    A Warning To Green Card Holders About Voting
    Do not register to vote in any election until you have officially been granted US Citizenship.
    Going into this election season, it is very important to understand that for a Green Card holder, (Lawful Permanent Resident) to register to vote is not only improper, but can have severe consequences in the future.
    Even though there are States that have instituted policies that do not require evidence of US Citizenship when registering to vote, the voter registration documents do ask whether the person registering is a US Citizen. Many have simply checked the box and gone ahead and registered, knowing that even if the State Law requires showing government issued identification, their driver license will suffice.
    While this is not legal advice, the publicly searchable “9 FAM” (Foreign Affairs Manual) is quite clear regarding the potential consequences of falsely claiming US Citizenship. There is no more serious a misrepresentation, based on the consequences, dealt with in 9 FAM. The potential consequence of registering to vote or for any other federal or state benefit afforded only to US Citizens includes Deportation and a LIFETIME BAN from entering the USA.
    If any reader who is not a US Citizen, has registered to vote in any official State of Federal election, I advise them to seek competent legal advice as soon as possible, to discuss minimizing or eliminating the risk of any future deportation and ban.
    The law is, what the law is. Regardless of whether this particular or any other immigrant related law is being consistently enforced today, that can change at any time.
    False claims to US Citizenship are taken very seriously by Customs and Border Patrol Officers. Some years ago, I was traveling with my step daughter, when we encountered a border check station on Interstate 10 in West Texas. My step daughter was quite proud of passing her citizenship test just the day before, and proudly answered yes, when a CBP Officer asked if she was a US Citizen. I quickly corrected her, so the officer would hear me, saying, “You WILL BE a US Citizen after your swearing in ceremony, but you’re aren’t a citizen yet.” Fortunately, the officer was understanding and we were soon on our way without incident.
    Many have registered to vote, somewhat “innocently” because of the misrepresentations or ignorance of well meaning officers at the DMV (Driver License Offices) or even a campaign worker.

    It is the correct stamp. The entry stamp looks exactly the same as no matter what visa you enter on. It's just the standard stamp. When I entered on my CR1 visa the border officer wrote my visa number on the stamp, right under the date. The important part is what says on the lower part on the CR1 visa: "Upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year."

    You can only enter with a CR1 visa one time. Once you enter, the visa, in combination with the entry stamp, becomes a document proving that you have LPR (green card)-status. The visa, with the entry stamp, is all you need to prove your green card status. It's good for work, travel, getting a driver license or anything you can do with a green card, basically.

    I would also focus on quality over quantity. Good “quality” visits are better than multiple “honeymoon-type” weekends. Renting an apartment together and doing day-to-day things, seeing each other at their worst, managing finances together, and things like that is far better, in my opinion, than spending one weekend a month in a hotel where you just see the vacation-side of each other. I made multiple short visits (over 40) before I moved because I work for an airline and the cost was minimal, if any cost at all. But some of the visits were like mini-honeymoons. We would go to a hotel and have a good time. I made a few longer visits of 2 or 3 weeks and they were far better, even though we stayed at his place and did normal things like grocery shopping, repairing an old bike, choosing new curtains, etc.

    Spending three months together in person along with family members from both sides attending the wedding will trump any concerns about the relationship being bona fide.  Lots of successful cases here when marriage was on the only/first visit of a few days to a couple weeks.  That alone is just one thing.  I'd worry more about actually getting married.  Going through ZAGS process often ends in failure after several months of trying.  IF IF IF you can spend time in Italy and marry there, go for it.

    Notification 1 is still valid.  That wording is given any time the last tax return doesn't show sufficient income to qualify, no matter what the current income is NOW, and no matter how much in, and what kind of assets are stated and documented.  The CO will make a judgment call based on the totality of circumstances.  If you want a prediction, then more fully disclose those details.

    Each pay stub shows year to date income.  Take the most current pay stub to the interview to show that she is still working at her current rate of pay.  Yes, less than a full year of work showing on her 2019 tax return is surely why you got that notice.  If the current income is clearly sufficient and comfortably over the minimum, you should be OK unless coming from India.  Please complete your profile so people can give you answers in country specific context.

    The land border allows essential travel and family reunification.  The latter is for permanent or long term visits - it is not to spend a week with an aunt across the border.
     
    Therefore, you should be able to cross with the CR-1 visa and immigrate to the US.

    It's borderline and will be a judgment call.  Best to be prepared with a joint sponsor standing by, if possible.  Meeting the minimum is no guarantee of success.  NOT meeting the minimum assures failure though.

    Since you've asked about two separate scenarios, I'm confused, or maybe you are.  If the USC Spouse qualifies based on current employment income the EZ version is OK.  If you are also using a joint sponsor for whatever reason, then the EZ version cannot be used by either petitioner or joint sponsor.

    Once the consulate notifies NVC they have available sots for CR-1/IR-1 interviews, they (NVC) will schedule interiews beginning at the front of their queue for that particular interview.  Until an interview is scheduled, the case will remain at NVC.

    If self-employed, then your current income is the total income line from the most recent year's federal tax return.
    Anything earned since the end of that tax year is revenue, not income, until claimed on the next year's tax return.

    Good chance you won't need that form but just some comps and a mortgage statement to document approximate value of equity should suffice.

    I'm sure living together with your wife in Russia will be considered as a positive factor by the consul officer.  But aside from the authenticity of your marriage, they also need to check that you will be able to financially support your wife and son when you all move to the US.
     
    Anyway, here's the answer to your question from the I-864 form instructions --
     
    Total Value of Assets. In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current Federal Poverty Guidelines for your household size. However, if you are a U.S. citizen and you are sponsoring your spouse or child age 18 years of age or older, the total value of your assets must only be equal to at least three times the difference.
     
    Also note --
     
    Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value.
