My Husband Lost His Birth Certificate Before My Naturalization Interview

A little back story, I live in California and have been married since 2016, but I've only been a resident for 3 years. I have my N-400 interview tomorrow and I can't seem to find my husband's birth certificate for my interview. I have a copy but it isn't an official copy of his birth certificate. Would this be an issue during my interview?

take the copy 

if they want an original ,  the officer will tell u case is on hold giving u time to produce an original

Even if he was born in another state,  u can order and pay for one online 

take a copy of your copy in case u need to scan it to reorder a new original (just  in case the copy is kept by the office)

Does your husband have a passport?

If so - bring it with you + the copy of his BC.

 

I wasn't asked to show ANYTHING on my N400 interview (even though the interview notice did mention BC as one of the documents I had to bring with me) so most likely you'll be ok.

06/28/2021 - day 1774 - I-751 status changed to 'New Card is Being Produced'; N400 status changed to 'Oath Ceremony Will Be Scheduled'

08/19/2021 - day 1826 (exactly 5 years since day 0) - Oath Ceremony (notice received on 7/19/21)

I would second what @Jeanne Adil and @.yana said: basically, bring what you have. 

There is a chance that they won’t even want it, especially if they already have an original on file. In my case, I had ordered an original BC for my spouse to bring to my interview, but they didn’t even bother looking at it. In the event that they need an original, you’ll have to reorder one.

 Yeah, for my wife's case, they didn't ask to see a single piece of evidence about me, they didn't even ask for our marriage certificate. They mainly asked for evidence showing we were still married (bank account, lease, tax returns) and the rest was all about her. That being said, all of the evidence about me is within scope and the CAN ask for it, if they want.

11/21/2016 - NVC Receives packet

12/12/2016 - Case left NVC for BKK Consulate

01/10/2017 - After travelling via the slowest route possible (likely via carrier pigeon) BKK Consulate receives packet

01/16/2017 - Packet 3 Instructions received 02/28/2017 - Packet 3 Instructions Completed

03/05/2017 - Packet 4 received (now the fun begins) --> 03/29/2017 - Interview disappears from the schedule on the embassy website -->03/30/2017 - She goes to her interview, is told they need to verify her documents since she is Vietnamese interviewing in Thailand, receives a 221G with 'Verification of Viet documents' as the reason. Gave back her passport.-->03/31/2017-04/04/2017 - Case is being continuously touched. We suspect that our case was approved at this point but they didn't have her passport. --> 04/10/2017 (10 days after interview) - Email emabssy to inquire about updates and if there was anything we could do to move things forward. (3h later) - She is told that she is approved and to expect her passport soon (how when they don't have it in their posession?) After clarification, instructed to send our passport to them. Ship out passport in a rush to beat Songkran (which failed) --> 04/11/2017 - Passport at embassy according to Thai Post Office --> 04/17/2017 - Emailed to confirm they received the passport. They issued an evasive answer about Songkran backlog (they love evasive non-committal answers)--> 04/24/2017  Evening - Case changes from Immigrant Visa to Non-Immigrant Visa and a new case created date is given --? 04/25/2017 morning  (less than 12h later) - Case flies through Ready -->Admin Processing --> Issued

04/26/2017 - Checks mail, passport is there. No mention of it being mailed out. 

05/02/2017 - Arrives in the USA, without Issue

06/17/2017 - Marriage!

07/07/17 - SMS and Email notification of NOA1 for AoS, EAD, and AP

I brought my USC husband's birth certificate and passport, but the IO didn't want to see any of it. She was only interested in MY documents, not my husband's. You'll likely be fine without his BC, they have seen it during other parts of your immigration journey.

Order a new certified copy of the spouse's birth certificate. The IO may want to see the original, if you don’t have it it may delay your case. The interview invitation says to bring the original document of the copies of documents that were submitted. 

It should be simple to apply for a new certified copy of his birth certificate from the local or state office that issues them.

K1 Visa Arrived USA July 2017

Married August 2017

AOS Approved July 2018

 

Filed for i751 joint application May 2020

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

 

Filed for Naturalization May 2021

Update: my interview was August 19th and all went well. My officer was so kind, I answered 6 questions and I was done. I didn’t even need my husbands birth certificate just proof that our marriage is bonafide ex. Taxes done together. This was 25 years in the making for me. I came to this country at 8 months so it was a bit of an emotional day but, I can finally say I’m a U.S. citizen 🇺🇸
