    im a k1 visa also..i came to a point that i wish we had done cr1 instead but if i think about it um not really..we have our own decision and opinion..and my opinion about cr1 i think i just dont like the fact that most filipino who gets cr1 are desperate people who wants to secure the approval..its because they dont want to get deny because of their red flags..for example in our village there are 10 people applying for our visa but 8 of them are for cr1 and 2 for k1..only 2 for k1 because  they have a very positive view and they trust each other and their relationship but those 8 people for cr1 they are usually  from friends/family introducing to the foreign men and usually they only met once in person and decide to get married and so they can be together.. They chose cr1 because there are some red flags..sorry its just my opinion..i admit im a HATER of some people who do cr1 for AMERICA or other country and not for TRUE LOVE..sometimes i felt sad for the church who let those people get married in God's house.. sigh
     
    Hooray to us who files for true love!! k1/cr1 or any other visa as long as its not for the country.😅😅😅 
    i hate seeing those people in our village who marry those foreigner for money and now they are an ####### of the village.. They think they are above. really only dumb people talk too much about the foreigners money like its also their money LOL

    Your Bride?  If you are married, you have only one option:  CR-1.   If you are not yet married, then I suggest looking at this:
    K-1
        More expensive than CR-1
        Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
        Spouse can not leave the US until she receives approved Advance Parole (approx 3-4 months)
        Spouse can not work until she receives EAD (approx 3-4 months)
        some people have had problems with driver licenses, Social Security cards, leases, bank account during this period .
        Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    CR-1
        Less expensive than K-1
        No AOS required.
        Spouse can immediately travel outside the US
        Spouse can start work if desired
        Spouse receives Social Security Card and Green Card withing 2 or 3 weeks after entering the US
        Spouse  has legal permanent Resident status IMMEDIATELY upon entry to US. 
     
    All-in-all, the CR-1 is superior to the K-1 imo.

    A Warning To Green Card Holders About Voting
    Do not register to vote in any election until you have officially been granted US Citizenship.
    Going into this election season, it is very important to understand that for a Green Card holder, (Lawful Permanent Resident) to register to vote is not only improper, but can have severe consequences in the future.
    Even though there are States that have instituted policies that do not require evidence of US Citizenship when registering to vote, the voter registration documents do ask whether the person registering is a US Citizen. Many have simply checked the box and gone ahead and registered, knowing that even if the State Law requires showing government issued identification, their driver license will suffice.
    While this is not legal advice, the publicly searchable “9 FAM” (Foreign Affairs Manual) is quite clear regarding the potential consequences of falsely claiming US Citizenship. There is no more serious a misrepresentation, based on the consequences, dealt with in 9 FAM. The potential consequence of registering to vote or for any other federal or state benefit afforded only to US Citizens includes Deportation and a LIFETIME BAN from entering the USA.
    If any reader who is not a US Citizen, has registered to vote in any official State of Federal election, I advise them to seek competent legal advice as soon as possible, to discuss minimizing or eliminating the risk of any future deportation and ban.
    The law is, what the law is. Regardless of whether this particular or any other immigrant related law is being consistently enforced today, that can change at any time.
    False claims to US Citizenship are taken very seriously by Customs and Border Patrol Officers. Some years ago, I was traveling with my step daughter, when we encountered a border check station on Interstate 10 in West Texas. My step daughter was quite proud of passing her citizenship test just the day before, and proudly answered yes, when a CBP Officer asked if she was a US Citizen. I quickly corrected her, so the officer would hear me, saying, “You WILL BE a US Citizen after your swearing in ceremony, but you’re aren’t a citizen yet.” Fortunately, the officer was understanding and we were soon on our way without incident.
    Many have registered to vote, somewhat “innocently” because of the misrepresentations or ignorance of well meaning officers at the DMV (Driver License Offices) or even a campaign worker.

    Basically, documentation of the final outcome of the case (i.e. sentencing or final settlement of the case).
    It is not stated in the I-129F or instructions that court records are actually required here, but we have seen an increasing number of RFEs for them anyway.

