I filed online on May 21, 2021 and had my interview in Chicago yesterday (March 14th). I also had a pending I751 and the officer completed both interviews together (we were NOT notified about this in advance). The officer told me that both of my cases (N400 and I751) will be approved and I will put on the waiting list for an oath ceremony once all the paperwork has gone through. The wait for the oath ceremony is about 6-8 weeks at this office.

Well, a colleague of mine applied in August and was sworn in back in very early March, and his biometric appointment was waived.  A simple google search has led me to understand that it is because of the pandemic that they've been waiving a lot of appointments and just scheduling people for the interview.  I don't know what a "timeline" is.  I've been a permanent resident for five years now, and I sent in the N-400 today.  There are two possible field offices my application can go to, because of a weird zip code I live in that straddles Los Angeles and Los Angeles County.

Los Angeles itself shows a 12-16.5 month wait.
Los Angeles County shows a 13.5-17 month wait.

My lawyer says that most of her clients are getting processed pretty quickly and assured me last week that I'd have an interview by the end of 2021.

This is the timeline for my wife - she applied for naturalization based on 5+ years as a LPR. This is North Carolina.

May 12, 2021 Oath Ceremony Notice Was Mailed
May 12, 2021 Your Form N-400, Application for Naturalization, was placed in line for oath ceremony scheduling.
May 12, 2021 We recommended that your Form N-400, Application for Naturalization, be approved. Your case was submitted for quality review.
April 14, 2021 We scheduled an interview for your Form N-400, Application for Naturalization.
April 13, 2021 We received your Form N-400, Application for Naturalization, and mailed you a receipt notice.

That is from the USCIS case tracking, and it isn't actually 100% correct - more correct would be to say:

    April 12, 2021 - submitted N400 online
April 13, 2021 - got both a "we received your app" and "biometric waiver"
    April 14, 2021 - interview scheduled for May 12, 2021
May 12, 2021 - wife attended the interview, was told "you are approved - please go back to the waiting room and wait to be called for your oath ceremony". Oath taken, she was given her Naturalization certificate, surrendered her green card, left a US citizen.

Have to admit we were both not only shocked w/ the fact it took only 31 days beginning to end, but also because we never expected she would be taking the oath right then and there ! We found out when she came back home - we didn't go with her because we thought she would (hopefully) be approved, and she would get a follow-up notice to go for the oath. But nope - all in one sitting. So we didn't even get a picture . . .

EDIT: and in case anyone else is wondering . . . after she took the oath, they told her "wait here for a minute and we will give you your naturalization certificate". So she asked "But, my biometrics were waived. Which picture are you going to use ?". They told her "We select the one we think looks best from all the pictures we have on file from you, from visas/AOS/entry to the US/etc.". So she got a picture on her certificate from about five years ago or so . . .

Thanks!! You were right - I check online and it says case approved! Yay! Does anyone know how long it will take to receive the new green card now?

It looks like the fee hikes were put on hold also, another yay!!!! We are going to be traveling internationally this month so will probably apply for naturalization when we return. Hopefully we can get the new greencard before we leave.

So yeah, printing issues seem to have been an issue in recent months. I've seen quite a few reports of people still waiting for them.

That said, the title is a bit misleading. While some people may be missing actual documents and technically be "undocumented" as a result, they are not being deported or are subject to deportation. It's a documentation issue.
The requirement to carry the green card has not actually been enforced in any case I can think of or find offhand. This goes doubly for somebody who isn't carrying it because they haven't received it. So that part just seems a bit misleading..."undocumented" tends to have a different meaning to most people.

That's not to say there isn't harm...the lack of a valid EAD or green card can be a hurdle for an I-9 (to work), or a lack of a green card to travel. So it's not harmless either.

The other thing I would say is nothing there implies this is being done intentionally. It sounds like their well-discussed financial issues are the cause of the delays, not an attempt to cause harm.
As bad as this is, the underlying funding issue is the real killer. USCIS may furlough up to 70% of their employees if they don't get a loan from Congress. If that happens, non-emergency processing will likely come to a near halt.

@aroabi Please see my most recent post above.

@aroabi I believe the goal is to adjust fees on or before 9/30/2020.  I’m considering waiting for my ROC approval before applying for my N-400.  In a scenario that the effective date of the increase in fees is approaching and I have no updates on my I-751, I will go ahead and file for N-400 if my window has opened.  No reason to spend more $$$ if you’re eligible to apply before the increase.

Just got an e-mail update that my case was transferred to another office (originally EAC). No idea why and I'm wondering if the letter will tell me more and where it was transferred to. This is the first action I have had on my case since doing biometrics in June 2019.

Spouse just got a text notification. According to USCIS case status:

Not sure where it's going or what this means since we haven't received the letter yet but  I will miss not being at the VSC anymore...the time for approval was down to around the 1-year mark so we were hoping for a decision within the next few months. Now we just wait a little longer!

Yes it was the signature for the petitioner in the end of the application. We filled it out twice as first time we made mistakes and second time overlooked the signature as I (the spouse) have gotten most of the paperwork together and missed that part the second time.. hope everything is ok for you

Although many may not agree with the law currently on the books, what the OP is doing is perfectly legal.  There was a post in CEHST that discussed the AOS from a tourist visa, but unless the law is changed (not likely anytime soon), it is a very legal method.  The OP and their spouse may get more scrutiny particularly with the unauthorized work, but as many members have said, they should end this ASAP.

You haven't been given any conflicting information.

Your K-1 visa expired the moment you passed through immigration controls at the airport, since it's a single-use visa and you used it. Your legal presence is now governed by your I-94.

You are initially granted 90 days of legal status. Your K-1 visa requires you to marry your original petitioner within those 90 days, though there is a workaround if you later marry the petitioner outside of those 90 days.

Once your I-94 expires (after 90 days), you are out of status and removable by ICE. You also begin to accrue unlawful presence. Filing your I-485 'stops the clock' on unlawful presence, and places you into a period of authorised stay until your I-485 is approved or denied.

You don't have to file for AoS, but you will be considered unlawfully present in the US from the time your I-94 expires until you do. The political climate right now isn't great for those unlawfully present, so you should file asap.

One thing that I really want to say after reading all this...do not “use” your fiance and her nationality as a stepping stone into the USA. It’s coming across that you want her to file for you just so that you can get into the country, not to pursue the relationship with her. Please don’t do that to her. It’s cruel and heartless. If you genuinely want to build a life with her then investigate the options of her moving to Canada. Since you are inadmissible into the USA currently, I assume she has no problem traveling to Canada as she must be the one doing all the traveling at the moment. Perhaps look at border living?

It’s awful when parents are in another country and sick or elderly. But you are speaking here to a whole community of people who have left their homelands and their families to come to the USA. Many of us have experience being apart from sick and dying relatives - and in many cases the distance is greater than Canada - USA. Some here have not been able to get back to their homeland in time to see a parent before they die But everyone gets old at some point. And having elderly or sick parents is not a reason to break the law, however much of an emergency it may feel to us. If your parents are advanced in years (in their 80s?) I’m guessing you must be at least 40. You’ve been around long enough to know that immigration laws are there for a reason.
