Have her show the GC, but keep the NOA from the I131 in case CBP asks her anything. A lot of GC holders apply for a re-entry permit and their plan change and they come back to the US prior to the REP being approved. She should have no issues.

Your mom has a green card. It's advisable she's back to the US.
She doesn't need the permit if she's back within less than a year of absense. Even if she's out of the US for more than a year, she should come back to be with you and maintain her US residence.

Having your mother sponsor them after becoming a citizen would not speed anything up either as the F3 is only two years ahead of the F4 in the visa bulletin.
If they are skilled, they can always look at working at companies willing to sponsor them although that might be a long shot depending on their field of study.

Good morning, this amazing community!! My mom just entered the US under IR5 visa on Oct 22, and waiting for her plastic green card. (She got her social security card after only 1 week hooray!!! 😄).
I think she will get her 10 year green card after I renew her one-year temporary visa on her passport (Plan to apply by July 2023).
Do you guys know after she is granted her 10 year green card, can she live in the US and another overseas country (for example, Vietnam) ? I assume that she will need to live in the US longer (7 months) and shorter in Vietnam (5 months), for example.
Also, they will deduct the total time she wasn't in the US when she applys for citizenship?

@lifegoeson123 she will receive the GC in mail soon which is valid for 10 years. No need to renew it until it's close to expiration. Forget about her naturalizing if she spends 5+ months each year living abroad. She'll need to make sure her residency is maintained and she doesn't lose her LPR status. Overall, not a great plan. Green card is for living in the US.

She will receive a 10 year plastic Green Card. There is no renewing the stamp in her passport. The stamp acts as a Green Card until the plastic one arrives.

@Crazy Cat Right now, the government stamped on her passport visa "Upon endorsement serves as temporary I-551 permenant residence for 1 year". We are still waiting for her plastic green card since I paid $220. I haven't seen it, so I am not sure how long it will be valid. I assume one year. Then we will have to renew it by submiting I-90 for her 10 year green card. Please enlighten me if I am wrong Thank you so much!!!

There seems to be a lot of honest misinformation out there. Most people (including me, until recently) just assume that their newly immigrated senior parents are not eligible for health coverage. I have gone through the process successfully and can only report on my experience.
My advice to the skeptics is to use a healthcare navigator or call the healthcare.gov team directly and apply for health insurance. Don't be paralyzed into inaction simply based on hearsay. The worst thing they can do is say no. More likely though, you are going to be pleasantly surprised by the results.

Hi Mia77,
Just because we sponsored our parents' green cards (I-864) it doesn't mean they have to be declared as our dependents in our tax returns. The two are completely separate. If they file taxes separately (this is really important) and they don't work / have any income, they are eligible for maximum healthcare tax subsidy. The law specifically states that healthcare subsidy does NOT constitute a public charge (quoting my very experienced healthcare navigator.)
To be clear, this only applies to health insurance purchased on the open exchange. Federal programs (Medicare) and state programs (Medicaid) will apply the sponsor's income for any means tested benefits. The one exception is the state of California. Their Medicaid program (Medi-Cal) is very liberal and does not apply the sponsor's income when determining eligibility, even if you filled out an I-864. Also, recent immigrants (in the US less than 5 years) with no income are eligible for Medi-Cal. I was considering moving to CA just for this, until I found out Obamacare covers my parents. But I digress...
Again, to make the most use of the healthcare subsidy, don't claim your parents as dependents on your taxes and you should be fine. You lose a bit in the form of tax deductions for dependents, but the payback in terms of health coverage is well worth it IMO...

Did your parents check the SSN box on their DS-260 forms? If so, wait around a month after US entry. If they don't receive their SSN in the mail by then, book an appointment for them at the SSA office to apply in person.

Just to make sure. She entered with her visa and got the I-551 stamp right? All that needs to be done is to pay the greencard fee and her 10 year greencard will be sent to her within a couple weeks/ months. You do not renew her visa or file the I-90 if her greencard hasn't come in by the 1 year mark. If she doesn't have her card by that time she'll have to follow up with USCIS where her card is and she could get another stamp as proof of status but hopefully it doesn't come to that and she'll get her card soon.

Has she entered the USA?
Assuming she paid the green card fee, she should get a 10 year green card within one year if her entering the USA.
Obe can file to review a 10 year green card no more than 6 months before it expires.

In addition she needs to spend more time in the USA than outside. The moment she arrives in USA, if she wants to take a trip outside the USA for X days, she should not do so until being in the USA for at least X+1 days. And after her return from trip of X days, her next trip of Y days should not be another X+1 or Y+1 days, which ever is greater.
It she plans to naturalize, it is critical that:
* she file her income taxes with the IRS, on time, each year even if she doesn’t have taxable income
* she retains the last 5 years of IRS tax return transcripts
* if she is divorced, she keeps records of required support for her spouse
* if she has any minor children born during a marriage thst dissolved, she keeps records of child support payments if she doesn’t have full custody
* if she has any minor children born out of wedlock who don’t live with her she keeps records of child support payments
* keeps records of offenses other than parking violations or if they exceed $500 in fines
* keeps records of her physical presence in the USA for the past 5 years

It won't affect anything. You are a citizen. You can file this minute if you want to.
There is no right away with immigration. You mom will take about a year or more and your brother will take about 15+ years. Also, keep in mind that in 15+ years if his children are to old (over 21) they may not be able to immigrate because they will be considered adults.
Since you are divorcing your husband, they will not look at you and your husband's income together. They will only look at your so you will need to make the requirements to petition for them.
