Hi all

 

Just woke up to find a notification that I-130 is denied. I-485 status still shows as interview scheduled. The application was filed a year ago concurrently. I was scheduled for my I-485 interview in March but it was postponed due to COVID.

 

On July 20th status changed to Interview Scheduled but the notice never arrived. I contacted USCIS twice about it and was told to wait. Most recently last week and was told the notice was never mailed.

 

Is this normal? I thought they had to wait for an interview to decide on an I-130 when it's filed concurrently?

3/19/2020: interview canceled automatically due to COVID, status back to ready to schedule for an interview

7/20/2020: interview scheduled; notice never arrived

8/24/2020: I-130/I-485 denied for no show

9/3/2020: contacted Senator's office

9/9/2020: status changed to case was reopened for reconsideration

9/11/2020: status changed to case was reopened

2/13/2021: Notice interview scheduled for April 9, 2021 12:30 PM

4/9/2021: barely 9 minutes interviewed both of us; only asked how we met (20 year relationship proof); ran through the yes/no questions; approved I-485 and I-765 the spot

3/8/2024: filed N-400 application online based on 3 years of marriage to USC

3/9/2024: N-400 notice case is being worked on

3/31/2024: Interview scheduled notice

5/13/2024: Interview day

10/14/2020 - New version of I-765 received in Chicago

03/10/2021 - Notice of Deficiency (Missing I-693 Medical Form)

06/25/2021 - Receive Biometrics Appointment Letter

07/23/2021 - Biometrics Appointment at Norfolk VA USCIS Office

07/23/2021 - 485 & 765 statuses changed to "Initial Review"

07/29/2021 - Interview Ready to Be Scheduled

08/13/2021 - Interview Scheduled for September 21st

09/21/2021 - Interview at USCIS Norfolk VA

09/21/2021 - Email saying “card produced and mailed”

09/24/2021 - Approval email sent for I-485

09/28/2021 - Green Card mailed by USCIS (email notification)

09/29/2021 - Green Card delivered to mailbox (also email notification)

10/01/2021 - I-765 rejected because “benefits were obtained via other means”

 

13 Months Total, No Lawyer or assistance besides USCIS website and VisaJourney, you can do it too!!!!

Sounds like a no-show for interview is the reason. Sorry for this mess but you don't trust the telephone people for notice. Please wait for the letter to come and you can request an infopass to talk to a local agent. Good luck.

If you are inside the United States, you can no longer schedule an appointment online using InfoPass for domestic offices. However, you can check your case status, see our case processing times, change your address, and use other tools on our website.

If our online tools do not provide the help you need, please call the USCIS Contact Center to request an appointment.

Agree that you will have to see the letter for details.  What evidence was sent along with the I-130?   Unfortunately, it seems that I-485 will be denied, too, since the I-130 is the basis for adjustment.  Hopefully, you can get this sorted out.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I-130 wasn't denied before, my original interview which was canceled 6 days before it was scheduled so not sure why now. But I sent them evidence going back 20 years, multiple leases, joint banking etc

 

still on hold with USCIS for the last hour to talk to a tier 2

Update from tier 2 agent: we were scheduled for August 4th, 2020 and the interview notice never arrived

 

have to wait till deny notice arrives by the end of the week

Wait for the denial letter, and call to get an appointment to talk to the officer who is in charge of your file.
