shumway1756 got a reaction from Antoinette05 in What do I put for province in the I-129 form?
I put N/A for all fields that didn't apply to me. Didn't run into any issues. I feel like it also communicates that I reviewed that field and found it not applicable, and it removes any doubt that I accidentally overlooked it.

Chiming in, the K3 is indeed dead. I tried that to get my wife to the US faster. They actually closed the I-129F a few months before adjudicating the I-130, "because the applicant or petitioner received a status or benefit through other means". So if they pick up the I-129F, and see the pending I-130, they're just going to outright kill it.

In the end it was a good thing. Assuming the K3 had worked out, it wouldn't have reduced the wait by much, and we would have had to file for adjustment of status later. Better to wait a short bit more and get the green card straight away. But again.. Not going to happen that way anyway.

This is a vague step, it had me scratching my head too because there were no instructions as to what they really meant. After seeing other VJ posts I uploaded a single passport-style photo (like you said, uploading 2 is redundant when filing electronically). It was accepted with no problem.

shumway1756 got a reaction from Pen in What Photographs do I add to CEAC?
This drove me crazy too. There are absolutely no instructions, either on CEAC or the State Department website, explaining this. It's also strange that they say "Photographs", plural, if they're only wanting a typical passport photo.

I can't remember where, but I finally found where people were uploading passport-style photos and this was being accepted. So that's what I did.

But yes.. The lack of instructions on this point is very frustrating.

It means you'll be uploading your documents online instead of mailing them in. It's much faster! As soon as you get your case and invoice number you should be able to access it, pay the fees, and get started after the payments clear. After uploading documents and filling out the DS-260 VJ'ers are reporting anywhere from 5 days to around 2 weeks for documentary approval. Took mine 2 weeks.

shumway1756 got a reaction from Locito in K3 NVC Process time, same as K1 or CR1?
I submitted for a K3 for my wife as well, I was naive at the time and thought it was viable (hadn't spent enough time on VJ yet). USCIS closed the i129f/K3 almost a full month before they approved the i130/CR1 petition, which shows that they don't even give a rip about the K3's anymore, even if they do get to it before the other. In the end it's so much better though, so much less hassle and money with the CR1/IR1.

Any attorney who suggests a K3 is immensely incompetent and he/she is not staying abreast of the latest trends (they're more than 8 years behind). I would strongly consider a different attorney (or, if your case isn't special, you can go it alone and save the money.. many of us have done it).

The Alien number is the REGISTRATION NUMBER on the visa itself.  You might have to put an extra"0" on the front if you were issued an 8 digit number.

The first response is wrong.  You are married.  Married there married here married everywhere .   She will not yet have a SSN until she has a visa.  You can file for the tax id and file jointly but you must include both your incomes world wide.   Filing separately may actually be the best way.

Unfortunately, you cannot file as married because the “marriage” has not been recognized. She will need to establish a SSN in order to pay taxes or be claimed as a dependent. Single will be your tax status.

Yes, you can schedule the medical appointment once you receive your interview appointment notice. I'm not sure how long Guatemala is taking. My wife (in Romania) received her interview notice 2 weeks after being "documentarily qualified". Again, not sure about Guatemala, some other users more familiar with that region can add their experience.

    Congrats! You're getting closer!

I went through this this year too. The W7 instructions specifically state that you must include your federal tax return (1040 and all related forms) for 2017 with the W7 application. It sounds like, from what you've listed, that you just included a copy of your W2? That's not what they want and it doesn't let them process your taxes. You have to prepare the 1040 and all related documents (including W2, 1099's, etc), and submit it at the same time as the W7.

Per W7 instructions, when asked on the 1040 (and any other included forms) for your spouse's SSN/ITIN number, leave that field blank. The W7 processing center in Austin, TX will fill that in once they've approved your W7 and assigned a number, and then process your federal tax return.

Enforcing those rights is the challenge...usually it's much more of a hassle and cost to do so than it's worth. Usually it's best to educate them on the what documents are acceptable, not try to force anything on them.

Pay the immigrant fee before you travel to the States. The packet from the embassy should explain how to do that. Checking the box for SSN on the DS-260 was also a good option. My wife's SSN and GC both came in the mail exactly 10 days after arrival in the US. Taking off weekends and seeing when they shipped both out, they were both created in just 5 business days after arrival. Of course that's not always the case but it's not taking too long these days.

Adjustment of status when the GC is within 90 days of expiring. Definitely don't forget that part!

    Congrats!

I have no idea how you're going to get reliable statistics to answer that question. People break up for all kinds of reasons...the wait/depression/anxiety is almost never the underlying cause IMO.

Like the others have said, you can certainly enter on a valid tourist visa. Don't volunteer any information, but if asked answer truthfully about the pending I130. I would suggest having some things to show that you plan to return home after your vacation, including already purchased return tickets, perhaps a letter of employment showing you have a job to get back to, etc. You may not need those, but it's good to have incase the officer wants to inquire further.

Yes, you need it with you. A copy at the interview will suffice, the original isn’t required. You should also have copies of all relevant tax documents for the sponsor.

The current address. When you fill out a form you always fill it out with the information that is accurate as of the time you're filling it out. Don't worry, they know that life changes so it won't be seen as an inconsistency.
