    That would be FBAR.  It's actually a requirement of the US Treasury, not IRS.  Filing is now done online, not with the tax return -- https://bsaefiling.fincen.treas.gov/NoRegFBARFiler.html

    We are still in the Philippines.  We file U.S. taxes together but our BPI accounts are separate.  My wife has an ITIN but BPI would not know anything about it and has never asked her to fill out a W9.
     
    However, I include the interest on both of our BPI accounts on our U.S. tax return.  I also report the tax BPI deducts as foreign tax.
     
    It is a piddling amount because interest rates are so low.  A few years ago we had over $100 in interest at BPI.  This year I have $22.40 and $3.67 PH tax deducted.  So I looked into it, and IRS says you have to report all interest, even if you don't get a 1099-INT and even if it is a small amount.  I thought maybe there was a rule that said under XXX amount does not have to be reported, but no, there is not.
     
    I like to be honest on my taxes so I will my tax on the $22!  🙂

    @Highmystic If you don't mind, please update us after you send the W-9 to BPI, especially if they ask for additional documents or raise other issues. It would help others (like me) plan ahead, because I plan to retain my PH bank accounts even after relocating to the States. I already understand that I need to include my interest and investment income in my future US tax filings, but it helps to learn about others' PH-specific experiences.

    in addition if you you have colrlctingly more than $10,000 USD in foreign accounts you have to make an annual FBAR filing by April 15.

    If she has bank accounts in the Philippines, then not all of her income is from work.  Interest from bank accounts (including foreign accounts) is also considered as income that must be reported to IRS.  Hence the requirement for W-9 or W-8BEN.

    Just always be honest when asked questions. Think if you answer "No" to prior use and then they find out you have. Way worse than just being upfront about it to begin with.

    Some states have legalized it, either for recreational use or medicinal use.  A word to the wise...   Since his interview and medical is by and for "federal" and not state,   pot may be in issue.  "Federal" law it is illegal.  I have read articles recently where Canadians (where it is normally legal) and entering a State in the US where it is legal,  was question by Federal Immigration if "they ever smoked marijuana... a yes answer (although legal in Canada and the state they are going to) was denied entry in to the US (where as a whole, it illegal).  Unless they do a hair test,  he should not partake and clean up for a urine test.

    File amended tax returns with Schedule Cs and Schedule SEs and pay the taxes and fines.

    Denaturalization is very convoluted process, but it's been done a few times.

    You, and with the help of your attorney, will need to respond quickly once the NOID is received from USCIS.  It would appear that you didn't spend sufficient time with her and didn't commingle your finances.  Spousal visas are normally pretty straight forward.  With you referencing a K3 it sounds like you didn't prepare very well.   
     
    Worse case is that you will spend more time with your wife and refile once you have a better case.

    Slow down. You haven’t met yet. Don’t focus on the requirements first. That’s a red flag, anyway, to be thinking of visa requirements before you’ve even met. Get to know one another and enjoy your time together. The right time to file the K-1 is when you are ready to marry. For some, that’s after one visit. For others, it’s after multiple visits. Only you two know the right time for you.
     
    Yes, one visit meets the legal requirements to file a petition. But that’s just the tip of the iceberg. Marriage is a huge step. Make sure it’s what you both want. You have an uphill battle with the embassy in Pakistan so I would recommend more than one visit. If that means waiting until next year to file, so what? K-1s are not being processed by the embassies right now anyway, as they are not considered “mission critical” (embassy jargon for “essential”). You also will likely spend a considerable time in AP also so you need to see this as a multi-year plan.

    Wang is charged with visa fraud, in violation of 18 U.S.C. § 1546(a).  If convicted, he faces a maximum statutory penalty of ten years in prison and a fine of $250,000. 
     
    SAN FRANCISCO – Xin Wang, a scientific researcher and officer with the People’s Republic of China’s (PRC) was arrested in LA as he was exiting the US.  Most likely a LOT more going on here then just plain old visa fraud, but on multiple false statements on (at least one) Visa.

    I don't know if it will help, but keep a copy of the mailing, that it was indeed mailed to the gov, and receipt that it was at least delivered.  If you get in trouble that you are out of status, at least you have something to show you are trying.  I think if you are not stopped for anything, or questioned, you will get by until they send you your receipt.

    Yes, the House holds the purse strings and were too busy with "other matters" to deal with it.  Since USCIS is somewhat self funding through fees collected, and with fees down about 50 percent due to the shutdown, they don't have much of a choice, unless employees just volunteer to work for free to do everyone's paperwork, and that's not going to happen.

    You are in danger of deportation until you get the receipt for your I-485..you will then be granted authorized stay until the decision is made on your adjustment of status......this is not Trump's fault.  Congress must provide funding....
