    Okay that's  good to hear  but what I'm saying is at this point in the process could I take over in the case? I'm guessing USCIS has  already extracted what they needed from his dad in the intial filing process? Just wanted a bit further detail the next steps.

    That’s not correct. Anyone you petition for whether as a fiancé or spouse etc. Lying is a bad idea for several reasons including the fact that it leads to bans when discovered, the probability of discovery is very high, plus it’s against our terms of service here.
     
    Just be honest that you previously filed for someone, you’re not the first nor will you be the last.

    1.  He doesn't need you to complete his removal of conditions.  He can do it on his own with a divorce waiver.
    2.  You cannot be removed as his sponsor until he has attained citizenship, gained 40 quarters of work credit, lost his status and departed the US, or has died.
    3.  If you have solid evidence of fraud, you can report it to USCIS.  But remember that you have already provided a LOT of evidence that the relationship is bona fide.

    Tell the neighbor to go ahead and call ICE.
    When the neighbor informs you of the time ICE is expected to arrive, wait with a jar of lemonade and extra glasses for the "all would be visitors" at the door. Some people are just miserable and they need to be called off at their bluff.

    I think I did tell you in an earlier post of yours to keep murm over the GC and focus your battle on citizenship. USCIS may as well give it you and delay your N400 for as long as they want. Why would you fight over a step that is way back? I am currently sitting on 1 year N400 application without even an interview notice on the horizon. Focus on the final battle (N400) unless you wanna win the GC one and have to start the arduous process of waiting for the N400.

    Statistics show that roughly only 3%-5% of I-751s are actually denied.  Either significant fraud doesn't exist...or USCIS interviews don't detect fraud.  Either way, conditional green cards are a waste of resources and time.

    Agreed. I just figured minor children of green card holders would be able to immigrate with their qualifying parent(s) or at least would be able to do AOS in the U.S. The system is set in place like that for a reason right? So I'm not even going to waste my breath questioning or trying to challenge it.

    Thank you for ACTUALLY answering my question. In that case I guess we adults in the family will have to alternate our time between Canada/US until they are able to join us over here.

    Agreed. I just figured minor children of green card holders would be able to immigrate with their qualifying parent(s) or at least would be able to do AOS in the U.S. The system is set in place like that for a reason right? So I'm not even going to waste my breath questioning or trying to challenge it.

    It's illegal to enter the US on a non-immigrant basis with the intent to immigrate by adjusting status.

    Yeah they...don’t immigrate yet if it means leaving children alone. Migration is a choice and it is not always the right choice at every stage in one’s life.

    What’s wild is that they even allow over 21 children to immigrate as beneficiaries of a petition, even if they get married. A lot of countries don’t allow this.
     
    The wait time is because the law specifies a quota for these types of visas per year and there is a large queue waiting for them.

    Okay listen. I have already hit my 10 year visa and went through all of this.
     2015 my husband moved to stay with me so that we could see if our relationship was sustainable. 5 months in we decided to travel to the USA to visit and meet his family and to reset the 6 month period. We were rudely awakened that this was not how the border would allow us to behave and essentially I got told that he could finish the remainder of his 6 months and then we needed to leave. We were devastated and embarrassed by how the officer treated us ( basically calling us stupid and telling me that we had no rights because we were not married. After crying I began to research.
     
    I immediately applied to get my spouse a temporary residency for Canada, so that he could remain longer( as long as you have a pending application before your passport stamp runs out you are fine). We married in feb of 2016. After trying and trying to get PR in Canada I gave up and decided to go the other way. We applied in oct 2016. 
     
    during this time I continued to apply for temporary residency, 3 times in fact and when I got to the interview portion of the cr1 on sept 11 2017 because I did this and because we remained in domicile the entire time the officer changed their entire attitude! I had proven our marriage was bonafide simply because my husband remained with me, unable to work etc, through the entire process. 
     
    I had to remove conditions and truthfully 680 dollars will be worth it every time. Many petitions that begin in the United States first are deemed suspicious.
     
    I highly recommend having her enter to visit you, and take appropriate steps to make her a temporary resident while you complete all your processes.
     
    have someone on the USA side help you. STAY AWAY from the border. It’s hard but necessary because it proves you are there for them and not to evade immigration law. 
     
    I am in the process of naturalizing. I wish you luck!

    Bring her actual passport. The initial filing is for copies, the interview is for originals and/or certified copies. You can bring regular photo copies too, but definitely the original. When my IO wanted copies of something I had brought she declined my photocopies, she instead scanned the original into their system instead of making paper copies, she said they're trying to reduce the amount of paper files (hence the many forms that are now available for online filing). 

    It doesn't seem common for them to ask for the US citizen's BC at the N-400 interview, many of us have already been through greencard processes together with our US spouses so USCIS already have copies or the BC since before. Personally I brought my USC husband's BC and passport, but I wasn't asked for anything regarding him at all. But bring what you have just in case, even if it's "just" the passport. It would also be in your spouse's interest to order a certified copy of her BC either way.

    You can try. Worst case you will get an RFE for the birth certificate. You should bring both a copy of her passport and the original passport to the interview. It is possible you won't be asked for it.

    I understand you don't want to remain in the US. But having come all this way, I would just keep the GC and remove condition myself and ultimately go to get citizenship. 
     
    You're not gonna lose anything by keeping it.

    Unfortunately you will have to find another job or find a joint sponsor if you want to sponsor your parents after naturalizing.

    In such case I'd presume you owned some assets, so document and appraise them, and add them to your 864.

    Hey!
    That makes alot of sense and is understandable. As we all know, militarily  personnel and their familes get priority immigration benefits and with the pandemic added into the mix doesn't help with the backlog either. I'm just taking it easy at this point to be honest lol. 8 months?! That is insane. Hopefully things speed up for all of us June filers. Thank you for sharing your personal experience. Thet idea of military famalies went over my head as another possiblity to why things are taking alot longer.
