    Get a restraining order against your mom and cut off contact with her. Your mom has some issues and I would not trust your child around her at all. Legally speaking she can't do anything regarding your immigration case.

    I'm curious, like Transborder and NigeriaorBust: having a baby in the U.S. is pretty expensive; do they have savings to take care of the cost? Or does the wife have U.S. medical insurance?
     
    As far as AOS goes, USCIS will not care that the wife wants to have the baby in the U.S. That's not a reason to bypass immigration normal procedures; it will seem like the wife is just looking for quick green-card status for her husband. Better to have the wife file CR-1 for her husband and get a co-sponsor, and go through the process legally and reasonably. The husband came into the U.S. on a visitor's visa. He will have to leave again and file for a CR-1 or IR-1, depending on how long they've been married.

    It doesn't appear that your mother meets the residence requirements to directly confer citizenship to you or your brother.  She could file petitions for al of you but because of your ages it will takes years ( about 8 )  for you children to get a green card.  When she petitions your father that will be about a year.  The issue will be the affidavit of support.

    People are sometimes picked at random for interviews at this stage, or perhaps they had a question about something that didn't really warrant an RFE or couldn't be explained with a piece of paper. Since you know it's coming, and you hate interviews (yet you have to go, unfortunately), is there a therapist you could see in the time before the interview that could maybe help you with some exercises to help you relax?
    My sincere sympathies; I get 'stage fright' and it's almost paralyzing, so I have a tiny hint of how you might feel, but breathing exercises help me, and maybe a therapist could help you as well.

    There are so many parts to these collections of paperwork it's understandable, even when you check them over and over, that you might miss something. If you can, maybe ask a good friend to take a look and try to see if you're missing anything; sometimes just a different set of eyes can help you. You can re-send, don't stress. Good luck!

    Just make sure your checking account statements and credit card statements are representative of the entire time you've been together, because that's what they'll want to see.
    Do you have any cards or letters, addressed to you both, at the same address? You can include copies of those.

    First, K3 is obsolete. It's a waste of money going that route...it will just turn into a CR-1 anyway.
     
    If you plan to marry in Canada, then a K-1 is not possible. You must marry within the US for a fiance visa, and not be married prior to entry using said visa. You would have to wait until after you marry, then file for a CR-1 visa, which will take (on average) 10-12+ months. Given the current processing timelines for a K-1 (6-8 months), marrying civilly in the US then going to Canada to have a formal ceremony/reception isn't practical. Once you enter on a K-1, you cannot leave the US until you get AP, which is about 3 months after you file for AOS (after marriage).
     
    Edit: Quickest option to do what you want would be to marry now, file for a CR-1, then come over to the US in the 10-12+ months. You will be able to work and leave the US at that time, too (unlike the K-1 which has that period of being unable to work or leave the US).

    I'm not sure I agree with the "there's not much you can do right now" line.  As soon we got married, and especially after my spouse came to the US, we created a file folder (well, a box) and we collected all sorts of paperwork as we went along.  If we got mail addressed to both of us, that went into the box (like Christmas cards and wedding invitations, for example).  We put our bank statements and credit card statements in the box.  We put our medical insurance statements and claims in the box.  When we travelled together, we put the hotel reservations/bills (with both of our names), the boarding passes, pictures of us with friends - all of that - we put into the box.  When our AAA cards were renewed each year, we copied them and put the copy in the box.  When we joined a gym, we copied our cards and put them into the box.  We really tried to collect data all along the way.
     
    Then, last year, when it was time for ROC paperwork, we just organized the box!  It was soooo much easier than trying to create a bunch of paperwork from scratch.
     
    So I firmly suggest that you "collect along the way" - as I think it makes it easier!

    This really shows how people should always read the comparison of the various visa types in full before hastily sending off the I-129F in the mail. I'm sure a lot of people only read the part that the K-1 is faster than a CR-1 and overlook all the disadvantages. Too late for the OP now unless they abandon the current petition and file a spousal petition after marriage but hopefully will serve as a reminder to new lurkers.

