Threats to report my family to ICE

Hi everyone, I have a question , my husband and I just submitted my I-130 online on Friday and will get the AOS mailed by the end of July , last night we had a bit of a run in a neighbor who has threatend to call ICE on , we're now really worried about what will happen if they show up at my house or at the place I do volunteer work as she knows where it is. What happens if ICE show up? Really concerned.😥

5/10/2021 Received Biometrics appointment notice in the mail

5/26/2021 Status updated to show fingerprints were taken

5/28/2021 Case is ready to be scheduled for an interview

6/07/2021 Received I-693 deficiency notice in the mail (dated 05/23/21)

6/11/2021 Interview was scheduled

6/21/2021 Received interview notice in the mail

7/29/2021 Interview date (Approved on the spot)

7/29/2021 New card is being produced

7/30/2021 Case was approved

8/02/2021 Card was mailed to me

8/03/2021 Card was picked up by USPS

8/05/2021 Received approval notice in the mail

8/11/2021 Received Green Card in the mail

10/13/2021 EAD and AP updated to Case closed, benefit received by other means

Are in status in the US?  If you are out of status, you need to file a proper I-485 asap.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

On another note, why submit I-130 and the rest separate? You could have done concurrent filing, just FYI. Nonetheless, I do not know your reasons.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

When the neighbor informs you of the time ICE is expected to arrive, wait with a jar of lemonade and extra glasses for the "all would be visitors" at the door. Some people are just miserable and they need to be called off at their bluff.

Definitely. Is the petitioner a US citizen?

Filing paperwork isn't illegal. So as long as you're in status you shouldn't have anything to worry about. If not, and the petitioner is a USC, file the 485 ASAP.

Yes husband is a US citizen , I'm out is status . We're working through the I-485 now

There are no benefits in waiting.  Worst case scenario is that you are detained and placed into removal proceeding.   Is that likely?  Maybe not, but it is possible. Once a proper I-485 is filed, you will be granted authorized stay until the I-485 is approved or denied.

We are awaiting two documents , that's the only reason

Great, overstays are forgiven for spouses of USC, so file I485 ASAP and you will have nothing to worry about re. your neighbor.

 

Also, who's to say they will even go through with it anyways... Good luck!
