    We ended up driving from Montreal to Sault Ste. Marie, ON and crossing there (we were going to cross at Detroit but thought that SSM would be faster). It was a Monday around 11:00am, there was no one else crossing at that time. We mentioned that I had a K-1 Visa to activate and we were pulled into secondary. All contents of the van were inspected while we were inside waiting for the paperwork to be processed. Maybe make sure you have some cash on you (we had to scrounge lol), there was a processing fee for the I-94 (this was in 2014, unsure if it's still the same). I was there for maybe 20 minutes, it was very fast and went without incident.

    My husband and I haven't had any children, I can't have children - it hasn't been an issue for me yet in this whole process.

    Just to be clear here:
     
    You want to get a Visa for studying, have someone pay for your PHD, house you and maybe appear in a movie or two while you're at it?
     
    I'd start by applying for PHd programs you're interested in and see if they accept you, as well as what tuition assistance they may offer.  Highly doubt you'll get a full free ride to include housing and tuition so be prepared to have quite a bit of funds.
     
    As for movies, avoid the weinstein group when applying for roles.....

    We started our Journey 09/07/2014 when we were married in Canada. Me being a US citizen and he is a Canadian citizen. Along the way, we could not have done it without the help of Visa Journey. My husband was allowed into the US on 05/26/2016. He got a Social Security # right away and we waited and waited and .... After countless calls and inquires as to the status of my husband's green card, we were finally told that his paperwork had been lost.  Thanks to the advice from VJ I had multiple copies of EVERYTHING I had sent to USCIS. We had to start over and recreate everything. We were told it could take years because of the new bans on US immigration. More phone calls, more visits to USCIS, more background checks, you name it we had more of them. My husband's green card arrived in the mail yesterday. 05/25/2018. 3 years 7 months and 18 days. The kicker to this story is that it expires in 20 days.

    I had no luck after I received my EAD, no calls, emails, nothing. Once I received my GC that changed. I had a couple of job offers within the first month, and started working about 6 weeks after I had GC in hand. I started off in an administrative position and quickly moved to the software development side of the business.

    MY INTERVIEW APRIL 16 EXPERIENCE
     
    Hi guys! I just want to share my interview experience yesterday and hopefully it helps in you preparation in your upcoming interview! Good luck! 
     
    My interview was scheduled at 8:00am, I arrived 25 mins early. I was checked in and called by the officer around 7:50am. 
    Documents I brought with me
    - Interview Letter
    - Green Card/ Driver's License
    - Passport (expired and renewed)
    - Husband's birth cert & passport
    - Updated form of recent travels
    - Marriage certificate
    - IRS we filled joint
    I  brought the original &photocopied them as well
     
    Documents that the officer asked
    - Interview Letter
    - Green Card/ Driver's License
    - IRS tax that we filled joint
     
    I started with the English test and just have to read 1 sentence and then write the sentence he asked me to write. That was it! I then proceed to the CIVIC questions. They gave me this red booklet about the 100 questions to study for Naturalization when I did my biometrics. Everything is on the booklet.  The officer probably asked me 10 questions total. Like how many supreme court justice? What does declaration of the independence entails? Give me one branch of the government? etc. I got them all right. Then we proceed to the next part of the interview...
     
    So, Its kinda like adjustment of status interview but w/o my husband. lol. I was asked about our relationship. Me and my husband are together for 4 years and no kids yet. He asked me like maybe 5 times if I have kids. I said "we don't have kids" and I" don't have kids". So he asked for more evidence. Health insurance, bank accounts, life insurance etc. But I didn't bring any with me. Luckily I brought the IRS tax we filled joint 2014-2016  with me so I gave it to him. So that kinda stopped him and then he write notes in his computer. I was then asked about the yes or no questions in the N-400 form that we filled up and questions about pledging loyalty to the United States. I also wanted to point out that the officer also asked me if I have arrested or had any traffic violations. So I kinda paused because I just had a recent one, its obstruction of control/vision. From holding my phone! lol. Anyway I told him that I went to court and pay the fees so I wont get the points. Its my 1st ever ticket. So he put that in his computer again. Kinda freak me out because I thought its gonna be the only reason that I wont be approved. The officer is nice and professional. After that, I was asked to review infos he typed in his computer in this IPAD and signed couple pages. And then he told me Congratulations! I will send recommendation in your case for approval ! He congratulate me 3 times. Yeyyy!!
     
    I just checked my status online when I woke up today and it says 
     
    We approved your application
    Your final step to becoming a citizen is to attend your naturalization ceremony
    We will mail you a letter when we schedule your naturalization ceremony.
     
    I'm over the moon. I'm gonna kissed the USCIS good bye soon. Over all it was a smooth process. Our field office here is very organize and not so busy. I wont be able to complete this journey w/o my VisaJourney family my no.1 source of information  .

    I don’t understand why people are still making this mistake. 
     
    Im gonna tell you like it is because I don’t know any other way and it may help someone in the future who reads this. Your K1 is gone forever. No other K1s can be filed either. You never should have had any celebration of any type. It doesn’t matter that you are not married in paper. For that country and their culture in their eyes you are married and that is grounds for denial. Your case will be in AP until it’s sent back to USCIS to expire. Then and only then, probably months from now, can you apply for a new petition. 
     