    Are you going to submit the K1 application or you are waiting for the interview? Sorry for asking questions but I can't tell since you don't have your timeline yet.
    If you are sending the application, you must provide the evidence that you and your fiancé have personally met within two years of the date the petition is filed.  I think the following is a list of items that are generally accepted by the USCIS. Do not send originals though. Make photocopies of your evidence. 
     
    Airplane and/or Train Boarding Passes: This shows that you actually got on the airplane. Good evidence when used in conjunction with copies of the plane ticket. Note that plane tickets alone only prove that you bought a ticket and not that you actually made the trip.
     
    Anything else you feel proves that you and your fiancée have met in the last two years.
     
    However, do not send chat transcripts, phone bills, emails, or anything else that doesn't prove a physical meeting. Save those things for the interview.  So the screen shot is not considered as physical meeting.
     
    For the interview, I was crazy enough to keep every single chat history.  After the interview I felt I over prepared, but it is good to prepare well in advance.  So I would keep the screen shots as much as I would be able to.
     
    That's what I was told and I did it.

    Wow, you wasted a lot of time and money on something that you're not gonna use or need. ? You could have just gotten married on the VWP. 
     
    So you've decided you're not moving to the US, right? I think if you cancel/withdraw the visa due to changed plans, it won't affect his ability to travel on the VWP. You could probably double check that with the US embassy in Sweden. They're very approachable.

    If you're serious about living two years in Sweden...Marry in Sweden, cancel the K-1 and 10-12 months before moving back to the states, apply for a spousal visa.

    If these tattoos aren't gang-related, and you say they're not, I really don't think he has anything to worry about. When he goes to the interview, be sure he dresses nicely (doesn't have to wear a suit, but wear nice business-casual type shirt and pants if he has them). Answer truthfully that they're not gang-related and you should be fine.
     
    Lots of people all around the world have tattoos now, and for most of them, it's just body art, and the CO knows this; they probably have a heads' up about which ones to note and watch for, anyway. Try not to worry too much, ok?

    If you're in Italy, sorry, you can't come to the U.S. with the intent to get married and stay and then file AOS. That's immigration fraud. 
     
    You can file for a K-1 fiance visa, wait about 5 months or so for it to be processed, and then come and marry within 90 days, OR, you can always come on a tourist visa, get married, and then go back to Italy and file for a CR-1 spousal visa. It'll take a little less than a year, probably.

    New residents do not usually get 6 months, normally a lot less. In Colorado the first thing you get is the EAD. However the issue here seems mainly what is required by your Insurer to insure your vehicle.

    Personally I would pull the petition, work on your relationship, iron out the problems, then try again. It's a stressful thing, moving countries, and you really have to be 100% committed to get through it intact. Just take a little pause to work together; you'll probably be happier that you did.

    I have to agree. If his relationship issues are causing immigration issues (such as missing a medical), then relationship issues need to be fixed before there are more immigration issues, such as missing an interview, failing an interview due to clearly not wanting to be there, coming into the US and not marrying but then maybe not leaving, coming into the US and having FURTHER issues that may stall out AOS.  

    I've seen enough people here NOT do AOS for their foreign spouse because they aren't sure the relationships working. I say if someone says their relationship is faltering pre-K-1 Interview then yes, we should try to talk them through it. Too many people go through this process blindly and follow the step by step and not realize that just because you got 90% the way through doesn't mean you actually should do it. Some people do it all simply because they were so deep into it, they would rather risk it all instead of take a step back and reflect on why they were doing this process in the first place.

    And while they may be working through it, their interview is in 2 days from today. Issues big enough to stop someone from missing their medical appointment aren't usually something that can be hashed out in 2 days. We're trying to let her know there is the option of pulling the petition and then working on the relationship and trying again when they are 150% this is what they both want.

    Without the relationship, there is no immigration, at least in cases like this.
