Denied at interview

I have a very important question. ...My husband went to interview, had all the docs required of us, but at the end of the interview was told that they are sending our petition back to uscis for review. The paper did not say denied, it only said that they were sending it back. Does this mean that we are going to get a NOIR (notice of intent to revoke)?She said our anwsers didnt match and because we did not celebrate afterward that it wasnt real. She didnt even look at our proofs of me visiting every year or the photos we wanted to submit. Anybody experienced this before?

So, both of you were asked questions?  That, in itself, is not normal.

Chat to your husband and ask him which questions he was asked. 

Then you should start preparing to reply to the NOIR when it comes and  I believe prepare a new petition - as this current I-130 is on a track with no definite timeline.

I can only relate my experience with Filing a EOIR and what happened

 

U may get a NOIR or NOID

They sent me a colored paper saying i  could appeal with EOIR 29 form

 

What is Form EOIR 29?

The Notice of Appeal (Form EOIR-29) asks for specific details about the underlying application you filed with DHS. Please refer to the decision of the DHS Officer for specific appeal instructions and for the requested details about the underlying application you filed with DHS.

 

 I did /this took little over a year and our marriage was declared bona fide but told me to reapply (another 2 years)/  

Basically i could have reapplied and skipped the EOIR by addressing a couple of issues with the new petition.

 

when doing the RFE for the issues ,  u need ACTUAL  proof of why the CO is wrong 

CO says u and he did not agree on some answers / u need to find chats or emails where u discussed these and see if it is because of the language differences or not understanding u and being confused.

 

I can only say in our case the CO said "Does she like to read?"  and he said ,  'Yes"  CO asked what books and he said the classics and CO asked latest book and he told the CO "it is about the exploring Dead Sea but i never told him the book title/  Book is Narrative of the United States'  Expedition to the River Jordan and Dead Sea"  Our whole discussion on this was written in a yahoo chat where he asked me what i did all day .  that conversation turned to how my life had changed with death of my husband and me quitting racing.   I also had said i  read online to research items for my mom who was writing her 3 books and he told the CO that and CO said that wasn't reading.  I ended up explaining what i meant by The Classics  and what types of racing i did.

 

This type of actual proof that things were discussed and words like the "Classics" meant nothing to him because of cultural differences and what u may have done to make him understand your life,  your interests,  your family,  even your climate  (all the things 2 people should talk about so he and u know each other well to have a life together.  Actual proof of what u talk about and experience together and how you each perceive 

 

Now,  u must wait about 6 months to hear about the NOIR/NOID and answer the CO with ACTUAL PROOF not a "say so" answer as to why CO is mistaken 

You will be given  a timeframe to get these answers submitted if u do it as RFE 

otherwise,  find your proofs and submit them with a new I 130

So,  ask him now about the CO interview and start preparing your response /I will say your husband probably knows what went wrong

I know it's not the norm but I went to my husband's interview with him and we were both questioned. Fortunately, we had a positive outcome.

Thanks  for responding. I dont understand why I would have to reapply.  I've read in other forums where it only took 9 months to get reaafirmed after the uscis reviewed her case.

When a person is denied at her interview, how does it take for them to send it back to USCIS? and will i get notice letting me know that they have received it?

No set time but 6 months? and yes they will issue a NOIR/NOID.

Six months is a proper expectation, for receipt and then some months for the Notice of intent to Revoke NOIR to arrive.  You will then have the opportunity to respond.  

 

In these situations, the actual reasons for denial you already know about, should be used to determine whether to wait and respond, or to withdraw and file again now.  Without knowing those facts, no further meaningful advice can be provided, except to have the applicant write a detailed report (verbatim) of everything that happened or was said (both ways) by anybody, while at the Consulate.

Why did you go? From what I heard, having USC petitioner at the CR-1 / IR-1 interview overseas usually hurts and doesn't help the case.

It was well over a decade ago and at the time, it was encouraged that the petitioner go to the interview if possible. We didn't have a Stokes interview, we we never separated, the CO merely asked a few general questions.

Hello everyone, I'm hoping somebody reading this can help me.... My husband went for his interview October 4th of 2023.  He had all the documents we needed but Consular said she did not believe it was for the right purpose. I have been waiting for a denial letter cause I am the petitioner, it's been more than 6 months what do I do. I've been calling the USCIS  and they say they have not received it. But Consular said she would send it back for further review. What can I do? The country is Senegal. thanks
