    In my opinion, if your end goal is naturalization, I would file the N400 and get that clock ticking.  As @Scandi mentioned, you get a fair amount of notice for an interview.
     
    In the end though, it is up to you.

    Since you came on a CR-1 you're almost guaranteed to get an interview for your i-751 - so file the N-400 so you can have both interviews in one. No reason to wait and have two separate interviews. 

    For the interview you just need to keep checking your online account where you will find the date and time once scheduled - you usually get 4-6 weeks notice when you're scheduled for an interview. So unless you're planning on staying abroad for a longer period of time, it shouldn't be an issue to be back in time for the interview.

    There are trusted labs in her country to get the DNA test done. No need to bring them to the US to get tested. Find one of the labs that the consulates use they would be trust worthy at least.

    Just a thought, too.  If the OP's friend has a government job, especially with a security clearance, he may need to alert a supervisor as to what is going on, in case of a blackmail or extortion attempt.
     
    I am sorry for the child in this situation.  I also know what it is like to feel like there is impending doom with a legal case, and how worked up it can make you!  OP - have your friend get a lawyer.

    You can get away with it without having to pay an attorney.
    Your having waited for 5 years should preclude questions about the marriage.
    If you're asked, pleasantly reply, "I'm applying under the 5-year rule, under which marriage queries are precluded, sir."  Repeat as necessary.
    The magic words are, "Let's please include your supervisor in this interview now, sir."  Repeat as necessary.
    Practice in front of a mirror until you're comfortable with these responses.

    Entering the US via an F-1 visa with the intent to stay and adjust status is the problem.  That can be seen as illegal misrepresentation.

    Life is somewhat unfair in general. I wouldn't feel guilty about your employment based GC getting approved faster than other's family case.
     
    A lot of LPRs, spouses of US citizens will get an opportunity to apply for citizenship on 3 year rule, whereas you'd have to wait for 5 years of residence. So many of them can become US citizens sooner than you!

    I feel like because the vast majority of family based applicants would apply for premium processing making it… not premium processing any longer. I do not think it’s a viable option for family based petitions for that reason.

    Ok, I called the largest Accredited testing center in Nigeria( listed on the embassy website), They closed at 5, and I just got in before they closed. If you have your case number, you can call and talk to them. they have a person that specializes in the DNA testing for the US embassy, and for USCIS. They do it all the time. You do not have to go to the embassy for collection, they laughed pretty hard when I asked them that. You call and make an appointment with them for your kids, they can get you scheduled within a few days easy they said. You will do testing at a location in the US near you ( They are all over). They said it's a 5 min process for each person, and they will take your results, and the kids results, put them all together, and they have to deliver them to the right department/person at the embassy. They maintain the complete "chain of custody" thru out the whole process, and they have to deliver the results to the embassy. Whole process takes about a week usually, so not 5 years. It's not cheap from my understanding, they told me 200,000 N to 300,000 N per test. Sounds like a lot of cash to me, but I didn't convert it. Here is the website with all the contact information. If your in the US you can contact the closest center to you, and they should be able to help. Get started on Monday, and you can have the results at the embassy by the following Monday.

    I won't disagree your husband was disrespectful towards you during the fight.

    As you are adjusting status, if you leave the US you will abandon the process (unless you have AP). You are currently allowed to stay in the US because you have the NOA1. It indicates are you allowed to remain in the US even though the I94 has expired. But, if you leave you might not be allowed to return to the US for some years (as a tourist) depending on what the consulate decides when you apply for a B1/B2 and if either tourist visa or ESTA are still valid for use for a return trip (you've shown immigrant intent by applying for adjustment). 
     
    See how your husband behaves after the fight.
    Is he apologetic? Is he willing to work on the issues you were arguing about?
    In addition, the things you called him out on... if he never changes these behaviors would you be able to stay with him? It seems like you are saying no... 
    You are in a tricky situation because you are most likely fully dependent on him until you obtain EAD. You might also want to consider going back to your home country, work on the marriage and obtain the immigrant visa via the consulate. This would give you more independence in the relationship as you would return the right to work and drive.

    Correct but the best way to go about adjusting status is to file the I-130 concurrently with the adjustment of status related forms.
     
    To the public charge issue, yes they'll need a qualified joint sponsor, AND a plan of actual support for two of them.

    Make sure she is well prepared for the test this time; maybe find her some classes for immigrants seeking to naturalize.
     
    And I can assure you that there was nothing racist about the questions the officer asked; they are professional, and it is just part of their job to ask these kind of questions. During my AOS interview, I was asked if I intended to overthrow the government and if I associate with terrorists.

    CR1 is a very wise choice for the Philippines.  I know.   I have first hand experience with what an awesome choice it was.
     
    More or less any way will require at least a short trip by the US person at this point.
     
    Utah online marriages heavily tested at this point by both the US Government and the Philippine Government so your statement that online marriages may not be accepted by the philippine government is just plain false.  One simply must register the marriage.  EXACTLY the same as one would need to do with any K1 marriage if they wanted it to be recognized by the Philippine government.

    Not sure what you're freaking over...I've got the same notice a few times. The packages eventually get to their destination. Just relax. You'll need a lot of patience this journey. This FEDEX issue is nothing compared to USCIS drama that we experience in our AOS journey. 
     
    Packages get marked that they were delivered to my door but none actually was. They shown up 2 days later. I just relax and wait.

    A couple of open ended questions about the marriage through which LPR status was obtained are standard, the proposal question is actually in the Officer training manual. Asked in a casual non confrontational manner..they go almost unnoticed .
     
    I find it interesting they offered withdrawal..clears up pending cases, not that it helps OP if he decides to re apply.

    Your statement will not prevent an RFE.  Scanning, emailing and reprinting is perfectly acceptable.  There is no need to physically mail.

    Hello all,
     
    I was wondering if USCIS would allow if I made a statement about the burden that it would be to obtain a passport photo of my fiance? First of all, in Peru it is very hard to get the specifications correct, secondly, to send mail from Peru to the US often costs around $100 because the post is privatized (unless you use the national mail service which will not guarantee receipt) and it also takes roughly two months even with a private service. Any input would be appreciated! Thank you.

    If parents would be in the US already, there would not be an issue. But having them enter the US with the intent to adjust status is fraud. What will they tell CBP when CBP asks them what the purpose of their visit it? What do you think will happen if they say “we’re going to adjust status once we’re in the US”. 
     
    I also don’t appreciate your attitude and calling members racist when they give you an answer you don’t like. This forum has members from all over the world, and nobody made a racist comment. Drop your attitude!
