Working & Traveling when 2-year Green Card Expires

Hello, 

 

My wife just got her conditional green card for 2 years after getting her K1. When it expires in 2 years, how will she be able to work and drive legally when it expires and we wait for her 10 year GC? 

 

Looking for some help!

She'll receive an extension letter when she files to get her conditions removed.

If the extension letter expires while her 10 year GC is still pending - she'll make an infopass appointment to get an I-551 stamp in her passport.

08/31/2016 - day 9 - electronic NOAs received via text and email, check is cashed.

09/08/2016 - day 17 - biometrics appointment notice received in the mail (appointment date 09/19/2016).

09/13/2016 - day 22 - early biometrics walk in.

10/28/2016 - day 67 - EAD status changed to "New Card Is Being Produced".

11/16/2016 - day 87 - EAD card received in mail.

06/27/2017 - day 309 - contacted the congressman office.

07/28/2017 - day 340 - finally received an interview appointment in mail (online status has not changed).

08/31/2017 - day 374 - Interview; I-485 status changed to 'New Card Is Being Produced'

09/08/2017 - day 382 - greencard received in mail

03/16/2021 - day 1670 - N400 Interview - passed; due to I-751 stuck in another office 'No decision can be made at this time'

06/01/2021 - day 1747 - with help of Sen. Sanders' office, I-751 file finally forwarded to St. Albans field office

06/28/2021 - day 1774 - I-751 status changed to 'New Card is Being Produced'; N400 status changed to 'Oath Ceremony Will Be Scheduled'

08/19/2021 - day 1826 (exactly 5 years since day 0) - Oath Ceremony (notice received on 7/19/21)

Timeline

Her status will not end after 2 years.  She will file an I-751 package to remove the conditions on her green card.  When she does that, she will receive a letter which extends the expiration date on the card for 2 more years while you wait for the 10 year card.

 

Even after the extension letter expires, her status does not expire.  If she then needs proof of her status, she can request an infopass appointment at USCIS to get an ADIT stamp in her passport.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We are in the process right now filing I-751. I was also wondering what will happen after her card expires in September and how we can travel in November. Thankfully VJ answered all my concerns :) Extension letter until she receive her 10 year GC.

If you were unaware of this process, it is a good time to get organized for it now, because even if you don’t have an interview, you will want to submit a complete package. The more complete the package, the less likely you will have an interview.

 

During this time, make sure your wife is added to all of the utilities and that you get bills in both of your names. Add her to your lease, if that applies or add her to your deed. To show that you have joint ownership. Add her to vehicles, and insurance. Other things to show are bank statements with both of your names as owners of the accounts. Making sure you have deposits and pay household bills out of a shared account.,  it is acceptable to both have your own accounts for your own purposes, but you should have a joint account that is used to fund joint living expenses. Keep copies of shared credit cards, medical insurance cards if one of you covers the other, telephone plans, and also any trips taken together. Right after we got our conditional green card, I kept a separate file with all of the new information that came in the mail. I especially saved any pieces of mail that had both names on them. Putting together a removal of conditions package can actually be a big job, so it is good to get organized early on and also have a good history of shared expenses together.

I trust that you had an interview for your adjustment of status for your 2 year conditional green card. If when you file your I751 you send a lot of evidence (joint Bank account, Joint Utility Bills, joint credit card bills , Insurance policys with each other as benificiries, joint auto loans and insurence, joint lease etc etc ) you may not get called for an interview. We didnt and I sent a lot of what I described. Massachusetts Motor vehicles will renew your license with a 24 month extension letter. You are also allowed to work and carry on as usual. International travel is ok too. Start saving your evidence starting yesterday, dont wait to start as a well equiped package will make your life go a lot smoother.

There is no way to predict who will have an interview and who won’t. Some people that have already had one for AOS have an interview again, some don’t. That’s nothing you can control. There is a recent memorandum that leans towards waiving I751 interviews for those that already have one, but again, nobody really knows who will go for one and who won’t.  
But what you CAN control is the quality of evidence that you put together for your package. As @bakphx1 has rightfully stated, preparation is key, so that you’re not rambling the last minute to put the package together. Right after my GC approval (my interview was waived) and even before then, hubby (USC) and I (beneficiary) started purposefully trying to make evidence. For example, opening a joint bank account and paying for our joint bills together. Adding each other to our health insurance/ retirement accounts/ life insurance. Also, as soon as I was approved I made an envelope, labeled it “ROC” and started gathering evidence there, little by little. For example, pieces of mail to each of us but showing the same address. Receipt for State taxes, insurance cards, etc. Then a month before my window opened, all I had to do was to organize the evidence I already had (in addition to filing out the I-751 form).

Also , the evidence you present has to cover the period between the moment you get your conditional GC and your window for your I-751, so that’s why I had been collecting it throughout that time period. It just made things easier.

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