    Your only solution to be together is go there and get married again because you’re gonna need a marriage certificate to prove you’re married then file for CR1. You’re gonna wait 12-14 months for visa in hand if no other delays. They won’t expedite your case just because you got denied a K1. You start all over. That’s the price you pay for trying to be snarky. 
     
    A celebration ceremony is too married for a K1 and it will always get denied. And it is not married enough for a CR1. So there. I hope it’s lesson learned for you.

    Yes your family is being split up unfortunately due to your own actions. You were spending more time in the US than in Canada, which is not allowed, even for Canadians who require no visitors’ visas. If the plan was for you to live in the US, you guys should have filed a petition for that purpose as against the in and out you were doing. 
     
    Your option is for your husband to initiate the petition process which will certainly take over six months, while you remain in Canada for the duration. Alternatively, you both move to a third party country.

    You need to bear a few things in mind.
     
    To enter on a Tourist visa with intent to stay is illegal
     
    To work on a tourist visa is illegal
     
    And both are against the VJ ToS.

    Please don't be cryptic. If you're looking for help from people who have had a similar experience at least give the name of the countries involved. Then maybe someone who married or lived in either country can give relevant advice. 
     
    To get good information from us, you need to give us good information to work with.

    K-3 is obsolete...it's a relic from back when the CR-1/IR-1 was taking multiple years. Very, very few are issued anymore (due to USCIS and NVC processing policies). Even if the K-3 somehow made it through USCIS and NVC, it's currently only a couple months faster and much more expensive, has more restrictions (i.e. no work for months after entry), and will take about a year longer to get the actual green card (and therefore a year longer wait to naturalize). You can only file for AOS within the US, and you cannot enter the US on a tourist visa with intent to file for AOS. You will need to show a bona fide marriage. You must be able to financially support him so he will not become a public charge. The I-864 requires a minimum of 125% of the poverty level for your household size in income. Assets can be used instead/alongside income at a 3x multiplier. Income must continue from the same source upon return to the US to be considered. You must have filed at least the last 3 years of taxes, or provide an explanation as to why you were not required to file taxes (i.e. income below the filing threshold). Note that USCs and LPRs are taxed on worldwide income. A joint sponsor (USC or LPR in the US) can complete an I-864 alongside your I-864 if you don't meet the requirements. You must have, or show sufficient intent to establish, US domicile before the visa can be issued. Note that domicile does not just mean having somewhere to sleep. The housing arrangement with your mother is good to include, but is probably insufficient as the only evidence of intent to establish domicile. As for when to file, the current timeline is about 12-14 months from filing to interview. The visa is valid for 6 months from the medical. That said, you can easily delay the process at NVC for up to a year. I would also suggest looking at doing DCF in Jordan. Given his living situation, the embassy may not permit it. But if they do, expect the 12-14 months estimate to be more like a few months instead. This gives you a little more control of the timeline as well.

    3) filing jointly means you include your worldwide income (not savings on previously taxed income)

    I was married the exact same way.  No family or friends, in a courthouse.
    It wasn't even brought up during my AOS interview....actually, come to think of it, we weren't even asked anything about what type of ceremony we had or who was there.  The IO was only interested in seeing the marriage certificate itself.

    It's this kind of thing that annoys me. She used a USC for immigration benefit. As soon as she got her citizenship she divorced him and is going to re-marry her original husband to bring him here. That was the plan all along. Why didn't she bring the child with her when she came on a K-1? Because there was never any intention to build a family life with the USC husband. 
     
    She can marry when she is legally free to marry (if there is a waiting period following divorce in her state of residence then she will need to wait that long after the divorce  before marrying again). She can petition as soon as they are legally re-married. Whether the visa will be approved or not is a whole other story.

    Contact the NVC and remove the I-864.
    Change your phone number.
    Start a divorce if you do not wish to be married.  If someone yells at you on the phone what will they do when they are here? Hit you? Hit your child? Control your life? Is that okay with you?

    So he overstayed, you must file a two step AOS. The i130 first must be approved, 50-50 on if you would have an interview for it. If so, it will be a stokes. During the wait time for the i130, you want to request the judge pend your case for 6mo-1yr depending on scheduling based on a processing i130....bring that proof to court. You will be pended til that is approved or denied. Once approved, you wait til your next court date and request termination without prejudice and to have your case remanded to USCIS. Have a copy of the i485 already filled out, photos, everything as a show that you are on top of it. You will either be terminated or given a merit hearing to adjust in court. Termination just means you file like anyone else but must include the form from the judge granting termination and allowing the case to be processed.  
     
    I am strongly still advising you to at least have a pay by the hour legal service, or pro bono. This is like a mine field, high risk. I paid 9,000$ Total for ours and took a loan for it, you can't put a price on keeping your spouse with you ! 
     
    All I said is all that I saw our lawyer do for us. I have a thread about ours where I kept tabs and updates called "visit from ICE, now going to court"  if you want to read it.
     
     
    Feel free to PM me. Not many of us have posted about removal and come out the other end smiling. I see you are in Atlanta, the lawyer we used travels to Georgia as well as the Carolinas for removal issues. She works wonders. She also takes payments.....a rarity
