no Airlines will let you travel with just the expired passeport.