    Whether court records related to that specific question will be needed depends on whether there are any available and what kind of crime it was.  The best practice would be to provide any record that IS available, along with your explanation.  A "disposition" would be something like "pleaded no contest and receive X hours of community service..." etc.

    I have a friend who did the same, but I get greater piece of mind from having done it myself (with a fairly straightforward application.) I'd be afraid that come application is less important to a law firm and than it is to me and that they might miss something! My friend got two RFE's for some pretty obvious errors. It depends on the circumstances.

    Exactly, they don't do anything that you can't very easily do yourself with a little help from this website (for free).
     
    Besides, USCIS will still keep issuing RFEs when needed, in that regard nothing has changed.

    I do agree with the sales tactics and hype. But I must say, due to the amount of RFE's I have seen on this site, I would recommend at least considering a reputable firm to help with the package. I have been using a firm for several years for various things such as visa expedites, passport expedites and also the same firm for two K1 applications which were both approved with no RFE's. Unfortunately, the first one didn't work out. I have seen several lawyers even screw up applications on here. I chose to use the firm here recently because of todays environment with longer wait times higher scrutiny of the applications. Sure, I could have done it on my own, but I could afford to pay the couple hundred bucks and it gave me peace of mind that a third party reviewed it for errors and missing documents before it reached USCIS. They also organize the application in a way USCIS likes to see it. I am not saying everyone should do it, I am just providing another point of view. An RFE can add another one to two months to an already exacerbating seven month wait. My view is why chance it.  If you have potentially legal issues or criminal background problems, I would highly recommend a lawyer over a visa firm. Visa firms and coaches are not legal experts. They merely help put the package together.

    Yes, the form is updated regularly. In 2017 they removed the need for the G-325 by incorporating the questions into the I-129F. They also updated the wording for criminal histories, as you have noted.
     
    Those crimes shouldn't impact the petition's approval, but they do need to be disclosed. You should also provide court documents/police records for each charge, along with its final disposition, even if not strictly required by the petition itself.

    Yeah this has been discussed in nauseam here on VJ. The vast majority of them are hyping this to get more people to sign up for their services which "guarantee a visa".  When they can't guarantee anything but waste our money. 
     
    The vast majority of people who have actually read the notice both on here and reddit including myself don't see a problem with this at all. Because some people send in just the documents and hardly anything else to hopefully try and bring those documents to the interview. When the vast majority of time it doesn't even make it there.

    Not at filing stage, only at the interview stage if they apply for a K2 visa. However we preferred to frontload our petition and enclosed my sons' IDs and birth certificates right with the petition. At filing stage you have to list all beneficiary's kids and K2 kids may either go with their mom or follow within 12 months after she's got her K1 visa. No separate petitioning required, they are automatically petitioned for with their mom.

    Just FYI, you will also need a multiple filer waiver for the K-1.  I am not sure if this affects overall processing times.

    Refusal or not, his timeline is average for the current times. Your processing times in the past are now just a distant memory. It is taking almost a year for everyone, whatever the outcome. There used to be a bigger gap between timeframes for K-1 avd CR-1 but now they are pretty much on a par. Which makes me wonder why some people still think the overpriced tourist visa - sorry, fiancé visa - that leaves their spouse unable to work, drive (in some states), leave the country (you say your wife has no plans to travel but what if a family member back in her home country dies? It's not about plans, in my opinion, it's about the freedom to be able to do so if you want/need to) for many months is such a good deal.

    Yes.  This is on me.  I will put together a much better package this time.  We are just determining if a K-1 or CR-1 should be used this time around.  I was expunged in 1995 I think.  I should be able to find court documents and refile.

    For some K3 context, we submitted a petition for the K3 (we were naive and thought it might be quicker). USCIS actually notified me that the K3 (I-129F) was administratively closed about 1.5 months before they processed the CR1 (I-130) petition. So they don't even go by which one is quicker, they will literally just close the K3 so they don't have to bother with it. So even if it is processed "quicker", they won't let it get ahead of the CR1.
     
    In the end, I'm VERY happy that it happened this way. CR1 is so much better, but I didn't realize it at the beginning of this process. VJ showed me the light 🙌
