I only share my own personal opinion and my personal experience that’s all, I don’t mean to mislead anyone as i know this is a crucial part of their lives; I did traditional wedding In Africa and still go thru my K1 visa and I didn’t encounter any problem at all it went smoothly.

You can have ur tradItional ceremony whenever you want it doesn’t matter if u file or not just don’t show the traditional wedding picture in your packet, soon as the embassy sees it they consider you guys married already, and I think you’re trying to file for K1 visa rt if yes go ahead and do your traditional wedding. it has no paper work so do it and keep the pictures away from Uscis. I hope this help you out I did this before too.

There’s no big deal even if they see the picture it’s just the gathering of both families showing acceptance of the couples to be married it even show how legit this union will be but whatever you do with Uscis one just need to be smart about it like I said before I did this before and nothing happen. And I understand your point am just letting u know there’s no big deal to this.

It’s a traditional wedding it’s not official there’s no paper work sign or anything it’s just the gathering of families from both side and I say it again as long as the couples didn’t post such pictures on social media and they never submit pictures from that event they will never find out this is for sure.

Additionally, many people find that the old USCIS website (the one pictured in your original post) and USCIS case tracker app do not work to track their case until after biometrics are completed and sometimes not even then. My wife has completed her biometrics now 3 days ago and still she cannot use that website to track her case. However, when she logs into the new website, she is able to track case status. So it may be simply that.

USCIS gives the choice for you to file any time after you become a conditional resident but before you are removed from the country. So I'd say that either file immediately after obtaining the final decree or wait till the 90 days window open would both be fine. However, since the waiting process is rather long now, filing as soon as you get the final decree might be better.

I switched from jointly filed to divorce waiver and had no problem obtaining the 10-yr green card. Hope that helps

When filing under a waiver of the joint filing requirement, your 'window' opens immediately upon your divorce being final.

You can either file now or wait for the 90 day window, your choice.

Most people have more then they realize for ROC. She will have the divorce decree which is pretty good evidence of the marriage and its dissolution. Its a legal document where you both disclosed your joint assets and debts. If you had none- then the decree is proof of that. There is no official list of things one needs to submit to prove bonafide marriage. Some couples dont mix finances- that doesnt make them non-bonafide.
Anyway, no one is ever going to tell you her immigration status. You may find out about it if she talks about it or others do- but family court does not care about ones immigration status. Its not really your concern anymore except for the fact that there is the aff of support- however its rarely used to collect from sponsors and she did not sue you in court for support.
You can contact USCIS about your feelings that she committed fraud. Theres a post in Effects of major changes by Brian nineteen something, I forget his user name, probably a few pages buried, but its about how to report fraud to USCIS. You can send a letter or go to infopass. You would need solid proof though or its a waste of time. If she does ever become illegal you can attempt to get her picked up, in the past ICE did not care, currently they are instructed to deport anyone illegal. However, if she did file 751 and it ends up getting rejected and she has to go to court there are many ways she can get approved. Court will also take many years to resolve. I believe in some places its a 2 yr wait to even get your first court date. She will have status until court rules she doesnt.
You should look into getting a block on your childs passport (or being able to get a passport) in case she decides to leave the US and take the child. Also look into if she is able to get a foreign passport for your child. If she gets one then there really is no way to prevent the child from leaving with her with that passport. The US cant put exit blocks on other countries passports. She can also get remarried and file various things- she will need to leave the US to interview in an Embassy but this can just be a 2 week vacation.
