"Your Visa is Nearly Approved"

Hi all, 

 

Just need to find out some info since my fiance is panicking a bit after her interview. She is Ukrainian and just finished up her interview in Frankfurt, but they gave her a packet that says "Your Visa is Nearly Approved". What does this exactly mean? She said for the most part that her interview went smoothly but they grilled her on one question about her B1 tourist visa that she received back in 2019. She wanted to come see me but thought she would be denied by border patrol if she said that she was going to see her boyfriend, so she instead lied then and said she was going to New York City. They asked her this exact question during the interview and she told the truth that she was actually seeing me. 

 

I was expecting things to go fairly smoothly, but she said she was caught off guard during this question and is super nervous now since they packet doesn't just say "Approved". At the end of the interview they told her that everything looks fine and that she can go now, and provided her this packet. Any advice is very helpful.

Not anything to do but to wait for the final administrative tasks to be completed. Your post will have reminded others of the way in which telling less than the whole truth to USCIS comes back to bite us .

Ugh. Not what I wanted to hear but it is reality. To add to that, they canceled her tourist visa and said that since she is applying for an immigrant visa (K1), then the tourist visa needs to be canceled.

That is the standard process .. immigrant intent as demonstrated by the petition negates visit intent. Hopefully it wont be long before you see “issued”. Receiving the info packet you described is a very positive indicator. Did they keep her passport ?

So, she misrepresented herself to gain a B2 visa....... Normally, a denied B2 (for lack of country ties) wouldn't have a negative effect on an immigrant visa application.  Canceling her B2 is normal procedure.   Please let us know what happens.  The CEAC status should change to "issued".  Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yeah, they said they will give it back in a week. I have attached the document they provided her after the interview

Thank you for the positive vibes. Was expecting a different morning but this process has been stressful the entire time so I’m not surprised we’ve been thrown another curveball

I really think its less of a curveball than you are feeling.. if there were significant concerns  regarding the previous visa, then she would have most likely received a 221g notice, not had her passport kept and not given the info you posted. Most likely the IO was wanting to see if she answered honestly .. they dont ask questions for which they don't already know the answer..  and it sounds like she passed that “test”… keep breathing 😁

No, she said in the DS160 when she applied for her tourist visa back in 2019 that she did not have any relatives, etc. in the U.S. and that she was going to visit NYC as a tourist rather than visit me. She was afraid that she would be denied to come see me when we were first dating if she had said she was seeing her boyfriend given some people try to stay in the country after they are approved on a tourist visa. During the interview she came clean since they asked her about it.

Thank you, i understand now, the co during interview check the previous visa and can ask questions about it.

It might be a new nomenclature they use in Frankfurt.  Visas cannot really be approved at the interview.  The interviewing CO may be satisfied, but they still have to run a background check as part of the administrative process, or at least verify all the documents she submitted at the interview.

 

Many times people post here that they were "approved" at the interview yet their status online showed AP or "Refused" and some verbage about administrative processing.

Just my personal opinion but even despite the fact that she didn't say the full truth while entering in 2019 - she did not overstay, did not marry you, did not AOS. You guys still did everything correctly from USCIS standpoint. Hopefully that means she gets her visa soon!
