7 weeks ago I sent the IRS a packet that had a w7 form, a copy of my husband's passport, and my w2 form. I need an ITIN for my husband in order for me to file my taxes.

 

Today I received a letter from the IRS stating "We rejected your ITIN application because you didn't include a completed and signed U.S. federal income tax return with your application."

 

Can someone please help me? Are they asking for a 1040 for a previous year? I'm stuck.

Would probably need a good bit more information to accurately figure out what to do (filing status, claiming husband as exemption, his current immigration status, etc.), but from the form W-7 it says this:

 

Reason you’re submitting Form W-7. Read the instructions for the box you check. Caution: If you check box b, c, d, e, f, or g, you must file a U.S. federal tax return with Form W-7 unless you meet one of the exceptions (see instructions).

 

They are probably wanting your income tax return, because that's the one that you are requesting it on, but you'd probably have to wade through the W-7 instructions diligently to figure it out based on all the specifics.

I went through this this year too. The W7 instructions specifically state that you must include your federal tax return (1040 and all related forms) for 2017 with the W7 application. It sounds like, from what you've listed, that you just included a copy of your W2? That's not what they want and it doesn't let them process your taxes. You have to prepare the 1040 and all related documents (including W2, 1099's, etc), and submit it at the same time as the W7.

 

Per W7 instructions, when asked on the 1040 (and any other included forms) for your spouse's SSN/ITIN number, leave that field blank. The W7 processing center in Austin, TX will fill that in once they've approved your W7 and assigned a number, and then process your federal tax return.
